Miller sent 150 exhibits at 9am! Stipulating exhibits could save time with Eastman.

Miller: For "time efficiency", stipulating exhibits or he'll have to examine Eastman on each of them.
Judge: Always encourage parties meet and confer to reach agreement on exhibits.
Miller plans to "hit other topics" besides the exhibits.

Miller going back to Carling's cross-ex about John Eastman on 1/5 and 1/6/21. Eastman was at the Williard in DC 1/3/21 thru 1/7-9.
Randy Miller (RM): Where were you?
John Eastman (JE): I was in the smaller suite with Giuliani. Other room for permitted rally on 1/5 & Ellipse 1/6.

RM: Meetings on 1/5
JE: 1st was Zoom hearing in GA. Then Eisenhower Exec Office Bldg with Greg Jacob (VP Pence counsel), then "ongoing discussions" on "illegality & fraud" in the Rudy room. Don't think I saw but presentations similar to TX v PA case... "impact of illegalities".

Judge: Meetings on 1/5, Giuliani, Boris Epshteyn, Bannon, investigators? JE: Not sure if 1/5.
RM: Discussion about voting machines with who?
JE: Prof John Baker had experts with info. Went to the big conf room for info. Machines: Joe Oltmann & Russ Ramsland.
RM: 1st you met Russ?
JE: Yes. Knew Russ with Antrim County MI. Also handled TX not allowing machines.
RM: Oltmann?
JE: 1st meeting, didn't know, presented as involved tech expert.

JE: Prof in Louisiana, met in 80s, "Constitutional Law", about the legislatures. Introduced to Oltmann, & Ramsland who was involved with Bailey v Antrim County, Ramsland's firm was to do the "forensic audit". Alleged voting machine issues.

JE: "I'd go get an hors d'oeuvre then someone else would come up to me" . Ramsland & Oltmann came to conclusion that ballots could be pre loaded in advance. Oltmann showed a chart demonstrating points of vulnerability.
Judge: Which machines were you speaking with them about?

JE: Not sure if just Dominion or the other 2 majors. Focused on GA because the runoff election was that night.
RM: Conversant with machines?
JE: Good word, I wasn't an expert. But machines shouldn't have been used in GA. Watched docu Kill Chain, read reports... (Eastman frozen)

JE: Machine problems for years...
(Note: Most objections related to no paper records, in 2000 many states didn't have them. That's changed. Dominion has paper ballots. Election deniers pretend we're frozen in time.)

Eastman says was watching GA election returns. Late evening, the "numerator" (how many ballots recorded vs ballots outstanding locked in at 95%... more were received but number didn't move. Only happens if you're increasing the denominator at the same time.

Then reporting shut down for an hour or 2, just like 11/4, They had predicted both things and they happened.
RM: What would make that malevolent?
JE: Possible that pulling ballots preloaded in "suspense folder" or replicating ballots digitally and stored.

We know this was/is bunk, but JE is focusing on what he heard & thought in Jan 2021.
Then came "transmittal of data" from China. Discussed with "several experts", didn't know if they could confirm that. Thought Ramsland & Oltmann were "very credible".

Joe Oltmann emailed John Eastman a chart, he had given him a paper copy. "Voting system diagram". Was discussing it with Giuliani, maybe Boris Epshteyn.
1:15pm EDT: Eastman has frozen up again but back quickly.

Opinion: Note that Joe Oltmann, like John Eastman, has ZERO election administration experience. Oltmann could make as effective a chart of brain surgery.

JE: Oltmann walked me thru it in great length. In red were vulnerabilities. Examples: 2 red boxes: Fake ballots (ballots pre loaded), phantom ballots (replicated in the system).
RM: Discussed with Ramsland too? JE: Yes RM: Was this info GA or voting machines in general? JE: Forensic audit in MI was source for issues.

RM: Further research?
JE: Well, I focused on the wi-fi symbol coming after the adjudication, that counting would shut down to connect to voter rolls so they'd match the # of ballots. They said they IDd a wireless chip in the Antrim County audit in the motherboard, had a PO.

RM: Is this the "malevolent wi-fi connection" info?
Judge: Text on left is about wi-fi? What addresses your testimony here?
JE: 1st 2 paragraphs describe potential... didn't focus on p2 or p4, Focused on p3.

RM: Was Jim Penrose involved with info you discussed with Oltmann & Ramsland?
JE: More about "incursions from Beijing China to Clerk's offices"... "I thought that was explosive". Could Penrose confirm it? Checked sources, can't confirm it was true. Met with Lengerg same time.

