SG Tushar Mehta appearing for the National Testing Agency #NEETResults
Counsel for the respondent : wrong answer sheet was given to us and wrong answers were given to questions. Then questions were attempted in hurry... The only solution was leniency. It was like a common order passed by HC.
Justice Rao: You said that there are 2 students, 1 answered 130 questions & other answered 160..... They say that they only got 45 minutes.
Counsel for students: we wrote to NTA and immediately filed the plea on Sept 22. Invigilators accepted that answer sheets were mixed up
Justice Sanjiv Khanna: if we set this as a precedent then what will happen
Justice Rao: they are bright students and they got more than ninety percent in qualifying exam. Invigilator has accepted that there was mix up. How can we leave students in lurch?
Justice Rao to Centre: though we are in your favour of declaring results but what about the students.
Counsel for students: we wrote to NTA and they accepted the mistake. If we write answer to wrong question we will get 0 marks.
SC: you said you did not have time... Every students know there is negative marking in the exam. You cannot say you don't know about this
Counsel for student: OMR sheets have barcode number... Though questions are same but for question P4 I was given O4 paper for answer..
SC: They are saying you will be given an opportunity
SC: We will decide what happens to the two students upon reopening. In the meanwhile we issue notice and file a counter. But we cannot hold the results of 16 lakh students. In the mean while consider if 130 marks appeared can be considered as 200 marks
SC: SG has said whatever confusion is there they will rectify that. You are talking about your clients but not considering the lakhs of students who are waiting for the results.
SC: We stay the HC judgment. NTA can announce #NEETUGresults
[BREAKING] NEET UG 2021: Supreme Court gives green signal to NTA to declare results, stays Bombay HC order
Wankhede counsel: No consent has been taken from the State. If Mumbai Police arrest me today, which is my apprehension, milords will not wait till the State flouts my rights.
Sr Adv Jaideep Gupta: the plea before you is the Joe Joseph vs State of Tamil Nadu. Parties have resolved differences apart from what height has to be maintained and what height should be of the reservoir level so that Tamil Nadu can draw some water
Sr Adv Jaideep Gupta: As per the rule curb prepared by state of kerala it indicates the levels which has to be maintained at different dates ... this takes into account the rainfall which has taken place for several years.
