Some CONSENT CALENDAR Items:1-B .Approve a First Amendment to the Security Service Contract with Turner Security Systems, in the amount of $1,071,182.68 for security services at the new Department of Public Utilities Operations and Maintenance Facility located at 1626 E Street.
The Contract term is for three years, with provisions for two, one-year extensions The First Amendment will increase the total contract not to exceed amount to $1,762,782.68.
1-D Approve Contract Change Order No. 13 adding 1,091 additional calendar days to the contract time and no additional expense for delays to Hal Hays Construction, Inc.,for the Headworks Odor Control Upgrade Project for a total contract value of $8,497,862.90(Council District 3).
1-G Actions pertaining to the award of a sole source purchase agreement for shower / restroom combination trailers for the Department of Public Utilities, Homeless Assistance Response Team
1-J **Actions pertaining to creating a Broadband Strategic Plan:1. Approve a Consultant Services Agreement with Magellan Advisors in an amount not to exceed $91,770
2. Uphold the City Manager’s finding that Magellan Advisors is uniquely qualified.
The City has an abundant amount
of fiber and conduit in the ground that can be utilized for broadband purposes. The fiber is currently utilized for the Intelligent Transportation System, Bus Rapid Transit as well as connectivity to City buildings, parks and other area agencies and institutions (Fresno Unified,
Clovis Unified, the County of Fresno and City of Clovis). The City desires to utilize its fiber for broadband purposes including addressing the digital divide and is seeking a broadband plan with the assistance of Magellan Associates. At the end of the engagement, the City will
have a comprehensive broadband plan that assist the City in applying for Federal and State broadband funding. The American Rescue Plan Act of 2021 (ARPA) has made funds available for broadband deployment and the State of California just recently passed a bill for broadband
investment. The City may be eligible for receiving funds but must identify opportunities and have solutions to be eligible for and receive funding. Magellan Advisors can assist the City in developing a plan that can be used for obtaining these funds as well as identify other
funding sources that may be available. Magellan Advisors is uniquely qualified because they understand California’s landscape, can identify unserved and underserved areas and deemed Fresno was a viable client for this purpose.
1- K Actions pertaining to Operating Agreement for the Downtown Baseball Stadium: 1. Adopt a finding of Categorical Exemption under CEQA Guidelines Sections 15301 and 15323 2. Approve Operating Agreement with Fresno Sports and Events, LLCThe Fresno Sports and Events, LLC., a
Delaware limited liability company, is the tenant of the Downtown Baseball Stadium (Stadium) operating the Fresno Grizzles Baseball team, a Minor League Baseball club has been working with the City Manager’s Office to developed an Operating Agreement related to non-Minor League
Baseball events held at the Stadium, to address the First Amendment of the Subleased dated January 22, 2021 which contemplated how the operations for non-Minor League baseball events would operate between Fresno Sports and Events, LLC., and the City of Fresno.This agreement
allows for Fresno Sports and Events, LLC to have first right of refusal for any nonMinor league baseball event, the City of Fresno to have the second right and/or a joint promotional event with both entities can occur at the stadium. Non-Minor league events this year have
included a Liga MX Soccer match, several large concerts, and the upcoming championship boxing match to be held on October 16th, featuring Mikey Garcia vs. Sandor Martin with the undercard hosting the home debut of Fresno’s own Marc Castro.
1-L RESOLUTION- Authorizing the City of Fresno to accept a donation, for a total of $50,000, from the One Fresno Foundation to pay Civic Education Center, Inc. for Camp Fresno 2021 Summer Youth Program services. RECOMMENDATION: Staff recommends the Council approve the acceptance
of the $50,000 donation from One Fresno Foundation to pay for services provided at Camp Fresno 2021 Summer Youth Program by Civic Education Center, Inc. (CEC). EXECUTIVE SUMMARY: CEC provided education and program activity services for Camp Fresno 2021 Summer Youth Program
through an agreement executed on June 21, 2021 for a total of $50,000. The One Fresno Foundation agreed to provide a donation of $50,000 to reimburse the City of Fresno (City) for CEC’s fee for services rendered.
1-N Approving authority for a retroactive one-time payment effective July 1, 2020, up to 5% of base pay earned in fiscal year 2021 or a retroactive salary increase effective July 1, 2020, up to 5% of base pay for Unit 2 (non-represented management and confidential) employees

