The #RittenhouseTrial resumes this morning, and we're expecting to hear testimony today from Gaige Grosskreutz, who was shot in the arm by Rittenhouse the night he shot and killed Joseph Rosenbaum and Anthony Huber.

From the @AP pool reporter in the courtroom: Prosecutors and Rittenhouse attorneys withdrew to the judge's chambers before Monday's proceedings began. Rittenhouse didn't initially join them, but he later did. No indication if there was a serious issue and what it was.
ADA Thomas Binger is asking Grosskreutz about his background in medicine and why he got into the medical field.

Grosskreutz is now explaining how EMTs respond to a shooting situation.
"It definitely doesn't get easier the more you do it."
Now continuing to outline his continued education as a paramedic/EMT.
Grosskreutz said he has nearly completed his Bachelors in outdoor education, has worked as a sea kayak guide.
Grosskreutz now asked about his participation in protests last year.
Said he was out demonstrating in Milwaukee after the murder of George Floyd by police in Minneapolis in May 2020.
Said what he was specifically doing was "just being in attendance."
Said these demonstrations were never violent, and people weren't destroying property or lighting fires.
Explains how he helped treat a person who had appeared to trip over a curb and yelled for a medic.
Said he realized there was no established EMT presence.
Said he and a friend decided they were going to offer their services voluntarily because of this
"We weren't going to be actively participating in any of the demonstrations"
Said it's an ethics code that they don't pick a side as medics.
Binger asks Grosskreutz how many times he was out there providing medical care at these demonstrations.
He said about 75 days prior to the incident in August.
Defense objected to the question but it was overruled.
Binger said it's relevant, and contrasts him and Rittenhouse
Grosskreutz said he was working his normal job the day he came down to Kenosha on August 25, 2020.
"we're all aware of what was happening after the Jacob Blake shooting...but given the chaotic situation...there was certainly a propensity for violence and injuries in general."
Said that night he brought his own supplies. A tourniquet, quick clot, chest wound seals, gloves, saline spray.
Binger asks Grosskreutz if he was armed.
Grosskreutz said he believes in the 2A, said that day was no different than any other day. Said he had a permit that not not renewed when he was carrying it on August 25, 2020.
Said he parked several blocks away for safety and to protect his property, put his supplies and gun on him, and walked toward the courthouse.
"There was already confrontation" between demonstration and police.
Said he almost immediately came upon a person who was affected by pepper spray and started treating that person.
Binger asks what the most critical situation was that he responded to -- said someone young who was shot with a rubber bullet and had a cut.
"Whatever hit her had some force behind it."

The video being shown is of Grosskreutz helping someone on the ground.
He said it's him and several people he doesn't know, treating that person who had a cut on their elbow from the rubber bullet.

Grosskreutz said he headed down 59th, and made his way toward the Ultimate Gas Station, he was still wearing his Paramedic hat on it.
No one approached or asked for help, and then said he heard gun shots.
Said he saw people running and heard people yell medic.
Said he started running south toward where he believed the shooting happened.
He's pointing out on the map where he was to the jury, and where he ended up reaching after the gunshots.
Said he saw people running up Sheridan, but then started to hear people yelling someone had been shot.
"It was there, while I was live streaming, I had contact with the defendant."

Grosskreutz: At the time I thought the defendant said he was working with the police, I didn’t do anything .
Said now that he’s reviewed the video, he said “I’m going to the police.” “I didn’t do anything is what I make out. It’s hard to hear from the muffling."
Grosskreutz said it was odd that he thought Rittenhouse said he was working with police, but said earlier in the night, he had heard Ryan Balch discussing a plan they had with police, that police were going to push the protesters down Sheridan past the Car Source lot.
Grosskreutz: "Balch explained there was some sort of understanding or plan, up to the militia members as they refer to themselves, to deal with them."
Said he then turned around and started running in the direction Rittenhouse was headed, as more people pointed out that Rittenhouse had just shot someone.
"I thought that the defendant was an active shooter."
Said any time there is a firearm in the situation, stakes are higher
Grosskreutz now being shown the video just before he gets shot by Rittenhouse.
Said at this moment, Grosskreutz said at some point, he pulled his gun out from his back.
"In the moment, I thought the defendant was an active shooter."
Said he had heard more gunshots, and saw someone jump over the defendant, and then another person use a skateboard to hit the defendant.
Binger asks Grosskreutz if he was intending to use his gun --
G: "If i had to. I didn't draw my firearm with the express intent" to use it, but was ready if he needed to.
Binger asks if Grosskreutz saw Rittenhouse fire shots and shoot Anthony Huber in the chest. Asks what he was holding.
Grosskreuts said in one hand was his gun, the other his phone.
Binger: What was going through your head at this moment?
"That I was going to die"
Asks why he put his hands up. Grosskreutz said he had just saw Huber get shot
"I was very close to the defendant, and I thought there was a high likelihood I would get shot myself."
They pause the video and Binger asks if Rittenhouse is pointing the AR-15 at him, Grosskreutz said yes.
After he put his hands up, Grosskreutz said Rittenhouse re-racked his gun.
"After he pointed his rifle at me, I put my hands up" and he re-racked.
Binger: What did you think was going to happen?
"Re-racking the weapon, in my mind, meant the defendant wasn't accepting my surrender"
Felt the defendant was going to shoot again.
"I felt I had to do something to prevent myself from being shot...or killed."
So he decided the best course of action was to close the distance.
Said he never had an opportunity.
"Was never trying to kill the defendant. In that moment I was trying to preserve my own life."
Binger: After seeing Rittenhouse shoot at one person at close range twice, Huber in the chest once, and being told by people in the crowd he already shot another... why didn't you take your own gun and shoot the defendant first.
"That's not the kind of person I am."
"That's not who I am and definitely not somebody I'd want to become."

