It’s Day 8 of the #RittenhouseTrial

The defense is starting the day calling Jacob Marshall -- he was Gaige Grosskreutz' former roommate.

They were roommates for 3 months before the shooting in August.

This is Jacob Marshall

Defense Attorney Corey Chirafisi asks Marshall if he visited and took a picture with Grosskreutz in the hospital and post it on his facebook account.

Marshall said he did. #RittenhouseTrial

Chirafisi shows Marshall a print out of the photo from Facebook, with his corresponding post.

We're now seeing that photo,.

Marshall just said Gaige Grosskreutz NEVER said his biggest regret was not killing Kyle Rittenhouse. #RittenhouseTrial.

He said it was a bad remark, and he was trying to stick up for the friend.

Wow. This witness did not go the way the defense was hoping.

The defense was asking Grosskreutz on Monday about this post made by Marshall, and Grosskreutz said he never made those comments to Marshall.

Marshall confirmed that today on the stand. #RittenhouseTrial

Marshall said he took the post down immediately when he was getting harassed and knew people would "twist" it.

Chirafisi said he didn't know the post would hurt him at the time, said it was bad judgement to lie about something Grosskreutz said.

Marshall is done with testimony.

Defense is re-calling Anmol Khindri, aka Sam.

He works at Car Source, owned by his father.

Here is Anmol “Sam” Khindri

Chirafisi is questioning Khindri about the amount of $ lost in fires at Car Source, and clarifying testimony Khindri made last week, that he didn't know what the loss was.

Chirafisi: Are you stil under oath stating that you don't know and didn't know what the loss was.

Khindri: I'm sorry. I can't remember.

C: You testified under oath you didn't know what the loss was.

K: I personally didn't.

C: Is that your testimony today?

K: I do have approx. what the loss was.

C: Did you learn that since your last time on the stand?

K: Yes. It was approx. $400,000.

Chirafisi is showing an interview of the Khindri’s who said they lost 137 cars and nearly $2.5 million.

Khindri said again on the stand that the $400,000 loss he said today is not a lie.

Khindri said the $2.5 million he said in that video was a mistake. Said they were in shock, saying they were approximating how much it would be to get back on track.

"That was the number out there with me being in shock."

C: You knew the specific number of cars.

K: I did not remember last week.

C: It was 137

K: I cannot remember what it was in total.

Chirafisi ends direct examination.

Binger is up for cross examination asking if Khindri remembers what day the video of the interview was taken.

Khindri said he doesn't remember.

Binger asks if it was 6 or 8 hours after that property and cars burned.

Khindri said he can't remember.

Binger asking if the computers and information inside the building that burned made it hard to paint the full picture of the value of his cars when he said it was $2.5 mil

Judge is explaining Rittenhouse’s rights ahead of him taking the stand.

Rittenhouse said he understands and wants to testify #RittenhouseTrial

Jury is being called back in.

This was unexpected today, and seems the station is calling Rittenhouse pretty early in its case.

Here we go.

Rittenhouse is under oath

Richards is asking some basic background.

Rittenhouse is studying nursing online at Arizona State University.

Rittenhouse said his father lived in Kenosha the night he came to the city on August 25, and other family members live in Kenosha as well.

Richards is now asking about the gun. RIttenhouse said it had never left the state of Wisconsin.

Rittenhouse now telling his hobbies -- lifeguarding, etc.

Said he was part of a few police groups and with the Antioch Fire Department

Now explaining his medical training.

On August 25, he said he was furloughed from the YMCA in Illinois, and worked at the time at the RecPlex in Kenosha

Rittenhouse now explaining his relationship to Dominick Black, who was dating his sister.

Now getting into him see the videos on social media about the protests, said he saw the Car Source fires, saw an officer get a brick thrown at his head, etc., on August 24

Richards now asking Rittenhouse about the morning of August 25.

He came to Kenosha with Black, his sister, and another person. Said they cleaned graffiti at a high school for a 1.5 to 2 hours

Said he wasn’t paid to do this

After this, they walked toward the Car Source and met Sam and Sal. Said he offered his condolences and said he told them to reach out to him if there was anything he could do to help, and they exchanged numbers.

