#CapitolRiot: Good morning. We start off today with a status conference/arraignment for Jennifer and Jamie Buteau, two #QAnon adherents from Florida. The DOJ recently filed a new indictment against them in connection w/ January 6. @wusa9 @EricFlackTV wusa9.com/article/news/n…
#CapitolRiot: As I previously reported, Jamie Buteau is facing the more serious charges of the pair. That includes assaults on federal officers inside the Capitol. @wusa9 @EricFlackTV
#CapitolRiot: The DOJ is asking for a 60-day continuance. Says plea offer still has not been made to the Buteaus. No objection from the defense. @wusa9 @EricFlackTV
#CapitolRiot: Judge Moss grants the continuance. We'll be back in 60 days. Hearing over.

#CapitolRiot: Final hearing of the day is a plea hearing for John Lolos, who was pulled off a plane in DC in January after repeatedly shouting "Trump 2020!" and subsequently charged in the riot. @wusa9 @EricFlackTV wusa9.com/article/news/n…
#CapitolRiot: John Lolos will be pleading guilty to count 4 against him, which is parading, demonstrating or picketing in a Capitol building. It's a misdemeanor that carries up to 6 months in prison. @wusa9 @EricFlackTV
#CapitolRiot: Lolos is quibbling with some language in the plea agreement that requires him to disclose financial information to the government. DOJ says it's a standard requirement of the plea deal. Lolos says "I don't agree with it" but he'll do it. @wusa9 @EricFlackTV

#CapitolRiot: Alright, tuning in to the sentencing hearing for Joshua & Jessica Bustle. They both pleaded guilty back in June to one misdemeanor count of parading in a Capitol building. @wusa9 @EricFlackTV
#CapitolRiot: The DOJ is asking for 1 month of home confinement for Joshua and 3 months for Jessica, plus two years of supervised probation for each. Also says it is not asking for a fine in Joshua's case. @wusa9 @EricFlackTV
#CapitolRiot: The DOJ argues Jessica Bustle's posts after the riot – in which she both admitted she "stormed" the Capitol but also tried to downplay what happened – warrant a harsher sentence than the one it's requesting for her husband. @wusa9 @EricFlackTV Image

#CapitolRiot: We start off today with a plea hearing for Karl Dresch, of Calumet, Michigan. The DOJ says Dresch posted photos of himself inside the Capitol with the caption, "We the people took back our house... now those traitors know who's really in charge." @wusa9 @EricFlackTV ImageImage
#CapitolRiot: Karl Dresch will be pleading guilty to one misdemeanor count of parading, demonstrating or picketing in a Capitol building. Judge Amy B. Jackson says because he has been in custody since his arrest, he will be getting time served. @wusa9 @EricFlackTV
#CapitolRiot: After assuring he understands what's happening and what rights he's giving up, Judge Amy Berman Jackson asks Karl Dresch what plea he would like to enter today.

"A plea of guilty, your honor," Dresch says. @wusa9 @EricFlackTV

#CapitolRiot: Next up: A hearing for Christopher and Virginia Spencer (NC). The DOJ says Christopher Spencer recorded himself inside the Capitol asking, "Where's Nancy's office?" and, "Who would've knew the first time I ever come would be to storm?" @wusa9 @EricFlackTV
#CapitolRiot: The DOJ says it has reached a plea agreement with Virginia Spencer. Still producing discovery for Christopher Spencer, who faces the much more serious obstruction of an official proceeding felony charge. @wusa9 @EricFlackTV
#CapitolRiot: Virginia Spencer will be pleading to one misdemeanor count of parading, demonstrating or picketing in a Capitol building – the same count most other misdemeanor defendants have pleaded to. It carries a max sentence of 6 months. @wusa9 @EricFlackTV

Most, if not all, of the #CapitolRiot defendants facing the big, 20-year-maximum obstruction charge have put forth some version of this argument. None of them have met with success so far in that regard.
#CapitolRiot: Judge Randolph Moss is laying out his view that January 6 was, in fact, an official proceeding. Says it was prescribed by the Constitution. Arguments were made and objections were heard and ruled on. Etc. Not just a perfunctory event.
#CapitolRiot: I think I astral projected out of my body for a second, but I'm back now and they're still arguing about this.
