Court had sought an explanation from the Central and State governments on how Remdesivir, which is scarce in supply, can be distributed through a parallel channel by political and film personalities.
Court asks if there is any audit on the quantity of drugs being supplied and drugs being administered and the deaths occurring in the hospitals; if there is any tally on those figures.
Court: We cannot do micro and macro management. We have to see that the system is smooth and there is no bottle neck. That no patient suffers for lack of oxygen or drugs etc. We cannot look at the nodal officer level, what needs to be done.
Court: You have to show us that there was demand for vials. You have to show us such orders.
We have power to strike down an arbitrary decision, but you have to show us. You have to lay down that foundation.
Adv Arshil Shah informs the Court that Crystal hospital has moved Supreme Court that there is no oxygen supplied to them.
The State is only giving us digits but they are not showing compliance.

Court: So against that he has moved to Supreme Court?
Shinde: Yes, that is what he is submitting.
Court: Well then let Supreme Court decide.
Court: Anybody has the right to move to Supreme Court.

So the number of patients are falling, the demand for oxygen is not?