Once they left, they went to Black's stepfather's and hung out there for a bit, Rittenhouse said.

Said they talked to Nick Smith around 3:30 - 4:00. Said Smith wanted them to drive him toward O'Hare because he wanted to buy a bulletproof vest.

Rittenhouse said they went to pick him up, but stopped at a store and bought two rifle slings.

1 was for Rittenhouse's and one was for Dominick's

"Just as a retainer so, if I'm helping someone with first aid, I can dangle my rifle behind me" so it wouldn't be taken from ground

Said when Smith wanted to withdraw money from the bank, but the bank was closed, and Smith asked if Rittenhouse and Black wanted to go and watch businesses and they said yes.

He said since he was going to be helping people with first aid so he didn't need a bulletproof vest

Gave the vest to him, which was given to Rittenhouse by a police department.

They parked at Smith's house, and went to the Car Source lot, which is in walking distance.

That's where Rittenhouse said he spent most of the night.

Said the owners were there, (Khindris)

Sam and Sal were coming out to help, and they got in their car and were driven to Car Source "3"

There, they hung around for a few minutes and other people showed up -- at the time R said he didn't know them, now he does.

They're now showing the photo they took outside of the Car Source that shows Rittenhouse, Black, Balch, Feidler, Khindri, and others.

Rittenhouse points out who he knew prior.

He said before August 25, he knew Nicholas Smith and Dominick Black.

He said the Khindris were happy they were all at their business and they gave them permission to be there.

Said he went down to provide first aid, including an orange box that carried medical supplies -- he said he carried that in his truck.

Also had a fanny pack with medical supplies.

Said after the picture was taken, a few vans pulled up and Rittenhouse said they wanted to protect the business.

Said Balch told some to stay at Car Source 3, and others went to Car Source 2.

Rittenhouse said Sal, the owner of Car Source, gave Smith a set of keys, and that he saw that.

Said Sal told them where the power washers, hoses, and extinguisher was.

Showed Black and Smith the ladders to get on the room.

Said he didn't use the ladders personally.

Rittenhouse said he was predominately in front of the Car Source 2.

Said he wasn't there the whole time, but when he left, he was with Balch asking if anyone needed first aid, and would put fires out.

Said he put one out at the church -- fire in the alley

From there, Rittenhouse said they saw the doors at Reuther Central High School on fire, but as they were walking there someone else had put them out -- near where they were scrubbing graffiti off earlier

Said earlier in the evening there, Rosenbaum had threatened to kill him twice, said he attacked him first.

R: The first time was me and Balch ... Rosenbaum was walking with a steel chain and blue mask on face. He was mad about something. Screamed "If I catch any of you f*ckers alone I'm going to f*cking kill you"

R: The second time, he was screaming "I'm going to cut your f*cking hearts out" and "Kill you 'n-words'"

Rittenhouse said he saw Rosenbaum tip a trailer and appear to start a port-a-potty on fire.

Rittenhouse said he had never and has never met Joshua Ziminski -- the man who fired the first shot in the air before Rittenhouse shot and killed Rosenbaum.

Rittenhouse now detailing the moments he helped a woman who had hurt her ankle. He said he was just pepper sprayed, but he took her in the Car Source and wrapped her ankle and directed her to the hospital.

Also said he helped another person

Said someone threw a 'chemical bomb' after Rosenbaum's second threat.

Said he helped flush Balch's eyes out after the bomb was thrown.

Said after he was pepper sprayed, he did not retaliate, but doesn't know who or why he was pepper sprayed.

Rittenhouse now talking about the moments after he finished his interview with Richie McGinniss of the Daily Caller.

Rittenhouse said he invited McGinniss to follow -- said despite saying in video to McG he is an EMT, he's not.

Rittenhouse now talking about how they continued to walk past the police MRAP vehicles. Said they continued on, and weren't told to stop at that point.

Saw "Yellowpants man" -- "You're the one who pointed your rifle at me with the laser pointed at me."

