The changes would, among other things, do the following: 🔽
1⃣Require all asylum apps be filed within 15 days of an asylum seeker’s first court hearing.
2⃣Assess a filing fee for all asylum apps, for the 1st time in U.S. history with no opportunity for a waiver of the fee.
3⃣Place onerous burdens on asylum seekers to ensure their apps are accepted by the immigration court, including permitting outright rejection of applications that do not conform to specific form-filling instructions and providing limited opportunity to remedy errors.
4⃣Change the role of the immigration judge from a neutral arbiter to one that can enter its own evidence into an asylum seeker’s case regardless of the parties’ position on that evidence, and permitting an immigration judge to deny asylum apps w/o considering any evidence.
5⃣Shift the burden from the gov't to the asylum seeker to prove certain elements of asylum applications, and to ensure evidence is admitted in court.
6⃣Narrow the definition of torture, and the scope of protection under the Convention Against Torture.
7⃣Limit the types of harms that can make one eligible for asylum, essentially prejudging claims, and ruling out claims based on domestic violence, LGBTQ persecution, and harms committed by transnational criminal organizations
We hope and expect for @JoeBiden to take bold executive action to rollback the impact of ALL of these regulations in the first days of his administration.
Leading this department will be no easy task, but we hope that as the 1st Latinx & someone who has advocated for immigrant rights, he'll change the direction of DHS once and for all.

We look forward to the immediate expansion of the program AND the dismantling of the detention and deportation machine that was created under Obama and expanded by Trump.
@DHSgov is a department that was built in the wake of 9/11 to protect the U.S. from terrorists — only for it to now be used to terrorize immigrants.
The new Biden admin must recognize this and immediately change course.

We are extremely concerned about President Trump's nominee. Amy Coney Barrett is not good news for immigrants. She is publicly supported by the Center for Immigration Studies, a Southern Poverty Law Center designated anti-immigrant hate group.

URGENT: More family separation happening at the border. This time our client, a vulnerable 15 yr old girl how came to the US as an infant, was taken by @CBP after arresting her aunt at a hospital. She was taken after surgery & tested positive for COVID-19. cbsnews.com/news/15-year-o…
The minor was taken to Edinburg hospital because of pain caused by a gallbladder stone. She was accompanied by her aunt. Someone notified CBP about them. They showed up at the hospital and took her aunt. The minor was then left alone.
Shortly after, she was transported in an ambulance to the San Antonio hospital with agents following them while the parents were not present. The hospital called the parents to say she was going to be transferred to San Antonio to have surgery.
