#CapitolRiot: The DOJ is asking for a 60-day continuance. Says plea offer still has not been made to the Buteaus. No objection from the defense. @wusa9 @EricFlackTV
#CapitolRiot: Judge Moss grants the continuance. We'll be back in 60 days. Hearing over.

#CapitolRiot: John Lolos will be pleading guilty to count 4 against him, which is parading, demonstrating or picketing in a Capitol building. It's a misdemeanor that carries up to 6 months in prison. @wusa9 @EricFlackTV
#CapitolRiot: Lolos is quibbling with some language in the plea agreement that requires him to disclose financial information to the government. DOJ says it's a standard requirement of the plea deal. Lolos says "I don't agree with it" but he'll do it. @wusa9 @EricFlackTV

#CapitolRiot: Alright, tuning in to the sentencing hearing for Joshua & Jessica Bustle. They both pleaded guilty back in June to one misdemeanor count of parading in a Capitol building. @wusa9 @EricFlackTV

#CapitolRiot: The DOJ says it has reached a plea agreement with Virginia Spencer. Still producing discovery for Christopher Spencer, who faces the much more serious obstruction of an official proceeding felony charge. @wusa9 @EricFlackTV
#CapitolRiot: Virginia Spencer will be pleading to one misdemeanor count of parading, demonstrating or picketing in a Capitol building – the same count most other misdemeanor defendants have pleaded to. It carries a max sentence of 6 months. @wusa9 @EricFlackTV

Most, if not all, of the #CapitolRiot defendants facing the big, 20-year-maximum obstruction charge have put forth some version of this argument. None of them have met with success so far in that regard.
#CapitolRiot: Judge Randolph Moss is laying out his view that January 6 was, in fact, an official proceeding. Says it was prescribed by the Constitution. Arguments were made and objections were heard and ruled on. Etc. Not just a perfunctory event.
#CapitolRiot: I think I astral projected out of my body for a second, but I'm back now and they're still arguing about this.
