The Nairobi Anti-Corruption Court has today convicted Mukuria Ngamau & Quorandum Limited for offences under ACECA and Penal Code for the offences of conspiracy to commit an economic crime, unlawful acquisition of property and making a false document. #HakinaUsawa
Mukuria Ngamau & Quorandum Limited were charged alongside Catherine Namuye, (deceased), former CEO, Youth Enterprise Development Fund, Bruce Odhiambo, (deceased), former chairman to the board, Youth Enterprise Development Fund and Doreen Ng’ang’a, business lady. #HakinaUsawa
Catherine Namuye, and Bruce Odhiambo became deceased during the pendency of the trial, and the case proceeded against Doreen Ng'ang'a, Mukuria Ngamau and Quorandum Limited. The court acquitted Doreen Ng'ang'a and convicted Mukuria Ngamau and Quorandum Ltd. #HakiNaUsawa
On the Offence of Conspiracy to commit an economic crime, contrary to section 47A sub section 3, of the Anti-corruption and Economic Crimes Act, the court sentenced Mr. Ngamau to 7 years imprisonment without an option of a fine. #HakinaUsawa
On the Offence of unlawful acquisition of Kshs. 115,710,000/- the court handed down a sentence of a fine of Kshs. 462, 840,000/- or in default to serve 7 years imprisonment. #HakinaUsawa
On the Offence of unlawful acquisition of Kshs. 64,654,789/- the court handed down a sentence of a fine of Kshs. 258,619,156/- or in default to serve 7 years imprisonment. #HakinaUsawa
On two counts of making a false document, the court handed down a sentence of 3 years imprisonment for each of the counts. #HakinaUsawa
The court further directed that Mr.Ngamau & Quorandum Ltd to compensate the Youth Enterprise Development Fund Kshs. 180, 364, 789/= for the loss occasioned. #HakinaUsawa
In summary, the court sentenced Mr. Ngamau & Quorandum Ltd to pay a fine of Kshs. 721,459,156/- and/or in default to serve 7 years imprisonment. The prosecution presented a total of 32 witnesses and the case was prosecuted by Ms. Eva Kanyuira. #HakinaUsawa
The case (of the Youth Enterprise Development Fund) was investigated by the Ethics and Anti-corruption Commission @EACCKenya and prosecuted by @ODPP_KE #HakiNaUsawa

The Prosecution led by SADPP Catherine Mwaniki and ADPP Gikui Gichuhi yesterday presented two witnesses in the case whereby, Joseph Irungu alias Jowie and Jackie Maribe are charged for Murder of Monica Kimani.
Brian Kasaine, a businessman & farmer, confirmed to the court that he lent Jowie Irungu his firearm and he also noticed a hole in the wall of the two accused persons' house with a spent firearm cartridge beneath it. He told court that Jowie had handled his gun three times.
The Prosecution produced a set of 120 photographs depicting the location where some items were burnt, as well as where gun ammunition belonging to Joseph Irungu were recovered by the witness. The witness told the court, the accused asked him whether he had anything flammable.

.@ODPP_KE attention has been drawn to a misleading heading by a local newspaper claiming @EACCKenya did not probe allegations of irregular withdrawal of Ksh 26.1 million from Wajir County Government by county officials.

On contrary, the IO in his testimony on 10/2/2020 during cross examination by defence confirmed @EACCKenya was involved & that more officers from the Forensic Department were deployed from @EACCKenya Headquarters to boost Wajir team in investigations.
The IO testified that investigations revealed the accused persons conived to withdraw the said monies by 5 cheques at KCB, Wajir branch between 2nd & 9th October, 2018.

The IO to continue to testify on 14/2/2020.
