Reading the ruling in this case issued on 2/17, the judge completely slammed @ITServeorg for being wrong about almost every single aspect of the case. Image
ITServe's case revolves around one of their H1B dependent bodyshops (Saxon Global) which argues they must be allowed to bench their workers and shuffle them around the country without doing any paperwork or paying any fees that hurt their bottom line. ImageImage
Saxon Global was BAILED OUT by we, the federal taxpayer, to the tune of $2 million dollars. Their "loan" was forgiven which means they don't have to pay back a single cent. And they say they can't afford to pay USCIS a measly couple of bucks... 🙄

STEM OPT is an ILLEGALLY created program that should not be expanded by every admin at the whim of the cheap labor lobby.

⚖️ H1B Lottery lawsuit ⚖️

Yesterday plaintiffs submitted their reply to DHS and ITServe's motions for summary judgment, and included exhibits showing DHS was warned about abuse of the #h1blottery electronic registration system. 🧵
Compete America warned about "flooding the system" with duplicate registrations. They predicted good faith users would be harmed and trust in the lottery system would erode.

Information Technology Industry Council expressed the same concerns about flooding the system with phony applications and asked USCIS to clarify how they planned to prevent fraud.

This is why the H-1B visa is not popular for hiring lawyers. If you treat them as indentured servants (i.e. using the visa as it was designed), they can turn around and sue you.

Sound familiar? Thanks to dual intent, employers can get away with abuses because employees are holding out hope for a green card and will put up with a lot. The #h1b visa is EVIL in so many ways. Reform it or end it @SenatorDurbin @ChuckGrassley @RepJimBanks.

This is a perfect case study why we need to issue the H-1B wage rule @SecMartyWalsh @USDOL @POTUS to protect workers and prevent wage abuses.
