1. So Barr is trying to pretend that Berman is gone and says an A-USA is now acting USA for SDNY. IMO statute is clear on its face that SDNY judges have decided Berman is the USA until Trump gets his replacement through the Senate. So Barr is likely just telling Trump that
2. it's all handled when clearly Berman is still the lawful US Attorney for SDNY. The confusion will be a defense attorney's dream. All the actions will be claimed to be ultra virus and void. Just watch. But for now, Berman is still there and waiting for the SCOTUS okay to start
3. indicting Trump, his family and associates. Also, I think the 2000 DOJ Office of Legal Counsel memo is unconstitutional and the #SCOTUS will rule that not indicting because you might be fired is official corruption and grounds to discipline any attorney that obeys the memo.

1. William Barr is a practiced dissembler. You have to watch him carefully. He said that the Insurrection Act (the "Act") can be used to quell rioting. A riot is not an insurrection. The Confederacy was an insurrection not a riot. Moreover, the Act can't be employed in DC.
2. The Act provides:

"Whenever there is an insurrection in any State against its government, the President may, upon the request of its legislature or of its governor if the legislature cannot be convened, call into Federal service such of the militia of the other
3. States, in the number requested by that State, and use such of the armed forces, as he considers necessary to suppress the insurrection."

The Act defines "state" to include Guam & Virgin Islands. See 10 U.S. Code § 255. It does not include DC within the definition of "State."

1. All this brings back memories of the Miami Riots. I recall my brother telling me what they did to make sure the cases were handled right after loosing major police shooting cases. They found that letting the police run the investigation resulted in claims of the fix being in.
2. So Janet Reno assigned a major crimes prosecutor supervisor to be on duty 24/7 with a beeper. It rotated. They gave them pistols to carry into the murder scene. Armed lawyers. So when there was a police shooting meaning a police officer shoots a citizen or a citizen shoots
3. an officer, the duty prosecutor rushed to the scene and took control, secured the evidence took the initial statements. The quality of the forensics improved drastically and the cases stayed winnable free from the public perception of a thumb on the the scales of justice
