Adv Thankan : KSRTC is a bulk purchaser of Diesel. Earlier we were enjoying subsidy then that was taken away. I have produced a chart in the petition comparing Retail Outlet Price and Bulk Consumer Price. Now the price of bulk purchase is higher
Nagaresh J : What is the logic here?
Adv Thankan : There is no logic other than marketing strategy, my lord.
Counsel for one of the respondents : when the price they enjoyed was less than retail price they never had an issue with being treated differently
Nagaresh, J : I still want to see the pricing mechanism.
Counsel for respondent : what happened is when subsidy was removed, the price went up. They are trying to say that this Court should interfere and insert a clause in the agreements with OMC. They cannot do that.
Nagaresh, J : produce the pricing mechanism
Adv Thankan presses for interim stay.
Nagaresh, J : no, this is not a matter where stay can be granted
INTERIM ORDER : standing counsel of Indian Oil Corporation is directed to a file a statement explaining manner in which price is determined
Adv Thankan : we will be forced to shut down my Lord
Counsel for respondent says the Supreme Court declined to grant an order. Adv Thankan points out that SC granted liberty to KSRTC to approach the Kerala HC
Nagaresh, J : let the statement come
Adv Thankan : just in Ernakulam there are 200 buses. We have special consumer pumps because if we go to regular petrol pumps, retail customers in the whole of Kochi Corporation will not get any petrol Or diesel for their use.
Nagaresh, J : no interim stay. We will consider after two weeks. You will have to suffer till then.
Adv Thankan : my lord, there may not be any further increase in price
Nagaresh J : you know that's not within the jurisdiction of the Court under Article 226
Nagaresh J : you (Indian Oil Corp) are a public sector undertaking so I feel you should give some leniency to public entities.