, stretching existing Caltrans resources beyond their current capacity. The City of Fresno Graffiti Team is well equipped to respond quickly to graffiti within the State right-of-way in locations away from high traffic areas, such as soundwalls and retaining walls. Caltrans
desires to contract with the City for $50,000 in delegated graffiti maintenance services for the current fiscal year, and will reimburse the City for the actual cost of work. The agreement will enable faster responses for removal of graffiti on the State highway system in the
City of Fresno, eliminating blight and improving the overall community appearance.

Maxwell: we may get reimbursed from Cal Trans eventually. When we voted on this in the past I was under the impression it would be for city property and not State property. Esqueda:one of our crews will be partially funded by State.We can invoice if we clean State. Maxwell: how
about embankments that face the public? Esqueda:there are some areas Cal-Trans won't let us clean or access. Mozier:this $50,000 comes from State and won't effect City General Funds.We also need to get paint sprayers fixed. One area we can't access are freeway median or bridges.
Freeway embankments: we can do sidewalks and possibly bridge poles. Easy access and we should be able to invoice State. Maxwell:most of the FresGo reports in my District from public is for Graffiti.Approved

City Manager Tommy Esqueda: We looked at the population to be served, three alternative sites. We looked at Clovis' proposed new center template.We don't have to do Clovis' model though.75% will visit 1-3 hours and stay 3 hours. Our alternative sites fit: Smugglers Inn, old Vons,
and Einstein Park. We need to look at parking element as well as pick up/drop off.Senior Centers often next to Parks.
More limited parking and no park at Smugglers. Old Vons is larger, ponding basin could act like a park,more demographics fit in area. Einstein:Manchester provides transit, park.Einstein Park was highest scoring.
We need to acquire site, plan, prep site,development and then start up. Need a financial plan in place. Esqueda:this is a approach but not the only approach. Arias:We finally allocated the money. I think it should be twice the size of Clovis and go big. old Vons is best. I would
purchase Vons today if we could. I think it should be on Blackstone. Soria:I hoped Esqueda looked at other sites too.Esqueda:We inherited site at Large park but decided against it. Smugglers came up and went to other sites from there. Soria:why not a 4th,5th site too. This is a
vert large city and we need multiple centers.If we are waiting it will take at least 3 years at this point. Maxwell:What are we replacing if we put it in Einstein? Neighbors of all ages use this park. Blackstone is an artery of our City. Reduced fares for Seniors exist. I would

4-B ***BILL (for introduction) – Adding Article 20 to Chapter 10 of the Fresno Municipal Code, prohibiting
smoking in and around multiunit rental properties. Lots of data to back this. Maxwell:This is the most common sense item I have brought in my nine months on dais. Bad air
air quality already. This will only meet certain projects. SJ Valley has the highest asthma rate in the country. Smoke travels thru vents and even plumbing. Fresno Youth Commission a group of youth said they support this in order to protect public.American Cancer Society also
endorses this. A constituent told us that they are concerned by people being exposed to second hand smoke. I can't close vents due to age of them. She is under going chemotherapy. She complained to landlord but no change. Some say "this encroaches on my liberty" But your liberty
ends at my body. Smoking is already banned at restaurants, business, hotels, airports, etc. Scientists and health expert agrees on this. Public:Greg Terzakis:thanks for working with us on the language on this. Association does not want landlord to be referee. We are in support of
this though. Many of our members already don't allow smoking in their units. Lynda Barbour:urge you to adopt this.Prevent exposure to smoke is only way to stop second hand smoke. We don't want exemption to balcony.We also want it applied to rental homes too.

@GarryBredefeld a health hazard around this country. I wish people wouldn't smoke. I ran smoking cessation program at VA. It is a psychological addiction too. But this comes with regulations but no help to quit smoking. We should ban smoking in shared outdoor areas. This also
