#MadrasHighCourt hears petitions challenging #ITRules2021. Earlier this week, the Court had pulled up the Central govt for delay in filing its counter affidavit in the matter.
Matter is before Chief Justice Sanjib Banerjee and Justice PD Audikesavalu.
UOI is yet to file a counter-affidavit: NB Joshi informs
ASG R Sankaranayaranan appears for Union of India, tells Court that he received written instructions last night, adds that counter is being prepared, seeks one last chance to file the counter. Adds that matter can be argued as well if Court sees fit
CJ Banerjee says that HC can extend time, but urges ASG to ensure that UOI files counter:
(We sometimes get the impression that) your secretaries and other minions don't take High Court seriously. They only take one court seriously and consider other courts as on the wayside.
Interim Order: Time to file Counter by Union extended by 10 days from date. List a fortnight hence.
CJ to ASG: Just ensure (that the counter is filed). We gave sufficient time.
[BREAKING] CJI NV Ramana laments the lack of debates in parliament and hows laws with "gaps" are being passed. #supremecourt#CJIRamana
1/n: "Earlier different, different laws used to be discussed and elaborated in the parliament."
2/n CJI Ramana: So the burden of the courts while interpreting or implementing the law is less. So the legislative part was clear with respect to what they want to tell us. #supremecourt#CJIRamana
3/n CJI Ramana: Why they are making such a legislation. Now it is sorry state of affairs, now we see legislation with sorry state of affairs. Now we see legislations with lot of gaps, and lot of ambiguity in making laws. #supremecourt#CJIRamana
