Delhi High Court will shortly hear a petition concerning #COVID19 situation in the national capital.

Listing it for post-lunch session, Court sought info from Centre on the issue of shortage of oxygen.

"Industries can wait. Human lives once lost are lost", Court said.
A Division Bench of Justices Vipin Sanghi and Rekha Palli asked the Central Government to state which are the industries to whom supply of oxygen cannot be curtailed.

Ramping up testing aspect:

There are certain aspects that need to be addressed by Central Government and its agencies: Court
We are informed that RTPCR test equipment are imported and the machines are dealt with routinely by customs at Port. It is essential that all such medicines etc are cleared on top priority. We direct Centre to issue necessary directions forthwith: Court
Procedure for clearance is highly time consuming. We do not wish to impinge on ICMR authority and we don't expect it to relax its standards. However we direct ICMR to give top priority to such clearances for setting up/expanding RTPCR test labs : Court
Next is the software device for uploading test results. Patients are required to give aadhaar card. Despite this, we are informed that agencies are required to fill details online.. we direct Centre, Icmr to review the form in which info is to be given by agencies: Court
This appears to be acting as a bottleneck in preparation of reports : Court
We have also noticed reports about the critical medicines falling in short supply and being sold in premium in black market : Court
We direct Centre and its agencies particularly the Drug Controller to issue necessary directions to all licensees. Govt should undertake checking on regular basis to unearth all such cases of hoarding : Court
The affidavit discloses that for remdesivir, 10.4 lakh vials were supplied to all States and UTs in last ten days..dgci has granted permission for manufacturing at 20 additional sites : Court
Centre should dynamically review distribution of remdesivir to States and UTs on the basis of the need/serious active COVID patients: Court
This is essential to maximize efficient use of life saving drug : Court
There are a number of other drugs which are in use such as Ivermectin, Dexamethasone, Prednisolone..as per news reports, there is shortage.. looking at the emergent situation, we direct Centre to interact with the manufacturers/patent holders/licensees to ramp up capacity: Court
We may take note of the fact that the Patent Act provides for compulsory licensing under Section 84.. section 92 .. Section 100. Looking at the present day situation, there can be no doubt that a case is made out for exercise of this power : Court
Interest of Patent holder should be kept in mind : Court
Best course would be to encourage the existing manufacturers to ramp up their production on a war footing. They should be encouraged to grant voluntary license to manufacture: Court
If such efforts do not fructify, the Govt/Controller should not hesitate to invoke their power under Patent Act since lives of the people which are being lost at a very fast pace take priority over everything else: Court
Such patent holders can be compensated by fixing a fair lisence fee : Court

Vaccine wastage:

As per one report, as many as about 44 lakh vaccine have been wasted out of ten crore. This is because of the restriction with regard to age/ categories of the people: Court
Govt has recently announced that from May 1, all above 18 years can be vaccinated. Wastage of vaccine is a criminal waste. We direct Govt to look into situation to permit full utilisation of vaccine : Court
We are informed that each vial has ten doses once it is open. It has to be either fully consumed or it does to waste. It should be possible for the govts to device means to register volunteers aged 18-45 years to take the vaccine if there are doses left after say 5 pm: Court
That would ensure that all doses are fully utilised. This flexibility is available in other countries such as USA. Govt should modify their cowin mobile app urgently : Court
Earlier I said that 622 beds are there in Centre hospitals. 2105 beds are currently available in Delhi in AIIMS etc. Besides that by today, we going to 4091 beds already. It will be done by today with the help of other govt facilities: Ms Roli