Binger now asks where Grosskreutz was hit by Rittenhouse's shot.
Grosskreutz: "I effectively lost a majority of my right bicep."

Court is resuming -- they're discussing when lunch is going to be delivered. Prosecution wants a 12-1 break today, but the judge said the food is warm and he doesn't want jurors to wait too long for break after it's delivered.
Testimony from Gaige Grosskreutz has resumed.
He's explaining how his wound was still bleeding with the first tourniquet, and had asked for another to stop the bleeding.
Now describing what he remembers from arriving at the hospital.
The first hospital said they needed to send him somewhere else -- said he rode in an ambulance, which was about 5 minutes.
From there he said he was supposed to be treated there, but would needed to be life flighted to Froedert in Milwaukee.
Said went he first arrived, he was taken to trauma room, and was prepped for surgery called -- which is a very deep cleaning of the wound to scrape away the dead tissue.
Said he doesn't believe he had other surgeries in the early morning, said he was in the ICU a few rooms away from Jacob Blake -- who's shooting by police sparked these protests in Kenosha.
Said the first surgery to try to repair his arm was the following Monday.
Said he was in hospital for a week for emergency care, then several months of physical therapy.
Grosskruetz said he had a spent teargas canister on him that he had picked up on the street - which they just showed to the jury.
He said he found that 50 feet away from the 59t street Car Source. It was not capable of doing further harm
Said he doesn't know why he picked it up.
"I don't have an answer for that."
Said police came to talk to him in hospital, and he signed a release for them to obtain medical records.
Also said he gave police a statement, and had explained he was recording the video on Facebook live stream, not physically on his phone.
It was stored on his Facebook page.
Said he was concerned about his own personal safety ...
"After the events, it was made known to me that people online and in person..."
Defense objects on hearsay, prosecution said it is state of mind for cooperation.
Judge is thinking.
Binger said a detective has already questioned Grosskreutz' credibility.
Judge said he's not going to allow the evidence as proof of what he saw, but proof of what was happening in his mind based on info he heared
Grosskreutz said people were making threats, going above just personal opinion and were outside his family members' homes.
"It became very concerning for me."
Grosskreutz said he was willing to turn over everything on his phone. Said it never happened.
At the time he said he didn't know why, but said he never personally refused to turn over everything on his phone.
He's shown a document, saying it is an official form for informed consent to disclose personal property and records from the Kenosha PD and District Attorney.
This was for the medical records access.
Grosskreutz said he still has issues with his arm, said muscle doesn't grow back.
"I do have a neurological deficit on my arm."
Said he's unable to feel from his bicep through top of his forearm through right thumb.
Has a tattoo on that arm that has "Do no harm" in a banner with the medical staff with the snake wrapped around it.

Chirafisi asks if he remembers saying that at some point his belt with his glock fell off his waist.
Grosskreutz said he doesn't recall. Chirafisi showing a document.
Chirafisi asks if that's a lie, G said no.
Chirafisi asks Grosskreutz if he told multiple officers.
Grosskreutz said no, but his statement said he did.
Chirafisi asks if he was chasing Rittenhouse. Grosskreutz said no.

Said he has spoken at one event, but is not a member. Has said "long live the revolution" and members are in the courtroom today
Chirafisi shows Grosskreutz a notice of claim telling the city he wants $10 million.
"Are you aware in this document you never mention you actually possessed a firearm. You left that part out. Is that correct?"
"That is correct."
Chirafisi is asking about another document where Grosskreutz failed to mention he had a firearm when he was shot.
"If Rittenhouse is convicted, your chance at getting $10 million bucks is better"
Grosskreutz said he doesn't know how all of that works.

"Anytime that there's a risk of head trauma, that's a risk."
Grosskreutz believed Rittenhouse was in danger of being seriously hurt, which is 'in part' why e wanted to intervene.
Chirafisi asks about a statement where he told police he told Huber to stop hitting him.
Grosskreutz said with the benefit of hindsight, that isn't true. Said he didn't say that to Huber.
"I'd just gotten out of surgery. I had just been sedated. It wouldn't have been a purposeful omission" in regards to him not telling he was carrying a firearm
Chirafisi argues he wasn't drugged too much to not answer questions about Rittenhouse's clothing, and omitting what he does for a living to that officer.
Grosskreutz said the traumatic experience and medication led to him to forget to tell police he had a gun and dropped it.
Chirafisi asking about G's second statement about what had happened. Asks if he had viewed some of the video.
G said he can't say for sure but assumes he had by that point.
Chirafisi asks why Grosskreutz refused to answer questions about the shooting with the lead detective. Grosskreutz said that was based on advice from his attorney.

The defense is explaining why they're motioning for a mistrial.
It's all in connection to the line of Binger's questioning that Judge Schroeder said was an over reach regarding his right to silence before his trial.

Yesterday, we heard testimony from the man who survived being shot by Rittenhouse.
Today, we're expecting the state to rest its case.
Judge Schroeder said a lieutenant saw someone outside video recording the jury. The judge said the lieutenant told the man to delete the video, and the judge said the next time, he was instructed to take the phone from the person recording.
The judge was asked if that person has been in the courtroom observing the trial, and the judge said he is not sure.