Rittenhouse said he had never seen him before but said sarcastically toward him, "I did"

Continued a bit more and turned back, as Balch was no longer with him -- went to the Ultimate Gas Station parking lot. Couldn't find him.

(Balch said he went inside there.)

R said he was unable to get back to Car Source 2. Said the police said not go down there, and he told them that's where he was positioned, at that business.

From there, he goes to where people were protecting the gas station, which he felt was safest place to go

From there, R said Black called him and said "Kyle I need you to get to Car Source 3...and put fires out."

R said at the gas station, asked someone if they could come and if he could get a fire extinguisher. The man gave an extinguisher but didn't go with him.

R said he started running toward Car Source 3, stopping to catch his breath and walk.

Did not have any interaction w/ Rosenbaum until "he came out from behind the car and ambushed me."

R said he was still asking people if they needed medical but never received any responses.

"As I'm walking...I hear someone scream burn in hell"

"I replied with Friendly Friendly Friendly"

Said he was wanted them to know he was there to help.

Noticed a flame in the back seat of the "duramax vehicle" when Ziminski stepped toward him with a pistol in his hand.

Said his plan was to get out of that situation.

Said he wasn't able to leave. Said he looked over his shoulder and Rosenbaum was running from his right side and he was cornered between Ziminski and Rosenbaum.

Rittenhouse is crying uncontrollably right now on the stand.

We're back in session. Rittenhouse has calmed down and is recalling the moments he shot Rosenbaum.

He said he saw Rosenbaum throw the plastic bag, which Rittenhouse claimed looked like a chain in the moment.

After the shooting, R said he saw Lachowski and told him he just shot someone and he said a 'mob' was chasing him.

People were saying "cranium him, kill him."

Said as he walked down Sheridan Rd, the next thing he remembers is being hit in the head with Anthony Huber.

Said he didn't really remember seeing Grosskreutz in the moment, didn't view him as a threat at that point.

Said he remembers running past Huber, who was holding his skateboard like a baseball bat. R said he blocked it, but was hit in the neck, and kept running toward the police line.

Said he got light headed, stumbles and hits the ground.

Said he was hit twice before falling, said the first was a concrete rock hitting him in the back of the head.

While on the ground, he said he remembers people by him and he moved his rifle in their direction, and all but one person backs off.

Said the last person in that group kept after him, jumps at him with his boots and his boot hits his face. R said he fires two shots at him.

Thought he would have stomped his face in if he didn't shoot.

Said a he was sitting up to get to the police, Huber ran up and hits him with skateboard a second time. Said he grabbed R's gun and could feel the strap coming off his body, so he fired one shot.

Said he then lowered his weapon, and saw Grosskreutz lunge toward him with pistol pointed at his head.

Richards: "Did you re-rack your weapon" as Grosskreutz said?

"No I did not."

Richards is asking about the re-rack and Rittenhouse explaining what would happen if he had re-racked.

Grosskreutz said he did. R said no

Said Grosskreutz and his feet were touching as his gun is in his hand and arms are up, said Grosskreutz looked at him and brought his arm down and pointed it at him>

Then Rittenhouse shot him once. Didn't know where he shot him in the moment. Said he was no longer a threat

Said he briefly pointed his rifle at someone else who's hands were up. They backed up. Rittenhouse said he doesn't shoot that person.

He gets to his feet and walks to police line to turn himself in.

Observation: Rittenhouse has not been emotional during this part of testimony.

Rittenhouse said he couldn't hear anything, his vision was narrow and saw police lights.

Said he tried to move rifle behind him so police didn't see him as threat as arms were up.

R said he told the officer he just shot somebody, said officer said "Get the F*ck back or your're gonna get pepper sprayed. Go Home Go Home Go Home."

Said from there, he went back to Car Source 2 and sees JoAnn Fiedler at door. They let him inside after getting key.

He said he was in shock, doesn't remember what was happening in there. Said he was just attacked and his head was spinning.

R said he did not turn himself in to Kenosha PD because it was blocked off.

