Most, if not all, of the #CapitolRiot defendants facing the big, 20-year-maximum obstruction charge have put forth some version of this argument. None of them have met with success so far in that regard.
#CapitolRiot: Judge Randolph Moss is laying out his view that January 6 was, in fact, an official proceeding. Says it was prescribed by the Constitution. Arguments were made and objections were heard and ruled on. Etc. Not just a perfunctory event.
