BREAKING: The Supreme Court has overturned a lower court ruling on Trump’s census memo, leaving open the possibility for Trump to try to exclude some unauthorized immigrants from a key count that shapes the next Electoral College map

2. Here's my write-up with @NinaTotenberg on what the Supreme Court's ruling in the census case means:

@NinaTotenberg 3. FWIW, @LeahLitman predicted that the Supreme Court would punt on the census apportionment case after a lower court did the same thing in the D.C.-based lawsuit over Trump's memo because it found the case "not ripe for review"

@NinaTotenberg @LeahLitman 4. As far as I've been able to confirm so far, the timing of the #2020Census results' release is not in the Trump administration's favor, meaning Trump is not likely to get control of the numbers he wants to try to alter before his term ends on Jan. 20
npr.org/2020/12/05/943…
@NinaTotenberg @LeahLitman 5. But it's not over until it's over. Keep in mind leaked internal documents from the Census Bureau show the release dates for 2020 census results are moving targets & as of late November, appear to be edging closer to Trump's last day in office on 1/20

@NinaTotenberg @LeahLitman 6. I've reached out to the @uscensusbureau's public information office for comment.

As of Dec. 15, it said in a press release:

@NinaTotenberg @LeahLitman @uscensusbureau 7. NEW: In a statement, Justice Department spokesperson Mollie Timmons says the Trump administration is "pleased" that today's Supreme Court ruling "clears the way for the Commerce Department to continue its work on the census and send its full tabulation to the President" “We are pleased that today’s ruling clears the way for t
@NinaTotenberg @LeahLitman @uscensusbureau 8. I'm still waiting for answers to these questions related to today's Supreme Court ruling in the census case because the @uscensusbureau's public information office just redirected me to @TheJusticeDept for comment: 1.	Any response in reaction to the Supreme Court’s ruling

NEW: The Census Bureau — using government records and not the #2020Census results — estimates that the U.S. population as of April 1 was somewhere within the range of 330.7 million to 335.5 million people Low: 330,730,000; Middle: 332,601,000; High: 335,514,000
2. The U.S. population may have grown by as much as 8.7% since 2010, according to the Census Bureau's Demographic Analysis estimates based on gov't records.

My write-up on what these estimates mean for the #2020Census results, which are *not* out yet:

3. People who died from COVID-19 before Census Day (April 1) were taken into account when the bureau worked on these estimates, said Eric Jensen, the bureau's senior technical expert for Demographic Analysis.

2. Trump admin signals it may make an emergency request to the Supreme Court to block the lower court's order for the #2020Census document release. Admin says it does not have enough time to fully review and redact the documents the lower court has ordered for release by Dec. 14. Given the exigencies of the...
3. It's worth noting that in that lower court ruling, U.S. District Judge Lucy Koh noted that the Trump administration has had months to gather many of these documents and that "time is of the essence" now bc evidence gathering for this case ends on Jan. 7

NEW: There are a number of open questions about #2020Census data quality raised in the @USGAO's latest report on the potential impact of COVID-19, plus the Trump administration's last-minute schedule changes that cut short counting and processing time

@USGAO 2. COVID-19 forced delay of the count of people experiencing homelessness, which could result in misrepresenting where these populations were living on Census Day (4/1). @USGAO says bureau has not explained how it plans to document how that could impact data products' accuracy. The Bureau told us that the...
@USGAO 3. The #2020Census door-knocking in August into early September was conducted under Trump administration pressure to finish counting early using pay bonuses to field workers and other procedures that were not tested beforehand, so how they could affect data quality is unknown. By early September, the tim...

Don't forget: after this election comes redistricting — and we may soon see a radically different way of redrawing state legislative districts in Missouri that doesn't take into account children, noncitizens and other residents who are not eligible to vote
npr.org/2020/11/06/931…
2. Presidential elections come around every four years, but the consequences of redistricting are locked in for a decade.

We are talking about lines and maps that determine how much political representation each person living in the U.S. gets for the next 10 years.
3. In general, political mapmakers around the country have long drawn state legislative districts based on the total number of people living in an area as determined by the census.

It's an open question whether it's legal to redraw districts based on only eligible voters.

Last night, Missouri voters passed a state constitutional amendment that could lead to the redrawing of legislative districts based on the number of U.S. citizens old enough to vote rather than of all residents. From Amendment 3:

2. It's not clear exactly how "one person, one vote" will be interpreted when Missouri's voting maps are redrawn.

In general, states draw voting districts based on the total population, i.e., census numbers of every person living in an area, regardless of citizenship status.
3. Drawing voting districts based on the number of U.S. citizens old enough to vote "would be advantageous to Republicans and Non-Hispanic Whites," wrote GOP strategist Thomas Hofeller, who advocated for adding a citizenship question to census forms:
documentcloud.org/documents/6077… A switch to the use of citizen voting age population as the
