🎉 VICTORY! A Brooklyn court ruled in our case with @MaketheRoadNY and @WIRACYls on DACA that Chad Wolf was not lawfully serving, and his memo was not lawfully issued. We are still reading the opinion and will provide more details soon.
@MaketheRoadNY@WiracYls We knew the memo issued by Chad Wolf was another cruel and divisive move that sought to upend the lives of over a million immigrant youth while Trump schemes to dismantle #DACA. This decision confirms that the Wolf Memorandum was not lawfully issued in the first place. 2/
@MaketheRoadNY@WiracYls The judge also granted a class certification in our case. What this means is that our suit with @MaketheRoadNY and @WIRACYls now represents #DACA recipients across the country who are eligible for DACA under the 2012 DACA memorandum — approximately one million immigrant youth. 3/
@MaketheRoadNY@WiracYls This decision would not have been possible without our courageous plaintiffs who told their stories to speak truth to power. We know their #HomeIsHere, and will continue fighting for them. 4/
@MaketheRoadNY@WiracYls Our next step is to schedule a conference with the Court regarding the next steps and the relief that will come from today’s decision. We will be sharing more information regarding what this decision means for #DACA in the coming days. #HomeIsHere 5/
@MaketheRoadNY@WiracYls Just over one year ago today, thousands of immigrant youth, supporters, and activists marched to #SCOTUS to loudly, proudly say that our #HomeIsHere. Today’s decision is yet another victory for immigrant youth!
BREAKING: We just filed our lawsuit against the Trump admin on #DACA with @MakeTheRoadNY, @WIRACYls, our brave plaintiffs, and four new immigrant youth plaintiffs. The complaint challenges the legality of the Chad Wolf memo from July 28th. THREAD 👇 1/ cbsnews.com/news/young-imm…
@MaketheRoadNY@WiracYls .@DHSgov’s memo drastically altered #DACA by rejecting all first-time applications, limiting the availability of advanced parole, and shortening the length of DACA renewal grants from two years to one year (essentially DOUBLING the cost of renewals). 2/
@MaketheRoadNY@WiracYls@DHSgov Our complaint argues that the Trump admin’s latest attempt to dismantle #DACA side-stepped proper procedures, stripping DACA applicants & eligible immigrant youth of due process. It also argues that @DHS_Wolf is serving unlawfully and does not have authority to alter DACA. 3/
THREAD: For our new report, we interviewed several immigrant service providers and identified a common pattern: the new DHS public charge regulation generated confusion and concern in immigrant communities across the country even before it was implemented. ow.ly/hSbI50yy23t
Researchers @manatt estimate that as many as 26 million people could be chilled from accessing health, nutrition, and housing programs because of fear and misinformation about the rule. ow.ly/ImIn30qllr8
Our report helps uncover how that fear has manifested on the ground, including among groups not technically targeted by the rule: lawful permanent residents, U.S. citizens, and exempted humanitarian groups like crime and trafficking survivors.
We are deeply disturbed by weekend reports of 60+ Iranian-Americans, including US citizens, being detained for hours at a time at US port of entry by CBP. Negah Hekmati, a US citizen traveling with her husband & two young children, were held & questioned for 5 hours. 1/
If this type of profiling sounds familiar, it’s because the aftermath of profiling & targeting Muslim and Middle Eastern communities that ramped up in 2001 are still being felt today. @DHSgov can’t infringe on people’s basic rights or profile people based on their nationality. 2/
We must keep fighting the racism and cruelty of the Trump administration and hold CBP accountable. Local law enforcement & leaders must counter these divisive tactics by rejecting racial profiling and surveillance. 3/
BREAKING: Today the Supreme Court failed to uphold one of our founding principles — no indefinite detention. #SCOTUS held that immigrants can be detained indefinitely for a crime they might have been released from years ago, w/o an opportunity for bail. 1/ usatoday.com/story/news/pol…
This means immigrants who paid their debt to society years ago are forever subject to being torn apart from their families and placed in detention without a chance to make their case to be released on bail. 2/
As Justice Breyer referenced in his dissent, this means the threat of indefinite detention can apply to immigrants who may have just been fined or subject to probation, like for using an invalid bus transfer, or illegally downloading music. 3/
BREAKING: The U.S. Court of Appeals for the 9th Circuit today upheld a lower court’s ruling to block @realDonaldTrump’s termination of DACA, allowing ~800,000 DACA recipients nationwide to submit renewal applications. 1/ #DefendDACA ✊
@realDonaldTrump@UNITEDWEDREAM@FWDus Trump’s attack on #DACA more than a year ago upended the lives of hundreds of thousands of immigrant youth and their families. His administration has since gone to extreme lengths to end the program without regard for how it has impacted people’s lives. nytimes.com/2018/11/08/opi… 3/
