#SupremeCourt is hearing a plea by former Karnataka minister & mining baron, Gali Janardhan Reddy, accused in a multi-million illegal mining case(s) seeking permission to visit & stay in the District of Bellary in Karnataka for a period of 8 weeks
Additional Solicitor General Madhavi Divan makes submissions for CBI: He is the beneficiary of the Bribe - it was done to secure his Bail. His conditions for bail should not be diluted. There was a reason as to why this should not happen. He is a very serious threat to witnesses
ASG: He is a person who has been very seriously accused. Due to not acceptance of bribe, that judge died under very serious circumstances, these are all instances that weight against cancellation of any condition imposed
Justice Dinesh Maheshwari: They say 6 years down the line, Reddy should be allowed to go to his native place in Bellari.
ASG: The accused has been enjoying his liberty. This condition of not visiting his native place is not such an onerous condition that has been imposed on the reddy. #supremecourt
ASG: There has been attempts made to delay the trial. In November 2020 there were discharge petitions filed by other accused
Justice Vineet Saran: What happened from 2015 to 2020?
ASG: Last year when the matter had come up before another bench, he had filed a discharge plea and after denying this fact, they approached trial court and withdrew it
ASG: This makes the substratum of their application that there is delay in trial. This is their basic reason. Now let me elaborate on witness threats.
ASG: A prosecution witness was forced to support Reddy and if that was not done he faced coercion. He attempted suicide but the plan was aborted. This is the irreparable harm that may be caused. The witness here was a bank officer.
[BREAKING] CJI NV Ramana laments the lack of debates in parliament and hows laws with "gaps" are being passed. #supremecourt#CJIRamana
1/n: "Earlier different, different laws used to be discussed and elaborated in the parliament."
2/n CJI Ramana: So the burden of the courts while interpreting or implementing the law is less. So the legislative part was clear with respect to what they want to tell us. #supremecourt#CJIRamana
3/n CJI Ramana: Why they are making such a legislation. Now it is sorry state of affairs, now we see legislation with sorry state of affairs. Now we see legislations with lot of gaps, and lot of ambiguity in making laws. #supremecourt#CJIRamana
