Good morning from #Kenosha!

Today is day 7 of the #RittenhouseTrial.

Yesterday, we heard testimony from the man who survived being shot by Rittenhouse.

Today, we're expecting the state to rest its case.
Judge Schroeder said a lieutenant saw someone outside video recording the jury. The judge said the lieutenant told the man to delete the video, and the judge said the next time, he was instructed to take the phone from the person recording.
The judge was asked if that person has been in the courtroom observing the trial, and the judge said he is not sure.
NEW: Also of note, the gun charge #KyleRittenhouse was facing and the defense wanted dropped will NOT be dropped, per the judge. #RittenhouseTrial

POSSESSION OF A DANGEROUS WEAPON BY A PERSON UNDER 18

The charge is a misdemeanor punishable by up to nine months behind bars.
The state is calling James Armstrong to the stand as it's first witness today. He is a senior forensic imaging specialist with the State Crime Lab in Milwaukee.

Armstrong is being asked about the FBI infrared video from a plane above the scene when Joseph Rosenbaum was fatally shot.

Armstrong said he annotated and highlighted Persons of Interest in the video.
Armstrong said he's also recently done more forensic imaging work -- which was clarifying and tracking the higher resolution drone video that was discussed yesterday.

Armstrong said there was no sound with these videos from the drone.
State finishes direct examination

Mark Richards is up for cross examination.

He asks Armstrong when he received the videos, and he said he got them from ADA Kraus on Sunday.

Richards said they just got this video Friday.
1920x844 is the resolution, per Armstrong.

Armstrong says the video is 30 frames per second.

He's being asked about timing things by frame, but said it's beyond his area of expertise.
The state now calls Dr. Doug Kelley. He's a forensic pathologist.

He works for the Milwaukee County Medical Examiner's Office, which handles the forensic pathology for Kenosha County.

Kelley performed autopsies on both Joseph Rosenbaum and Anthony Huber.
Kelley is explaining how a body is brought to the state crime lab and how they're stored until they're able to perform the exam.

Said the autopsy of Huber began quickly.
Kelley said to start an autopsy, he always examines a body as is, take photos, then they take clothing off, take photos, then clean and take photos.

Said they look for evidence for trauma, disease, etc.
"Mr. Huber died of a gunshot wound to the chest."

"Mr. Huber has an entrance wound just below the left nipple" said it traveled through his chest, and created damage to the lungs and significant damage to his heart.

Bullet did not exit, was located just below right collarbone
"The trauma to the heart and lungs is pretty extensive from this wound, so he bled."

Said there was blood in both chest cavities, over a liter in the left, 2L in right.
Kelley explaining the trajectory of the bullet and how they determine how it travels through the body.
Kelley said Huber also had some small scrapes "here and there" and a good size scrape to his right thumb, knees, and inside of his elbows, as well as lower back.

Internal: Hemmorage to left side of "deep" scalp, but no injuries to brain or skull itself.
Kelley said there's no way to age a bruise or scrape, said they could have been there prior, no way of knowing accurately.

Kelley said Joseph Rosenbaum's autopsy was performed the following day, August 27th.

"When Rosenbaum came to the office, his clothing had been removed. He'd been to the hospital and his clothing had been removed. Mr. Huber came with clothing still on."
Said Rosenbaum's body came with plastic bags on his hands to protect potential evidence.

Kelley said he had several injuries related to gunshot wounds.

"Mr. Rosenbaum has a number of injuries."
Kelley said he saw injuries from two bullets that entered the body and did not exit, one grazed skin, then another injury Kelley believes is an entrance and exit wound from the same bullet.
Kelley now explaining what stippling is to the jury.
Kelley explaining what Pseudo-stippling is -- anything that hits the skin and leaves a mark that is something other than gunpowder
Said they look very different than gunpowder stippling, and can be caused by a variety of things.
Kraus asks Kelley about the gunshot wound to Rosenbaum's right groin area -- it passed through the body and hits the pelvis and creates a bad fracture.

Kelley said bullet continued, and bruised the right buttock where bullet was found.
Kelley said *this* wound is not an 'immediately lethal wound'
Kelley now explaining a wound to the left hand, "a very complex wound"

Said there is tearing of the skin from the palms through the fingers, and the bullet exits through the back of the hand.
Kelley said he thinks that wound is associated with a wound to the lower left thigh. Said there is bruising and small cuts there, where he recovered small fragments of a bullet there.

"This is very characteristic of a ricochet type wound."
Said this injury is also not one that would cause death, Kraus asks if that would be clarified as a superficial wound.
Kelley said on the right frontal area of the head -- right lateral forehead, there is a graze wound

Kelley said bullet grazed part of Rosenbaum's head, and appears that the bullet moved back to front in a downward trajectory.

"The angle is sharply downward" from back to front
Kelley now talking about the wound that enters the back about an inch to the left of upper midline.

It passed through right chest cavity.

Created a great deal of injury to right lung, blood in right chest cavity, perforated diaphragm, enters liver, fractured ribs.
From there is passed into right flank, where Kelley collected the bullet.
"This gunshot is a lethal injury. This gunshot wound is the one that would cause death as a result of injuries to the lungs and the liver with the hemorrhage."
Trajectory: Downward, then eft to right, Kelley said it was from back to front.
Jury is about to see extremely graphic photos.

