A CJI SA Bobde led bench to shortly consider admission of a bunch of writ petitions challenging the three farm laws passed by the Parliament. Pleas state that laws would dismantle the APMC system intended to ensure fair prices for farm products
Petitions challenge Farmers Produce Trade and Commerce (Agricultural and Promotion) Act, 2020, Farmers (Empowerment and Protection) Agreememt on Price Assurance and Farm Services Act and the Essential Commodities (Amendment) Act 2020 @INCIndia
Bench of CJI SA Bobde with Justices AS Bopanna and V Ramasubramanian will begin hearing the batch of petitions shortly.
AG KK Venugopal, SG Tushar Mehta and ASG KM Nataraj appear on behalf of the Centre.
CJI Bobde remarks: AG, SG, ASG all appear in a natter where there is no cause of action... This in common parlance is called an "overkill"
CJI Bobde observes: This Court has held earlier that merely the passing of the legislation does not give rise to a cause of action.
We don't want to dismiss this. You withdraw thie and come back with a better cause of action.
Advocate K Parameshwara representing another petitioner tells the Court that there are other petitions also.
CJI: okay we have heard Manohar Lal Sharma's case. We will hear others.
Parameshwara tells the Court that the ordinance was challenged before the Chhatisgarh High Court but now the matter has been rendered infructuous before the HC.
SC suggests Parameshwara to approach the High Court first.
Parameshwara: Different matters will get filed before different High Courts then.
SC: This is why Court always asks for cause of action. What is your cause of action? What is your prayer.
Parameshwara highlights that the farm laws are sought to be quashed.
Parameshwara argued that the laws passed by the Parliament will have an overriding effect on the State laws which would give rise to a cause of action.
CJI Bobde says: Attorney, you will have to answer these questions before sone Court, either here or a High Court
AG KK Venugopal: We will file a reply here, My Lord.