RM: Back to Oltmann's p2 "Big Con Little Con". Did it inform you?
JE: Yes, wanted to stay focused on the Big Con (machine manipulations) not the other stuff.
CA Bar objects to the exhibit as truth of the matter but for limited purpose of what Eastman was looking at.

RM: Did you go to the Freedom Plaza rally?
JE: Too late. By the time I got there, "the roadies were already breaking it down".
RM: Was Eric Quinnell part of anything on 1/5?
JE: No, he wasn't in DC. The info from the John Droz team was a different matter.

Judge: At any time, did you record any of your time on this as counsel to Trump or his campaign?
JE: Nothing I remember.
RM: Same with 1/6/21? JE: No records.
1/6 was "Save America Rally" right? What were the steps?
JE: Meeting with Rudy & Boris, discussing order of the day...

RM: On 1/6 had you communicated with Trump?
JE: I don't recall for 1/5 or 1/6. Molly Michael (Trump's asst) didn't see any phone records... but there was some reporting he might have been on a call afternoon of 1/5 or AM of 1/6.

2 tasks: 1) Assuming Electoral Count Act was in effect, how would that work (Congress objections, 1 House 1 Senate). 2) Role of VP, since candidate on ballot should he recuse so Grassley should? Saw news about members of Congress objecting. Talking about public discussion...

Judge: If they were public, they weren't covered by privilege, right?
JE: Being careful not to disclose things with members of the Trump team.
RM: On 1/6, Rudy got a call to "fill a gap" & speak?
JE: Rudy said come over & speak about info from night before.

Judge: Was Ken Chesebro present with the talk with Giuliani and maybe Boris?
JE: No, I still haven't met Chesebro. 1 or 2 investigators & assistant Maria Ryan.
RM: Had you prepared notes to speak?
JE: No. We went in a car because it was cold... down 17th St to security entrance.

JE: Trump was delayed so they asked if Rudy and Eastman would speak. They did and then there were reserved speech in the front row where we waited a long time for Trump. We didn't stay for all of it, we went back to the Willard to start monitoring events on the Joint Session.

Miller brings up the NDC, page 10, paragraph 22. Do you agree?
JE: Wasn't 10s of thousands... so many more! (Trump will be proud). I think between 250-500K (quite a variation) & did research on it later. (Why?)

RM: Who asked you to talk about GA runoff? Scribbled notes about what you'd say?
JE: I think Rudy. Fraud, illegality, Oltmann predictions. No notes at all.
Miller is going line...by...line.
JE: True I said the "fraud" line, but wasn't for doubt.

JE: #DeadPeopleVoting: "People didn't rise from the dead to vote." Experts like Michigan Auditor General confirmed it (it's it in the NDC). Talks about MI then Kanzol report in Nevada with 1,505 cast ballots, GA...
Eastman is saying "dead people voting" was true (to counter NDC).

Duncan Carling from the CA Bar is just letting this go... the Gilles Georgia deceased voter information has been discussed over & over. Garland Favorito got into this too. JE: NEVER said it was outcome determinative. Gets testy on this CA Bar allegation. news.bloomberglaw.com/litigation/cou…

JE: Even if it was only four people, my statement about deceased voters was accurate. My statement was the truth. And no verification from MI whether the 1600 voted before they passed, want to see details. Didn't look subsequently. Don't know about 10 deceased voters in NV.

Duncan Carling objects: Asked & answered. Judge Roland sustains.
Eastman called them "secret folders", Dominion says "suspense folders" & others "adjudication folders" Eastman says he thinks those are the same things. Eastman helps the judge by saying that VOILA is French.

JE: (a bit heated) I did not know these statements were not true, still don't know, and spent time with experts (Oltmann & Ramsland) whose prediction about GA runoff came true! So I didn't know the statement was false, wasn't grossly negligent.

RM: Was your intent to incite attendees at the 1/6 Rally to take action?
JE: Absolutely not. I had no such intent, it was always to identify problems with the election & if problems affected the results on behalf of Trump.

JE: I found the claim that the election was secure was laughable. In Antrim it was quite clear votes were changed (although reasons varied).
Looking at Jeff O'Donnell's work in Mesa County CO, code can change results. Garland Favorito said it happened in GA. Why I don't know.

Interesting for #FaniWillis -- John Eastman is talking about Coffee County GA & what seems to be his knowledge.
Judge: Who conducted that audit?
JE: Don't recall but Garland Favorito testified...