His mom took him to the Antioch PD after Black drove him to his house in Antioch.

R said he kind of told his mother and sister what happened.

Rittenhouse said his mom drove him there an hour after the shooting.

His mom is in audience crying.

R said the police there had him sit in lobby and sat there until Kenosha detectives arrived.

"I was vomiting and having panic attacks."

CROSS EXAMINATION NOW from ADA THOMAS BINGER.

"Good morning Mr. Rittenhouse."

"Everyone you shot at that night you intended to kill, correct?"

R said he did what he had to do to keep people from attacking him.

Binger: You intentionally used deadly force.

B: You fired four shots at him, you intended to kill him, correct?

R: I didn't intend to kill him.

B know asking about videos R has seen about what happened that night.

R said he does his best to not read what people write.

Binger saying Rittenhouse has had the opportunity to listen to everyone's testimony and then tell his side of the story.

Judge is sending the jury out of the room.

Defense is objecting to this line of questioning.

Defense said ADA commenting on Rittenhouse's right to remain silent, Binger said he's saying Rittenhouse is now framing his story

Judge said Binger is on the borderline of violating Rittenhouse's right to remain silent.

Jury coming back in.

Binger: You had your AR-15 loaded with 30 rounds of full metal jacket ammunition.

That could kill 30 people correct?

R: Yes.

B: Now asking about Black buying the gun for Rittenhouse

Rittenhouse said he bought the gun for Black for Rittenhouse as he knew he couldn't buy it.

R said yes.

Binger said he knew it was illegal for him to have the gun in Illinois.

Said he had applied to get a card in Illinois, but because of a backlog, and the charges against Rittenhouse, he said his application for his FOID card was denied.

Said he and Black agreed that the gun would stay there and he'd use it when they went to ranges and to Ladysmith.

B: You didn't ever go to the Bristol shooting range with that gun, correct?

R: Correct.

B: Now asking why R wanted THAT gun, opposed to a different gun.

Rittenhouse said he legally wasn't allowed to possess a pistol in Wisconsin, but could possess an AR-15.

Said his original plan was to get a shotgun, and he didn't want to go to a different store because they didn't have them.

The judge is now saying what Rittenhouse, the ADA, etc, believe the law to be is irrelevant.

Judge said to the jury he's allowing the testimony right now.

"Ignorance of the law is not an excuse." - Judge Schroeder.

Binger: You're saying the reason you wanted Black to buy the AR-15 and not a pistol was because of the law?

R: Yes

B: There's no other reason?

R: I thought it looked cool.

Binger asked if it resembles guns used in 1st person shooter video games, like Call of Duty.

R said he doesn't really play those games much, but there are many guns in those games.

B: The point is to kill in those games

Rittenhouse: It's a video game, not real life.

Binger now showing Rittenhouse's tiktok account.

Binger is asking about the account and "Bruh I'm just tryna be famous"

Rittenhouse now being questioned about being a Firefighter/EMT Cadet at Antioch Fire Dept. from 2018 or 2019 up until Aug 25

Rittenhouse said it's not formal classes, they met once a week, and they would do EMT training like "airways" or firefighter stuff like hose drags and crawling through buildings.

Binger is having Rittenhouse clarify if cadets were allowed to respond to fires, which they couldn't.

Rittenhouse said he wouldn't be a firefighter or EMT after this program.

Binger: You were here in Kenosha telling people you were an EMT. That was a lie, correct?

R: Yes

Binger asked if he ever told anyone he was older than 17. Rittenhouse said it never came up in conversation, and believed he had rights to be there

B: But you weren't an adult

Binger now asking about his employment. R was furloughed from the YMCA when COVID hit.

He worked 41.5 hours at the Rec Plex as a lifeguard, starting on August 14, just 1.5 weeks before the shooting.

Binger: There was a time you wanted your AR-15 in Illinois, wasn't there?

R: "There was a time Dominick were mad at each other"

B: So you wanted the gun down there?

R: Something along those lines.

Binger: You're telling this jury it was justified to use deadly force to protect your own life.