First is the graze wound to Rosenbaum's head.
Next photo is a wound to the left leg. Rittenhouse has his head turned away from the screen, as he did while the jury looked at Huber's photos.
Next is a picture of Rosenbaum's left hand injury.
Next is a picture showing the exit wound from the left hand.

Now another hand photo -- showing all of the laceration on his hand as the bullet traveled.

Dr. Kelley back seated on the stand after standing at the screen to describe to the jury what they were seeing.
Kelley said the autopsy alone does not allow you to know what position someone was in when they're shot, or which wounds came first.

Said video can be helpful to answer those questions.

Kelley said the portion of video with sound helps
"Knowing he has these wounds to different areas...looking at the video and paying attention this his body position, I was at least able to say the only time he could have incurred the wounds to the back is when he's more horizontal" which is the last two gunshots.
Kelley says one of the first two gunshots at Rosenbaum was when he was four feet away, the final two shots were fired as Rosenbaum was falling and perpendicular to the ground.
Kelley says the injury to the groin that went to through to the right side of the pelvis may have led to Rosenbaum falling forward.

"It's a possibility."
Kraus asks how the hand could have been positioned for the injuries to be sustained -- Kelley said Rosenbaum's hand is in close proximity to the end of the rifle, with the palm to the ground.
Four gunshots called all five wounds.

Direct examination of Kelley has finished.

Court on break. Will return at 11.
Jury is being called down to the courtroom.
Defense attorney Mark Richards is starting cross examination of Dr. Kelley now.
Richards is asking for clarification from Kelley on stippling, both soot and gunpowder.

He's focused on the soot stippling on the hand, saying it had to be in very close range or in contact
Richards: That hand was over the barrel of Mr. Rittenhouse's gun (before the shot to the hand)

Kelley: That makes sense, yes.
Richards is having Kelley draw and circle where soot is seen on Rosenbaum's hand.
If the furthest he was away with the stippling you see in the wounds was four feet and closing, that goes very quickly if someone is running at you.

"If I'm lunging and going toward your gun, which is an extension of your body, closer still?"

Kelley: Yes.
Richards now asking about the wound in Rosenbaum's back, and the trajectory.

"We're not saying he was turned and shot in the back, correct?"

Richards continues to ask about the trajectory, saying the position of lunging would put Rosenbaum horizontal
Richards now jumps to Anthony Huber -- and the stippling found on that wound
Defense is asking about Huber hitting Rittenhouse in the head with a skateboard. Prosecutors keep objecting saying it's a conclusion only the jury can make.

The judge disagrees, since the medical examiner has seen the video.
Defense is asking Dr. Kelley about the timing of the shots and the order of the shots. Kelley again explains via autopsy alone, you can't put the shots and wounds in order, but the video helps clarify that.
Kelley believes the shot to the pelvis was first, and believes the injuries to the head and wound to the back would be the 3rd and 4th shots.

"If I was diving like a bull, that would be consistent?"

Kelley agrees.

Richards: "I have nothing further."
Kraus is back up for re-direct. He asks if it's also possible the wounds that go from back to front are consistent with the theory the shot to the pelvis caused Rosenbaum to fall forward.

Kelley agrees.

"The barrel would have to be behind the injury, correct?"

Yes.

Kraus asks if it's consistent with a 'swiping the barrel away motion" -- Kelley said he can't comment to that.

Kraus is having the detective point Rittenhouse's AR-15 at him to demonstrate the distance Rosenbaum and Rittenhouse were
Richards is back up for follow up cross examination. Richards takes the gun out of the detectives hands. Detective follows and they also do a physical demonstration asking Kelley questions.
The judge is allowing the still pool photographers to get closer. It's hard to see what's happening because the jury's TV monitor is in the way -- but the judge wants the pictures for purposes of the record, too.
Richards asks Kelley if the first gun shot would make Rosenbaum move forward. Kelley said he had forward momentum.

Kelley's testimony is over. Time for lunch.
#BREAKING: THE STATE HAS RESTED ITS CASE AGAINST KYLE RITTENHOUSE.

They will not be calling the FBI agent back up.
Defense will ask to dismiss the curfew violation, saying they never entered the lawful curfew order into evidence.

The judge said he would allow the prosecution to open that evidence back up and Mark Richards is outraged because the state just rested.
The judge said he's gonna take this under advisement.

State calls Lucas Zanin to the stand.

He was parked in his car on 63rd and Sheridan across from Car Source.

Zanin said the reason he was parked there was because he saw fire coming out of the passenger seat of a car there. Said he saw people smashing the car windows.

The judge said he will be informing the jury the testimony from the FBI agent will be dismissed as they are not finishing testimony.
The first person the #Rittenhouse defense is calling is Nick Smith.

Smith is friends with Dominick Black, who bought the AR-15 for Rittenhouse.

Smith formerly worked at the Car Source he, Black, and Rittenhouse went to guard, armed, in Kenosha
Nick Smith is seen in this photo that was submitted as evidence last week.

He's in the white hat with the orange cross.

An employee of Car Source, Anmol "Sam" Khindri, said they never asked for anyone to guard their business.

The defense claims otherwise.
