As I did last week, I will start a P.M. thread of the #RittenhouseTrial.
Gaige Grosskreutz is still on the stand in cross examination.
Jury is being called back to the courtroom now. Cross examination will resume momentarily.
Judge asks jury "How was the KFC?"
Fried chicken was the lunch today.
Chirafisi is showing Grosskreutz a document -- it's his statement given the day after to police.
"I told multiple officers that I had dropped my firearm. Right next to that you put your initials"
Chirafisi now getting into the post from Grosskreutz' former roommate, including a photograph of the two that was taken after the shooting in the hospital.
"Did you tell Mr. Marshall that your only regret was not killing the kid."
"No. I never said."
More of what his old roommate wrote was that Grosskreutz regretted not emptying his entire magazine into Rittenhouse.
Binger objects to those two pieces of evidence, and said he wanted to talk with the judge after.
He's now working on re-direct.
About to show some video again.
You hear Rittenhouse yelling out if anyone needs a medic.
G: "We got our own medics. You can go home."
Why did you say that?
G: Said these groups of people weren't received very friendly toward other demonstrators and said defendant lacked knowledge to fulfill role as medic
Again seeing the video of Gaige Grosskreutz' interaction with Kyle Rittenhouse after he had fatally shot Rosenbaum, and comparing it with statement to police after surgery.
He said he did not have his phone, and had not seen this live stream at that point.
Just saw video from Grosskreutz after he dropped phone after being shot. You can hear Grosskreutz screaming for a medic after the shooting.
Grosskreutz is never heard making any threats or comments to the defendant, which he testifies he did not.
Grosskreutz said he never intentionally pointed his gun at Rittenhouse.
Binger asks Grosskreutz if he would have gotten that close to Rittenhouse if his intent was to shoot him.
"If that was my intent? No."
Grosskreutz is now demonstrating how he was standing and why to the jury.
Video-
Binger: Is that the way you hold and point a gun when you’re going to shoot it.
Grosskreutz: No.
Chirafisi is now doing follow up cross examination.
Asking about his 'non-verbal' actions that showed aggression toward Rittenhouse even though he hadn't verbally threatened him before getting shot in the arm.
Chirafisi showing the photo again that shows Grosskreutz's gun is pointed in the direction of Rittenhouse's head.
He disagrees with Chirafisi that he's pointing directly at his head
C: You never said a word to him other than approach him with your gun out from three feet away.
Binger: When you asked the defendant if he had shot anyone, he lied to you, didn't he?
G: Yes he did.
B: You viewed his actions as threatening?
G: Yes
Chirafisi: Rittenhouse didn't lie to you.
G: Yes he did.
A little more back and forth there, but Grosskreutz is now off the stand.
State is now calling Heather Williams to the stand. She works for the Wisconsin State Crime Lab in Milwaukee as a firearms and tool mark examiner. #RittenhouseTrial
She examines firearms and related evidence, she says. Going over her experience now.
Her testimony is finished, no cross examination.
State calls Jason Krueger to the stand.
Krueger is an officer with the Keonsha Police Department.
Krueger was working the night of Aug. 25, 2020.
Was in the vehicle Rittenhouse approached after the shooting as his hands were raised.
Said he did not hear any specific phrases from crowd. Said he was focused on finding out where gunshots were coming from.
As Rittenhouse approached, he was giving him commands to keep away from his squad to stay back. Krueger said he pulled his pepper spray and was ready to use it.
Krueger said he did not view Rittenhouse's hands up as a surrender to them.
Said many people armed those days would put hands up.
Said Rittenhouse wouldn't listen to commands, so he sprayed pepper spray in his direction. Said he's unaware if it hit him, but he walked away
Chirafisi is up for cross examination. Said he doesn't have a whole lot of questions.
"Do you hear what you believe to be rifle rounds around 11:50 or so?"
"I heard gunshot rounds." Couldn't tell what kind of firearm.
Chirafisi asking about Rittenhouse having his arms up and Krueger's testimony that people with firearms would put their hands up so police knew they weren't a threat to them.
"Were you interested in finding out if he had any information?"
"I was."
Chirafisi now asking about video from Richie McGinniss from the Daily Caller. McGinniss showed Krueger video, and he recognized the man in the video, who was Rittenhouse.
Krueger then connects that Rittenhouse was the one who was approaching with his hands up.
ADA James Kraus on re-direct.
Krueger's testimony is finished.
State now calling Kristan Harris to the stand. He does The Rundown Live -- an independent news/media website.
Harris said he finished high school, but does not have any formal journalistic education.
Has been doing reporting for the last 12 years. Also contributed for "Cop Block" which has since been banned
Harris says he's covered protests from Minneapolis, Jacob Blake in Kenosha, and the January 6th insurrection at the U.S. Capitol.
We're seeing parts of The Rundown Live's live stream from that night.
Binger asks who Harris is talking to while live streaming -- Harris said he was talking to Rittenhouse, who said he was a medic.
He said "They have their own medics"
Harris now being asked about Joseph Rosenbaum and if he ever saw him or if he was in this video.
No was the answer to both.
Chirafisi now being cross examined.
Chirafisi asking if Rittenhouse was being violent or threatening.
Harris said no, that he was offering help.
Harris said he never saw Rittenhouse go after the people throwing rocks at the men who were armed standing on top of the Car Source.
I meant "begins" not being.
Chirafisi finishes cross examination.
Binger has a re-direct.
"The people you characterized as the militia...was the defendant dressed the same as them?"
"No he was not."
Binger now clarifying the clothing, gun, and actions of Rittenhouse compared to the others
Binger asking Harris about the man who said "You want to f**k around and find out."
Did you interpret that as a threat?
"I didn't really think about it but I could see how it could be interpreted that way."
The defense is explaining why they're motioning for a mistrial.
It's all in connection to the line of Binger's questioning that Judge Schroeder said was an over reach regarding his right to silence before his trial.
He was parked in his car on 63rd and Sheridan across from Car Source.
This is Zanin
Her stepdaughter was recording out of the window of the car.
Zanin said the reason he was parked there was because he saw fire coming out of the passenger seat of a car there. Said he saw people smashing the car windows.
We're seeing video now recorded from his step daughter
Yesterday, we heard testimony from the man who survived being shot by Rittenhouse.
Today, we're expecting the state to rest its case.
Judge Schroeder said a lieutenant saw someone outside video recording the jury. The judge said the lieutenant told the man to delete the video, and the judge said the next time, he was instructed to take the phone from the person recording.
The judge was asked if that person has been in the courtroom observing the trial, and the judge said he is not sure.
The #RittenhouseTrial resumes this morning, and we're expecting to hear testimony today from Gaige Grosskreutz, who was shot in the arm by Rittenhouse the night he shot and killed Joseph Rosenbaum and Anthony Huber.
