[SUPREME COURT TO DELIVER FINAL ORDERS IN CBSE EXAM PLEA]

2 judge bench of the #SupremeCourt to shortly dictate final orders in the plea seeking cancellation of #CBSEBoardExams

Govt had informed SC that Class X and XII exams stands cancelled due to #COVID19 @cbseindia29

Solicitor General Tushar Mehta appearing for @HRDMinistry and @cbseindia29 submitted that class X will have no exams whereas for Class XII there will be an option of a board exam at a later date. However for both X & XII, the marks obtained in past 3 exams will be assessed

The three judge bench had allowed the SG to file a notification putting the exam scheme into effect by today and also file a fresh affidavit detailing how will the assessment marks will be calculated & what impact could it have on competitive exams

Adv Rishi Malhotra: There should be clause stating that the students can opt for an alternate exam within 15 days of publication of results based on the previous assessment. Otherwise students can come after two months and seek an exam.

SG: This will be binding students

SG: If the situation becomes conducive in September, then the student can decide in October too. We are pro student.

J Khanwilkar: CBSE can altogether decide to scrap exams at a later date

SG: Yes, they may say it's too late

Adv Malhotra: Let the notification be a part of the order

Senior Adv Jaideep Gupta for #ICSE: We have seen CBSEs affidavit. We largely agree but our averaging formula will not be the same like CBSE. However, there are litigations against us.

Senior Adv Gupta: We may also give the optional board exam facility to Class X too along with Class XII at a later date. This is our difference with CBSE affidavit

Adv Shoumendu Mukherjee for ICSE board: One diff is with averaging of marks and one is that we may hold for Class X too at a later date along with Class XII. We will declare results by July 15.

Adv Mukherjee: With regard to Bombay HC proceeding...

SC: do not worry about other cases. It will be taken care if in our order and all those matters will stand disposed off. The subject matter will be taken care of since you accepted CBSEs proposal.

Order: J. Khanwilkar: We accept the notification issued by CBSE. Any other petition considering the subject of conducting exams for Class X and XII by CBSE scheduled for July 1 to July 15, 2020, stands disposed off by this order. ICSE in principle will issue similar notification

Orders:

ICSE may conduct optional exams for both Class X and XII. It is submitted that the assessment scheme would be slightly different than CBSE and will be notified in the website within one week.

Orders:

SC: This order does not deal with anything else other than the CBSE and ICSE exams and will not impact other litigations.
