The Supreme Court has upheld a 2011 Ombudsman ruling dismissing Surigao del Sur 1st District representative Prospero Pichay, Jr. as head of the Local Water Utilities Administration (LWUA) for grave misconduct and perpetually disqualifying him from public office.
The admin case vs Pichay stemmed from LWUA’s acquisition of a thrift bank w/o approval of the Monetary Board and the President. Pichay was LWUA chair from 2008-2011.
Same transaction led to charges of 3 counts of graft and 1 count of violating Manual on Regulations for Banks.
In affirming the finding of grave misconduct, SC said Pichay proceeded with LWUA's purchase of 445,377 shares of Express Savings Bank, Inc. for P80M without approval of the President and the Monetary Board, despite several letters reminding him of the reqts.
LWUA also deposited P300M and made advance payment of P400M to subscribe to increase in ESBI's authorized capital stock.
LWUA employee-complainants said ESBI was under BSP rehab and LWUA's P480M investment was not protected by govt securities/ESBI's certificate of stocks.
SC said LWUA’s ESBI transaction resulted in P780M loss on the part of govt.
The undue injury to the govt was also the basis for the SC’s ruling that the Sandiganbayan had probable cause to charge Pichay of graft.
LWUA also did not register the acquisition of ESBI.
Pichay claimed perpetual DQ under AO 07 only applied to govt positions that involve employment, not to any public office.
SC said AO 07 makes penalties under EO 292 applicable to disciplinary actions which include perpetual DQ from holding public office.
Pichay, who served as Surigao del Sur 1st District rep from 1998-2007, lost in the 2007 senatorial race before becoming LWUA chair in 2008.
After his dismissal from LWUA, he returned to same seat at HOR and is now running for his 3rd and final term in the May 2022 polls.

SOJ Menardo Guevarra defends "no vaxx, no ride" policy
Guevarra says that while a person has the right to refuse vaccination, State has power to regulate movement of unvaccinated if in the interest of public health/public safety and for benefit of vaccinated and unvaccinated.
Guevarra: Note that there is no restriction on travel for unvaccinated persons, just restriction on access to public transportation or common carriers, subject to well-defined exceptions.
But isn't there, in effect, discrimination vs unvaccinated who do not own cars as oppose to those who do?
Guevarra says there is substantial distinction bet vaxxed and unvaxxed. More than 3/4 who get hospitalized are unvaxxed, more than 3/4 who die are unvaxxed.
Atty. Howard Calleja says at least 2 more groups set to file next week petitions vs. Ferdinand "Bongbong" Marcos, Jr. either to intervene in the petition to cancel his certificate of candidacy or to disqualify him.
Calleja will serve as counsel. Says this is separate from his duties as convenor of 1Sambayan and insists this is not driven by political motivation.
One group will be composed of Martial law victims while another group will be led by Dr. Rommel Bautista.
Aside from the issues already raised in the first Comelec petition, one of the arguments petitioners will raise is that the CA ruling which reduced penalty for non-filing of income tax returns to mere fine is void ab initio. They will raise it before Comelec, eventually to SC.

The petition to cancel or deny certificate of candidacy of Ferdinand "Bongbong" Marcos, Jr. filed before Comelec is anchored on his supposed "false material representation" that he is eligible to run for President of PH, despite having been convicted of tax evasion.
Petitioners from Task Force Detainees of PH, KAPATID, Medical Action Group, FIND, PH Alliance of Human Rights Advocates and Balay say Marcos' 1995 conviction for tax evasion should prevent him from running for president, even if CA reduced penalty to fine.
Marcos was convicted for failure to file mandatory income tax returns from 1982 to 1985. Mere conviction, according to petitioners, perpetually disqualifies him from running for any public office.

Citizens’ Budget Tracker reviewed P20B worth of pandemic contracts as of Aug 2020. While 2/3 did not have sufficient descriptions, researchers analyzed prices in P5.4B contracts and came up with estimated P319-P550M potential savings if compared to average market prices.
