2/Earlier this week, our client Brian Murphy, a member of the Senior Executive Service at the Department of Homeland Security (“DHS”), filed a whistleblower complaint dated September 8, 2020, with the Department’s Office of Inspector General.
3/The complaint alleges multiple protected disclosures of alleged wrongdoing by various DHS officials at the senior levels. A copy of the complaint was also transmitted to the relevant Congressional oversight authorities.
4/It was brought to our attention that there was a factual error in the complaint pertaining to former DHS Secretary Kirstjen Nielsen’s Congressional testimony of December 20, 2018, wherein we had asserted she publicly testified ...
5/...that 3,755 known or suspected terrorists had been prevented by DHS from entering the United States. That information, however, was not part of Secretary Nielsen’s public testimony and we regret the inadvertent error.
6/That figure, instead, was part of a power point presentation presented to Congress by the White House, at a meeting which Secretary Nielsen led, on January 3, 2019. whitehouse.gov/wp-content/upl… (slide 4).
7/Today, we submitted a supplemental clarification to the DHS OIG and the Congressional oversight committees. As we did not publicize the initial complaint, nor shall we disseminate the supplemental clarification.
8/We are not responsible for any steps Congress may lawfully take with respect to release of the document.
9/Subject to this clarification, Mr. Murphy stands by the substance of his complaint and looks forward to independent, objective investigations by DHS OIG and any interested Congressional committees.
