🧵 Watching this live. Noteworthy that @victor_madrigal has backed off the assertion that international human rights law mandates a system of self-identification of gender. What it mandates is a system of gender recognition.
What he seems to be focusing on is the need not to discriminate against trans people about which I hope we can all agree. However the bill is not confined to trans people it allows anyone to identify as the opposite sex with next to no safeguards.
Also excellent to hear him say that he respects the difference between his mandate and that of @UNSRVAW & that her mandate on violence against women & girls must be respected.
I hope someone will pick him up on his assertions about the absence of evidence that self ID is used by men to abuse women in other countries & point out that may be because their crimes are being recorded as the crimes of women
Good to hear he’s concerned abt how lesbian & bisexual women receive healthcare. If this legislation goes thru many of us could find ourselves receiving intimate care & procedures from male bodied people self-identifying as women. Is that really acceptable?
Now he’s being asked about whether there’s any evidence of women self-excluding from trans inclusive services. There were sexual violence survivors who wanted to speak to the committee about this it’s a pity we don’t have the benefit of their testimony
His repeated insistence that trans women are women rather seems to deny the existence of sex, a protected characteristic under the law of Scotland, it’s such an extreme statement it necessitates a definition of what trans means which is absent from the Bill
It’s v depressing to hear it repeatedly implied that women & #LGB people concerned about the protection of their rights are engaging in a toxic & hostile debate. Human Rights are universal. Conflicts sometimes occur & need resolutions that respect all rights
Excellent to hear @UNSRVAW tell @MaggieChapman about how wrong it is that groups of women who are concerned about their sex based rights & single sex spaces have been accused of hate speech. I hope this will be taken on board
Now @UNSRVAW tells committee this is not about culture wars rather it’s about fundamental #HumanRights & the issue of how we all co-exist in society in a dignified way
And now @UNSRVAW tells committee that the failure to collect sex disaggregated data leads to conflation of results eg.male sex offenders who self ID as women while in prison & whose crimes are then recorded as those of women.
And @UNSRVAW emphasises the lack of data & impact assessments in other countries & absence of proper analysis. Many have contacted her regarding the problem of self exclusion. This is such important evidence
Now @UNSRVAW says guidance not enough on the draft legislation what is required is that we go back & address the issues she has raised. The draft legislation needs clarified & safeguards must be spelled out in law.
And @UNSRVAW says last week’s court judgment by Lady Haldane challenges the Scottish Government’s assertion that the draft legislation would not impact on the Equality Act so that too needs to be reconsidered
A potential gotcha moment falls flat when @UNSRVAW clarifies that while she might have signed a report supportive of Self ID in Bulgaria in 2021 her support was conditional on safeguards & she has learned during her mandate is how imperstinf safeguards are.
The @UNSRVAW also takes the opportunity to remind the committee that the Yogyakarta declaration is not established Human Rights law & it’s dangerous to look at it as such
Again @UNSRVAW emphasises this is not about a culture war it’s a #HumanRights issue & the right to have needs heard & addressed
And that’s a wrap for @UNSRVAW evidence. So clear & positively dripping with integrity. I’m sure many women will be immensely grateful to her for validating our concerns about this draft legislation & our right to articulate them.

🧵This is not a legal opinion on the domestic law of Scotland. The case law of the ECHR does not mandate self identification. The system of gender recognition we currently have is within the margin of appreciation allowed by the court 1/11
In particular the ECHR has recognised that “stringent” procedures aimed at verifying the underlying motivation for a change of legal identity are justified see page 22 of echr.coe.int/Documents/Guid…. 2/11
This “legal opinion’ contains no analysis of the potential conflict between the proposed system of self identification and the Equality Act and, in particular, of how self ID could undermine the sex based rights of women & same sex attracted people. 3/11

🧵 I’m at the Supreme Court today for #Indyref2 case. If the UK Govt had any respect at all for Scottish democracy, this court hearing wouldn’t be necessary.
At the 2021 scottish election the scot gov was elected on a manifesto commitment to hold a second indyref. Last time that happened 10 years ago in 2011 the UK govt respected that mandate & entered into an agreement to put beyond doubt the legality of indyref
That’s the established constitutional precedent of the right thing to do in these circumstances. That’s what they shd do now. That they won’t = denial of democracy and its unconstitutional.

🧵Yesterday another man appeared in court charged with threatening me on account of my belief that #SexMatters. I want to be very clear that every time someone in a position of power wrongly describes feminists or LGB people like me as transphobic simply 1/4
because we don’t share their belief in gender identity theory they risk inciting the sort of abuse & threats that I and others suffer from self styled “Trans rights activists” who in truth are nothing of the sort. 2/4
Instead, they are just good old fashioned misogynists & lesbophobes who are being encouraged & enabled by those who ought to know better. I don’t think enough attention is being paid to this problem. It needs to be called out by 3/4

This article was briefly amended to include @ALLIANCELGB side of the story but I can’t see it any more. Some might say that such hysterical anger at LGB people organising to protect their right to be same sex attracted is the very definition of #homophobia
Here’s what @ALLIANCELGB said “LGB Alliance is a registered charity whose goals are to promote equality and human rights for LGB people. All the publicly funded LGBTQIA+ groups now focus on the importance of gender identity,
saying that feelings of gender identity should supersede anything to do with biological sex. That is why we need our own organisation and services. LGB Alliance receives messages from young LGB people

🧵It’s #EuropeDay2022. As an @theSNP MP I lead the fight against the damaging #Brexit which Scottish voters had rejected & I am committed to delivering an #independent #Scotland which will rejoin the #EU. Here’s 10 reasons why. Copyright @Dr_PhilippaW
1. SOLIDARITY WITH A GLOBAL A-TEAM. The threats facing us are global. The EU leads progressive global action to solve shared challenges. An independent Scotland in the EU would be far stronger than post-Brexit UK scrambling for bilateral agreements.
2. EQUALITY WITH ALL EU STATES Brexit has left the UK more isolated than ever. An independent Scotland would be equal in the EU & seek to be a progressive voice & role model within the EU and internationally promoting greater consensus, equality, and respect.

🧵 Very disappointed not to get called to speak in the #OnlineSafetyBill debate this evening particularly as unsubstantiated allegations of transphobia were being bandied about. Here’s what I was planning to say
There is much to welcome in the Bill particularly in relation to tackling Child Sexual and Emotional Abuse online. As a former Specialist Sex Crimes prosecutor I am all too aware of how children are targeted online.
Sadly there are those in our society, often hiding in plain sight, who seek to exploit children and so child safeguarding should be a number one priority for any government. In so far as this bill seeks to do that I applaud it.
