This morning #Israel's defense forces convened an international conference on the law of armed conflict. This glimpse into the program reveals that "property destruction" is high on the agenda. I was not invited, but nonetheless, let me share my thoughts:
Going back to the Hague Regulations of 1907, Article 23(g) provides that it is especially forbidden “to destroy or seize the enemy’s property, unless such destruction or seizure be imperatively demanded by the necessities of war”
The 1945 Nuremberg Tribunal established, under Article 6(b) of its charter, “wanton destruction of cities, towns or villages, or devastation not justified by military necessity” as a war crime.
According to Article 147 of the 1949 Geneva Convention IV, “extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly” are grave breaches.
But, you say, #Israel's Military Advocate General (pictured here) wanted to discuss "the contemporary role of property destruction rule." Well then, here is something pertinent and directly applicable to Israel's contemporary occupation of #Palestinian territory. Art 53 of GCIV:
"Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited [...]
except where such destruction is rendered absolutely necessary by military operations." This necessity clearly refers to combat situations. It is to be narrowly construed, which is indicated by the word “absolutely”.
This brings us to the conclusion that #Israel's destruction of #Palestinian property - including humanitarian aid accepted - allegedly for the enforcement of spatial planning regulations does not fall under this exception of military exigency.
The International Criminal Tribunal for the Former Yugoslavia (ICTY) found that terrorizing the civilian population, forcible transfer, and destruction of personal property - undertaken in combination - are "crimes against humanity and violation of the laws or customs of war."

Since the beginning of the year and with a new #Israeli government led by the most extreme elements, @ochaopt and @UNHumanRights documented a 57 percent increase in the number of #Palestinians killed by Israeli forces.
A 70 percent increase in the lethality of Israeli operations this year demonstrates a change in the rules of engagement towards the liberal use of lethal force, and the employment of tactics and weapons delivering an increasingly lethal effect.
Combined with 225 attacks by Israeli settlers against Palestinians in the West Bank, of which 89 resulted in casualties, the systematic targeting of Palestinians is a daily and deadly reality.
Since this comes up often in - more or less - ingenuous responses, a reminder that @UN General Assembly Resolution 3314 defining aggression applies without prejudice to questions of recognition of a State, or to whether a State is a member of the United Nations.
#Israel's invasion and subsequent annexation of #Palestinian territory is an act of aggression, irrespective of the recognition of the State of Palestine @Palestine_UN.
In any event, the @CIJ_ICJ established in 2004 the territorial sphere for the realization of #Palestinian self-determination. Israel is bound to comply with its obligation to respect Palestinian self-determination and its 1995 Interim Agreement treaty obligations.
Would #Israel, claiming to offer refuge to survivors of WW II atrocities - among them my grandparents - oppose the prevention and punishment of crimes against humanity?
This is what took place at the @UN Sixth Committee (Legal) this week:
Delegates considered concluding a new convention on crimes against humanity, debating whether it would close gaps in the current international legal framework, based on the draft articles of the International Law Commission, and the @IntlCrimCourt Statute. #Israel pushed back.
Reiterating an earlier statement (2019), the #Israeli delegate insisted on the (contentious) primacy of internal jurisdiction over international justice, and on introducing stringent limitations on universal jurisdiction to prosecute the gravest international crimes. Shameful.
