#BombayHighCourt is hearing clutch of petitions pertaining to grant of permission to lawyers and registered clerks to travel by Mumbai Suburban trains.
ASG Anil Singh states that once there is a letter from the State Disaster Management authority, the railways will agree to grant of passes.
Not only for tickets, but tri-monthly, half-yearly season tickets.
Adv Alankar Kirpekar appearing for petitioner Mohan Bhide who sought for permissions to people who have been fully vaccinated states that the effectiveness of the vaccines has been considered by a medical college in Vellore which he has submitted to the AG and ASG’s offices.
Kirpekar: This has to be considered for the larger audience also. I am glad this is being considered for us lawyers…
AG: It also states yardsticks...
- the RT-PCR positivity rate has to be below 5% consistently for two weeks,
- there has to be 70% full vaccination coverage and
- zero tolerance for non-adherence to Covid-appropriate behaviour.
AG: If we take into account the number of citizens who are vaccinated and those who have been exposed to the virus, there is still at least one-third of our population that is unexposed. The circulation of the virus is shrinking, but this one-third population is susceptible.
AG: Let’s say if local trains are opened, it is this susceptible population that will be fast infected.
Court: But what about the 70% population? Why cannot you have dedicated counters for the same?

Sr Adv Milind Sathe: If we start this at Churchgate.. (laughs)
Another lawyer on behalf of Maratha Patrkar Sangha (union of Journalists) stated that journalists have not been allowed to travel by train.
Court: no that is not right. I think they are.
CJ Datta: I am telling from personal experience. A photo journalist from Kolkata came to visit me. I asked him how he reached (from Andheri). He said by train. I asked him how is he permitted? He told me that he showed his press card, and he was permitted.
Court: One suggestion, please do not compare Mumbai with Nagpur, Nashik, etc. This is city with special needs. There is a city with large number of population. Why are these issues to be raised in PILs only? Why not have a special committee?
Court: Travelling for people is very important as poor people cannot spend so much to travel. It is a matter of people’s livelihood. If that is the approach then everything is fine. Considering the complexity involved.

Full Bench of #BombayHighCourt to hear today the suo motu writ petition on the extension of protection to those who are unable to access justice because of the restricted functioning of the courts effected by the COVID-19 pandemic.
Full Bench consisting of CJ Dipankar Datta and Justices AA Sayeed, SS Shinde and PB Varale had extended the life of interim orders passed by itself as well as subordinate courts and tribunals that fall under its jurisdiction till August 13, 2021.
Court: The interim order is till aug 13, and we will extend it till Aug 31 one last time.
So whoever has been enjoying protection so far will get 2 weeks time to approach Courts.
