In Johnson v. Precythe, the Supreme Court allows an execution method decision — Missouri, pentobarbital — to stand that Johnson has "plausibly pleaded," the dissenters say, will be torturous for him. He sought to be executed by a firing squad instead. SCOTUS won't hear the case.
The conclusion from Sotomayor's dissent, in which Breyer and Kagan join:
Breyer wrote a second dissent, for himself, to "add that the difficulty of resolving this claim, 27 years after the murders, provides one more example of the special difficulties that the death penalty, as currently administered, creates for the just application of the law."
One or more opinions in argued cases coming at 10a.
The first #SCOTUS decision is in US v. Palomar-Santiago. Sotomayor has the opinion for a unanimous court, reversing the 9th Circuit in a case about the standards for challenging unlawful reentry charges. The decision makes such challenges harder for some. supremecourt.gov/opinions/20pdf…
There will be at least one more opinion, coming from Sotomayor, Breyer, Thomas, Alito, or the Chief Justice.
The last #SCOTUS decision today is in Guam v. US. The unanimous decision for the Court is by Thomas, reversing the DC Circuit in a case over the Ordot Dump and in a win for Guam in its efforts to get money from the US over the dump. supremecourt.gov/opinions/20pdf…
Twenty-seven merits #SCOTUS cases remain for June decisions. Next expected decision date would be Tuesday, June 1.

Krasner is winning 2-to-1 in the first batches of both mail & in-person ballots. Obviously not enough to tell us much, but it is an initial sign that early & day-of voting mightn’t be as divergent in this race as in the presidential.
If this stands, we’re also headed to a blowout — and yet another sign that a lot of folks at the national level (writing end-times stories) really don’t have a good handle on how much thinking is changing around public safety and criminal justice on the ground across the country.

This is a majority opinion by Judge Brasher limiting application of the First Step Act. The 11th Circuit ruling conflicts with every other appellate ruling — including ones from the 2nd, 4th, 5th, 6th, 7th, 9th, 10th circuits, per Berman.
Brasher is a 39-year-old former Alabama SG who was nominated to the 11th Circuit by Trump six months after he started work as a district court judge.
He was joined in the majority opinion by Judge Luck, a 42-year-old Trump appointee.

The dissent was from Judge Martin, a 65-year-old Obama appointee who was one of his first five appellate court nominees in 2009.

From the start, Biden acknowledges that police are being tasked with many jobs today, including "responding to incidents involving domestic violence, substance use disorders, mental health challenges, and homelessness."
Then, there's a bit that might track closer to an old-school Biden speech on cops.

So, unless I read this wrong, some timing elements here are left out or left intentionally vague:
* The story addresses "toll records ... from April 15, 2017 to July 31, 2017"

* ... "obtained" by the "Trump Justice Department."

* Reporters informed of this in a May 3 letter signed by current DOJ officials (ie, Biden DOJ).

When were they sought? When obtained? Unclear:
Does "it" mean they were sought in 2020? Obtained in 2020? Both?

The story also leaves unclear whether whichever of those it was (were?) happened under Barr, or after, under Rosen?
