#Using_public_money_for_memorials

Proceedings to buy JJ's residence quashed by MHC: "Today's India is not a land of pharaohs or emperors to immortalise the dead.

Justice N.Seshasayee said the need for the memorial could not be dictated by professional achievements, political populism, an image carefully groomed by cultivated charisma and electoral victories.

Referring to the State having relied on a 1969 SC Judgement related to a memorial for Mahatma Gandhi in Ahmedabad, the Judge asked, "By relying upon this verdict, has not the Govt. acknowledged that the benchmark for establishing a memorial with public money can be justified.....

only if the life & contribution of the person for whom the memorial is proposed approximates the life of Gandhiji & those of his illai?"

He went on to state: "In contemporary times, where there is a perceptible depreciation of ethical standards & erosion of moral values

which cumulatively leave their adverse impact on the constitutional responsibility & institutional integrity, #there_may_not_be too many leaders who may match the standards of those who gave their lives for the cause of the nation or the humankind."

The Judge said, "In other words, if the life of a leader has #only_a_relative_value to #some and #not_to_the_substantial_number,

then there is a risk of its becoming a memorial for a group of followers and not the public and may well fail in a judicial review of an alleen colourable action of the Executive."

The Judge pointed out that the affidavit filed by the Chennai District Collector only projected certain traits - the respect commanded & welfare measures initiated by JJ - for explaining the public purpose for converting the residence into a memorial

Referring to the issue of expenditure of public money, the Judge said that as a prudent manager of public funds, it is the #duty_of_the_Govt to deploy public money where the investment fetches tangible returns to the public at large
