Art. 15 of the Lisbon Treaty for the first time recognized the gathering of prime ministers and EU leaders as an institution: the European Council. It however limited its powers to providing “general political directions” and specifically clarified it was not a legislator (2/6)

Enter 2015 migration crisis. European Council comes in to settle the tough negotiations on the relocation of the migrants. It asks the Council to settle the matter through consensus (meaning unanimity) and agrees to a preliminary mechanism (3/6)

@EU_Commission, @EUCouncilPress and @Europarl_EN then go on to agree on a package through qualified majority voting. Hungary voted against. Unhappy it seized the Court. Below the Hungarian main argument back then. Sounds familiar doesn´t it? (4/6)

Orban lost the case. Why? Because the EUCO cannot singlehandedly change the Treaties. It cannot even legislate. The Commission and the Council put it clearly. So did the Court. Mr Orban who are you trying to kid? Agree to the MFF and the Recovery package (5/6)
