1. Members of Congress generally can't be sued for what they do officially because they are covered by the Federal Tort Claims Act. They also have limited immunity derived from the Speech and Debate Clause Art. I, Sec. 6, para 1 that provides as follows:
2..in all Cases, except Treason, Felony & Breach of the Peace, be privileged from Arrest during their attendance at the Session of their Respective Houses, & in going to & from the same; & for any Speech or Debate in either House, they shall not be questioned in any other Place.
3. IMO joining conspiracy to overthrow US with force, as Trump & Flynn have admitted they intend, would be treason and a felony so no Congressional immunity. Focused just on advocating overthrow, by voting to advance Trump's announced plan, IMO a reasonable juror
4. could find they have agreed to the criminal purpose the stated intent to overthrow by force. Other evidence of statements they have made and actions they have taken could be used to prove they independantly advocated overthrow.
5. In sum, any of these @SenateGOP @HouseGOP who advocate overthrow can and should be indicted and because they clearly pose a threat to the Republic, and likely will face charges that by statute can exceed life in prison, they should be denied bail pending trial in DC.
6. IMO @ttuberville is already close, if not beyond, the point of no return and could be arrested if he appears in DC. It's likely best to just wait for him to confirm that he has joined the conspiracy and the seek a grand jury indictment after January 20.
7. We have all the tools we need to deal with this conspiracy but we need to have steel in our spines and be willing to take the actions that the law and Constitution prescribe for these circumstances.
