SOJ Menardo Guevarra defends "no vaxx, no ride" policy

Guevarra says that while a person has the right to refuse vaccination, State has power to regulate movement of unvaccinated if in the interest of public health/public safety and for benefit of vaccinated and unvaccinated.
Guevarra: Note that there is no restriction on travel for unvaccinated persons, just restriction on access to public transportation or common carriers, subject to well-defined exceptions.
But isn't there, in effect, discrimination vs unvaccinated who do not own cars as oppose to those who do?

Guevarra says there is substantial distinction bet vaxxed and unvaxxed. More than 3/4 who get hospitalized are unvaxxed, more than 3/4 who die are unvaxxed.
Guevarra: Unvaccinated not absolutely prohibited from public transport, provided they have passes to show they are out to obtain essential goods and services (food, medicine); or that they have medical certs showing they couldn't be vaccinated for medical/health reasons.
Legal basis for access to public transpo/common carriers? Aren't common carriers required to offer services to the public?

Guevarra: Common carriers bound to carry passengers safely to their destinations and ‘safely’ means freedom from accidental injury, transmissible diseases.
Guevarra also stresses that the "no vaxx, no ride" policy is time-bound (only while the NCR is under alert level 3 or higher), and not meant to be adopted in places with very low vaccination rates.
Guevarra says DOTr's authority comes from the Administrative Code (EO 292) and indirectly from RA 11332 (mandatory reporting of notifiable diseases) as a member of the IATF.

Cities in NCR also enacted ordinances limiting the movement of the unvaccinated.
Guevarra refuses to comment on specific case of partially vaxxed woman not allowed to board PUV on the way to a medical exam for job application, saying he doesn't know all the facts. But he acknowledges practical problems of implementation. "Mahirap at mabusisis talaga."

The Supreme Court has upheld a 2011 Ombudsman ruling dismissing Surigao del Sur 1st District representative Prospero Pichay, Jr. as head of the Local Water Utilities Administration (LWUA) for grave misconduct and perpetually disqualifying him from public office. ImageImage
The admin case vs Pichay stemmed from LWUA’s acquisition of a thrift bank w/o approval of the Monetary Board and the President. Pichay was LWUA chair from 2008-2011.
Same transaction led to charges of 3 counts of graft and 1 count of violating Manual on Regulations for Banks.
In affirming the finding of grave misconduct, SC said Pichay proceeded with LWUA's purchase of 445,377 shares of Express Savings Bank, Inc. for P80M without approval of the President and the Monetary Board, despite several letters reminding him of the reqts. Image

Atty. Howard Calleja says at least 2 more groups set to file next week petitions vs. Ferdinand "Bongbong" Marcos, Jr. either to intervene in the petition to cancel his certificate of candidacy or to disqualify him.
Calleja will serve as counsel. Says this is separate from his duties as convenor of 1Sambayan and insists this is not driven by political motivation.

One group will be composed of Martial law victims while another group will be led by Dr. Rommel Bautista.
Aside from the issues already raised in the first Comelec petition, one of the arguments petitioners will raise is that the CA ruling which reduced penalty for non-filing of income tax returns to mere fine is void ab initio. They will raise it before Comelec, eventually to SC.

#ANCRundown: A youth group in Cagayan accuses some police officers of credit-grabbing. They arrived in the middle of a relief operation on October 31 with a tarp of President Duterte’s face and the words “Duterte Legacy.” They then took photos and left.

In this video clip from Oplan Bangon Cagayan, youth volunteers explained their concerns that their activity might be politicized with the tarp in place. But police officers asked to borrow 1 or 2 relief packs for “photo-ops.”

On #ANCRundown this morning, Zach Singson, project implementer of Oplan Bangon Cagayan, explains what happened and what their concerns are over the incident.

The petition to cancel or deny certificate of candidacy of Ferdinand "Bongbong" Marcos, Jr. filed before Comelec is anchored on his supposed "false material representation" that he is eligible to run for President of PH, despite having been convicted of tax evasion. ImageImageImageImage
Petitioners from Task Force Detainees of PH, KAPATID, Medical Action Group, FIND, PH Alliance of Human Rights Advocates and Balay say Marcos' 1995 conviction for tax evasion should prevent him from running for president, even if CA reduced penalty to fine.
Marcos was convicted for failure to file mandatory income tax returns from 1982 to 1985. Mere conviction, according to petitioners, perpetually disqualifies him from running for any public office.
