At the hearing this morning so far, both sides have just begun to lay out their positions.
It's a new investigative tool for the UK, so this case asks fundamental questions:
Whose responsibility is it to deploy an "unexplained wealth order?"
And is the Scottish govt under an obligation to use one? Against Trump?
Lord Sandison, the judge, is going to figure that out
The govt seems to be putting this responsibility on its top prosecutor.
Aidan O’Neill QC, a barrister representing the nonprofit that filed the lawsuit, has been explaining why it's actually up to ministers to pull the trigger.
The judge, Lord Sandison, just asked two key questions about anti-money laundering "unexplained wealth orders":
"Is there an international agreed to standard in this field?"
And is the Scottish govt obligated to engage in "best endeavors to do a specific thing?"
The judge is now listening to an argument that, if Scotland were to issue an "unexplained wealth order," Trump might have to explain why in the world his golf courses keep losing so much money.
The $60m cash purchase & upside down finances have been an ongoing mystery for years.
