One of the founding members of the Indian Freedom Foundation, Nikhil Pahwa has come forwarded and challenged the new IT with several of his claims through a Twitter thread.
Nikhil initiates saying that even if the deadline won't get extended, the Govt is unlike to (2/n)
enforce all the provisions & hold platforms to account unless it really needs to because the platforms could then move the court to challenge the guidelines.
The government was expected to issue a set of FAQs which clearly aren’t ready yet. The rules are in itself are (3/n)
completely messy and the ministry of electronics and IT will likely seek the extention of final dates.
The few rules which the government wants the apps to comply with and Nikhil’s counter over the rules are explained below-
1. The requirement for platforms to have a (4/n)
grievance officer is old. For years after that provision came into being, most platforms did not have a grievance.
2. There is a negligible chance of the government blocking US-based platforms because of the power that the US government wields. There is ZERO chance of the (5/n)
Indian govt blocking US platforms when Jaishankar is in the US to engage with the US government.
According to him, these rules give the govt of India a stick to wield. Arbitrarily. They'll use it to threaten, intimidate, bully. (6/n)
