Several districts in Rajasthan faced an internet shutdown yesterday.

Why? To prevent cheating in an exam.

We worked through Sunday and wrote to the Rajasthan govt. to lift the internet suspension, and to exercise restraint in issuing such orders.

We pointed out that the SC in Anuradha Bhasin v. Union of India has held that internet suspension orders can only be issued by the Home Secretary of the State Govt. in cases of emergency through a prominently published order that discloses clear reasons.

The orders, which were issued by Divisional Commissioners instead, refer to a need to prevent cheating and a mere apprehension of danger to public order. This is not a public emergency which justifies the extreme step of suspending internet services in entire districts!

Periodic compliance reports (as mandated by the #ITRules) are an important element for understanding how social media corporations regulate content, but misses an important element — disclosure of content removal requests made by the government are not mandatory! 2/n
While it is important for SSMIs to be transparent and accountable with content moderation, these values are equally important when it comes to government-mandated content removal orders!

For free speech to truly flourish online, the government cannot keep regulating it. 3/n

Earlier, the minimum download speed for broadband was only 512 kbps — insignificant for true access to services we require today. Today, it's 2 mbps.
