Supreme Court bench led by Justice AM Khanwilkar to hear an appeal against the Delhi High Court order which refused to stay the removal of Ashok Arora from the post of Secretary, Supreme Court Bar Association (SCBA) #SupremeCourt #SCBA
Advocate Ashok Arora seeks permission to argue in person
SC: you have to discharge the Advocate on Record. You should know you are an officer of the court
SC: the correct procedure is if you engage an AoR then you have to discharge him.
Arora: I will do that My Lord. May i make a statement or move an application
Arora: I can make a statement that I withdraw the AoR. I have been told by my AoR to discharge him. Sandiv Kalia appears on behalf of AoR.
Kalia: We are willing to be discharged.
SC notes the discharge. AoR Dr Sushil Bilwada is not before us and is represented by Sandiv Kalia and makes a statement that AoR should be discharged. On basis of this oral statement, the AoR stands discharged.
Now you argue Mr Arora
Arora: I am refraining from reading all sequence of events as its disgusting. I am seeking interim relief as they have suspended me and its continuing. Please look at the letter of SCBA annexed. Now look at the names, it says Ashok Arora, Honorary secretary under suspension.
SC: make a request them and say you don't want this to be circulated. Please understand under suspension is inappropriate according to you so make a request.
Arora: The interpretation by the HC is erroneous
Arora: Members had signed a declaration that Mr Dushyant Dave had insulted the bar by boycotting an event attended by 25 countries.
SC: where is the suspension notice to you? Is there any reason recorded there ?
Matter adjourned to Tuesday due to audio issues.
