3. This case starts with an arrest of gunners Swaran Dass & Aya Singh in 1975. Both were arrested for Spying for 🇵🇰 but Court martialled for Absence without leave & not espionage.

4. Swaran Dass implicated several names including Captain Rathaur & Captain Rana (both arrested in 1979). Some 50 serving Army Officials were arrested.
Captain Rathaur was brutally tortured and forced to confess 12 names. One amongst them was Captain Rana.

5. Captain Rana signed a blank sheet of confession after torture, which later bore 52 serving Army Officials.
Conveniently, in 1990, Aya Singh was shot dead by the Army for allegedly crossing the border.

6. In 1994, T. V Rajeshwar, Director of IB said that, "the case would have been thrown out in the Civil Court." He also said that the entire case has been fabricated by Army.
7. V. K Kaul, the then Deputy Director of IB who headed the joint intelligence team investigating the case said, "It was a mixture of lies and fiction incapable of belief without fullest corroboration, and there wasn't any."
8. In 2000, both Captain Rathaur & Captain Rana were acquitted by the Delhi HC. The HC said “the gross miscarriage of justice” done by the army to its officers in the Samba spy scandal which rocked the country. This verdict was challenged by the Army in the SC.
9. Later the SC quashed the HC order & justice was denied.

10. In 2016, Swaran Dass, confessed wrong names mainly because he was tortured if he didn't speak. But when when he gave false names, he was awarded with liquor & money.

11. In 2019, Captain Rathaur & Rana filed another petition asking to declassify all the documents that were earlier held in the interest of national security. The HC too directed the Army & the govt to file their response. The Govt & the Army haven't done so yet.
12. Our hearts bleed for these brutalised, persecuted and victimised Army Officers.
