What is the position, court asks.

Adv Priyanka Tibrewal says most of the affected persons appeared before the Committee and were taken back to their houses.

They admitted before the Committee that they were out of their houses and were not allowed to enter
Whatever I argued before this court (on those people being threatened and prevented from going back to their houses) came out to be true before the committee: Priyanka Tibrewal
Tibrewal says she has received more emails from people who have fled their houses.

Only those people who have access to email have been able to contact me: Tibrewal.
And I have only raised issue regarding Entally.

The situation is same across West Bengal. There are more such people: Tibrewal
Tibrewal asks for 10 days time to bring on record situation of more such people from other parts of West Bengal
Court asks whether there is any record to show these people had initially contacted the police and no help was forthcoming.

Tibrewal says she has records of representations/ communication to Police.
Advocate General Kishore Dutta request that the report of the committee be circulated to the State so that the State can assist the court.

Dutta also says it is possible that these people had not approached the Police.

We got information fro news reports that some petition has been filed in Gauhati High Court .

We read in Bar & Bench, Livelaw that some petition was filed: Acting CJ Rajesh Bindal.

#westbengal #postpollviolence
Court says first priority of court is to ensure that people displaced are rehabilitated to their homes.

AG has been instructed to say there is none: Acting CJ Bindal
AG Dutta says that is court's prima face opinion and he would like to take the court through his affidavit in detail.

Bench tells AG these are only tentative observations and not any order or conclusion.

Court dictating order:

The Committee has submitted its report giving details of the process carried out by them for rehabilitation of residents in Entally Constitutuency who were not allegedly allowed to go back to their houses after State assembly polls.
Let a copy of the report be supplied by Registrar (Listing) of this Court to counsel appearing for parties in the bunch of petitions listed before the court today.
Ms. Priyanka Tibrewal has filed a supplementary affidavit stating that she has received communications from number of persons from different districts in West Bengal facing similar problems
Sr Adv Bikash Ranjan Bhattacharya submitted that some people have been threatened by local police that they will not be allowed to live peacefully since dared to approach the Police.
Copy of the said affidavit be served on State of West Bengal.
Anyone in the State who is not being allowed to go back to their houses due to post poll violence shall be at liberty to lodge complaints on the website of West Bengal State Legal Services Authority
They can send their complaint to the email id provided in the additional affidavit of State.
In addition, persons having aforesaid grievance shall be at liberty to send their complaints to email id of West Bengal Legal Services Authority.
On receipt of such grievance, the competent authority should take necessary steps for rehabilitation of such persons and report to this court.
At this stage, Ms. Tibrewal pointed out that many people can't read and write and won't be able to send their complaints to police or State Legal Service Authority.

Liberty granted to counsel to send composite complaints on the designated email id on behalf of such persons