R: Yes

B: You'd agree you were not allowed to use deadly force to protect that Car Source building, correct?

R: Yes.

Binger listing more reasons R agrees with.

Binger: "But yet you have previously indicated you wished you had your AR-15 to protect somebody's property, correct?"

Judge sending the jury to the library.

Richards: Mr. Binger is either forgetting the courts rulings or attempting to provoke a mistrial. He knows he can't go into this.

The next time I'll be asking for mistrial with prejudice. He's an experienced attorney and he knows better.

Judge is now yelling at Binger.

Judge: Why would you think that made it okay for you to bring this matter before the jury.

He's screaming at Binger right now.

"I don't know what you're up to."

This is because of a motion the defense filed and the judge left open but said he was leaning toward accepting.

Binger said he acknowledged Rittenhouse said under oath that he had threatened to use that gun to protect property. Said he's working to impeach Rittenhouse during cross-examination.

Judge is yelling at him again.

Binger said he's trying to speak without being interrupted.

Binger is talking about an incident August 10 involving Rittenhouse.

He's trying to use Rittenhouse's verbal threat on August 10th that he was going to use his gun to shoot shoplifters.

Said R saying he pointed the gun at yellow pants man opened the door for this.

Richards says Binger knows if something was excluded in a pre-trial order, he needed permission to bring it up.

Judge to Binger: "Don't get brazen with me!"

"I said when I made my ruling, I see no similarity b/t talking about wishing you had your AR gun, which you don't have, to fire rounds at shoplifters, and the incidents in these cases."

Said he doesn't see the similarity because the incidents on August 25 happened in seconds, and he wasn't sitting there waiting to shoot people.

Judge said he doesn't want to have another issue. "Is that clear?"

Binger: Yes.

Jury coming back in.

"Alright folks, the objection's been sustained," the judge said calmly.

Binger is back to questioning Rittenhouse about the timeline of August 25 when he, Black, and Smith got to the city.

Binger asking about the text Rittenhouse sent to Khindri -- asking why he asked for the address, if he knew where Car Source was after driving past it every day.

Rittenhouse said roads were closed from 'the riots' and wanted to use it in his GPS

Binger: Despite the message everyone got at 8:00 about the curfew, you didn't decide to go home and leave like you're supposed to, correct.

R: I stayed at the Car Source.

Rittenhouse said he didn't see anyone leaving

Now Binger asking about Smith wanting to get a ride toward O'Hare to buy body armor.

B: The urgency was because he needed it for that night.

R: I wouldn't say he needed it, but he wanted it.

B: But instead you gave your body armor to him.

B asks if R regularly drives around with body armor.

R said he keeps in his trunk.

Now being asked about Rittenhouse buying a two slings -- one for him, one for Black.

R said he bought to help keep gun on him while providing medical aid.

B: Even when you had your gun, you took it off and handed to Fiedler because it was in the way when you were treating?

R: When I bought it, that was the purpose, but it didn't really work

Binger asks again if having a pistol or another handgun would've been easier.

R said if it was legal for him to possess one he would have.

Binger asking if Rittenhouse knew the AR-15 was taken out of the safe.

Said after he was instructed by Black, he went downstairs to get it. Believes the magazine was already loaded with 30 rounds.

Believes it was already chambered. Said he doesn't remember ever racking it .

The gun was loaded with .223 full metal jacket, per Rittenhouse.

Binger backs up to the 30 rounds of ammo. Rittenhouse said it was left over from when they were in Ladysmith when the gun was purchased

Binger said Black testified he shot at targets 75 feet away.

Rittenhouse said no, saying he only shot from where the stand is to the TV monitor (A few feet)

Binger: Did you know the capability of your weapon?

Rittenhouse: "I'm not an expert on AR-15s"

Rittenhouse said he knew the ammo was .223 Full Metal Jacket.

Binger asking if he understands what different bullets can do -- hollow point

Rittenhouse said "a bullet is a bullet" and "sorry, I don't know much about ammo."

Time for a lunch break -- court will return at 1:00.
