#SupremeCourt to hear plea highlighting the “inaction” of Supervisory committee appointed by the court to take care of material and safety aspects of Mulla Periyar Dam #MullaiperiyarDam
In view of a recent spell of heavy downpour in Kerala and the threat of floods looming large, the Supreme Court had in the last hearing issued an interim order saying the water level in the dam can be up to 139.05 feet.
Tamil Nadu govt has informed the #SupremeCourt that Mullaperiyar dam situated in Kerala's Periyar river and which supplies water to five districts of Tamil Nadu, is structurally, hydrologically and seismically safe

SC: Give us 5 minutes to wrap up one matter
Sr Adv Jaideep Gupta: this matter was adjourned for Kerala to file a better affidavit.

#supremecourt #MullaperiyarDam
Gupta for Kerala: It was stated that the water level as prescribed by expert committee was to be maintained. Tamil Nadu has filed a reply to which we file a reply by Monday... there is a cyclonic formation there also

Sr Adv Shekhar Naphade: Lets have it on Tuesday

SC: We have a part heard on Tuesday, we can have it on Thursday

Lawyers: Thursday is fine

SC: Let us have it on Monday then

Naphade: I have too many matters on that date

SC: That is the problem of handling it

Matter adjourned to Nov 22, 2021 ..interim arrangement to continue
Sr Adv Gopakumaran Nair requests for physical hearing

SC: Okay come all the way from there

Nair: its better, i can do that rather than face unmuting issues here on #virtualhearing
Adv VK Biju: the deepness of the seepage is extremely important to ascertain..people of kerala asking for data and chairman of supervisory committee ..

SC: So what do you want to say?

Biju: before hearing, the seepage data should be made available to this court
SC: You can circulate the plea to respondents

Naphade: malafides are writ large on the face of the report.. the main intention of such applications is to harass us.. but we will place all the records
SC: If there is an evolving situation, how it has been addressed and how it will be addressed needs to be looked at
SC notes that lawyers appearing, in this case, can appear physically even if the matter is slotted for virtual hearing

Naphade: I am talking with a sense of responsibility these petitions are only a result of social media posts

Hearing ends

@MamataOfficial #supremecourt Image
@MamataOfficial The appeal states that Calcutta High Court grossly erred in making the baseless, unfounded, unjust, unfair, and unfortunate remark that the CAT order was passed by “paying obeisance to the diktat of the Union of India”. #CAT #SupremeCourt

CJI: We listed this case since there has been issue of transferring some judges in some states who may be hearing such cases

Sr Adv Kapil Sibal: I had argued that in UP a magistrate court is not hearing such cases and it is being heard by sessions court.

CJI: This is sad
CJI: When we heard this case a few years back no one raised an objection but now when the case is over people are coming with issues
