29. Retroactive Agreement with the City of Fresno to participate on the Public Safety Realignment Adult Compliance Team: The ACT is currently comprised of sworn officers from the Fresno County Sheriff’s Department; the Fresno Police Department, which also includes a Crime Analyst
the Clovis Police Department, which includes a Crime Specialist; the Selma Police Department; the Reedley Police Department; the Kerman Police Department; the Kingsburg Police Department; the Fresno County Probation Department; & two Investigators from the Fresno County District
Attorney’s Office. The purpose of the ACT is to add an additional layer of offender supervision and public safety, by working as a cooperative unit capable of addressing the public safety concerns and issues facing local law enforcement in Fresno County. The ACT team enforces
conditions of probation, conducts compliance and non-compliance searches of Assembly Bill 109 probationers who are under the supervision of the Fresno County Probation Department, and provides immediate response to crisis situations. In addition, ACT can provide surveillance and
in conjunction with other law enforcement agencies.

Supervisor Magsig pulls Consent Item 17 :Adopt Resolution honoring Chief Mark Johnson who retired from Cal Fire Fresno/Kings Unit and Fresno County Fire Protection. Led effort against largest state fire ever the Creek Fire. Wanted recognition before Johnson left. Chief Johnson
introduces various family and Cal Fire staff. Thanks Sheriff Office for evacuating homeowners. @BuddySupervisor : known each other for 20 years& was a great firefighter and leader. @LincolnSeward Magsig: Cal Fire contract was created to help more "white areas" that only had vo-
lunteer fire service or none. I think having Cal-Fire contract saved Fresno County lots of money during Creek Fire. 72-96 hour straight for crews during Creek Fire as there was no other choice. Back fires saved Shaver according to Magsig. Magsig saw Chief Johnson grab a shovel
to move fore away from a home. Many chiefs watch from a command center but not Johnson.
Brandau: I was with Magsig and witnessed Johnson grab that shovel but not before telling Brandau "to stay next to truck and not help". Probably good advice. Pacheco:job well done!

3.Presentation of Retirement Plaque to Billy Ward - Probation Department - 32 Years of Service Probation Chief Haynes: Bill was a dietary aid and began with old Valley Medical Center until that closed. Moved to Juvenile Hall and Elk Horn until they both closed"Bill has closed
lots of buildings" jokes Haynes. Bill had a genuine concern for youth. Martinez: He always had a Word of the Day for the youth and preached education. Youth always asked for the word. Don't let this time define who you are.
Ward: always to do your best. Walk the walk. No future without an education. Don’t look for a reason to fail. Don’t go around complaining. Always want supervisor to say Mr. Ward “ is the best worker”. Any negative people comes around this invisible force field kicks in and I
would ask “ what is the nature of your inquiry”. Count to ten when someone is trying to provoke me just so I wouldn’t say something I regretted. Always be learning and then pass that knowledge on. Life is no mistake. You can either make your dreams come true or not. Set small
goals and meet them. Thank you after 35 years. Now fishing is on my mind and a type of relaxation therapy. Brandau: great words. “What is the nature of your inquiry.Don’t give yourself a reason to fail. “. Mendes: he has future coming back to us and inspiring us! Magisg: I hope
you will continue to inspire youth who often don't get to hear those type of words. Ward: small things like taking elderly trash out to curb goes a long way. Quintero: thank you for the powerful words. We can use your attitude in our nation.

4. Receive verbal update regarding homelessness efforts in the County of Fresno
Working with Public Health Dept. . 358 beds occupied out of 412 beds.
Hotels were purchased as triage beds. Some of those beds will come off line as switch to permanent housing. Mobile clinics will go not to just to these hotels but where homeless gather. We are gearing up for giving Covid vaccines when possible to homelesss.Next: This is
expansion of what the State and Federal governments were doing. Distribution of resources was sent to Supervisors last week. Supervisors will need to decide what to do when cliff arrives 2024. Homeless rate went down 45% over past 10 years but we risk losing that momentum due to
pandemic. All seems to be going well with our providers. We haven't seen any "gaming of the system" . Long term commitments by State/Federal is important. Magisg: Received calls from homeless advocates. Do we have non-committed dollars available? A: No. Much was for homekey which
helped purchase and run the hotels. Q:how much of the money is discretionary? A:Certain requirements associated with the funding.Emergency money helped start triage beds. Laura Moreno: rapid housing or emergency is provided in some funding. Little discretion other wise Specific
strategies have to use. Q:3500 homeless. Has that number gone up with Moment of Time count? A: only shelter count was done this year. I imagine an uptick due to Covid though. Unduplicated number of homeless. Quintero: Thanks Delfino and Moreno for last week's update. Q: when
money is given for beds but do we get money back for beds not used? Or does agency keep that difference? Delfino: Contracts are reimburse. If we think we will be higher than maximum then we need to come back to Supervisors to ask for more funding. All invoices are reimbursed.
Brandau:How many of hotel beds will be permanent? Sonia:Some of the bedding was in large shelters. Home key provided 165 at old Smugglers Inn. Five hotels will remain and become permanent housing. Numbers of homeless did come off the street to occupy the housing. Some decline
the offer but we continue to engage with them and some will eventually take a permanent housing spot. Some moved in with friends, rehab or asked to leave permanent due to rule breakages. Largest problem is sustainability longterm but these are one time funds that expires in 3
years. CAO Rousseau: They did great work early on. "Heroic work in working with City of Fresno as well as rural cities". Lots of funding coming down from Feds and State and we need to work with City of Fresno to use it wisely. Public: Cindy Pampino (sp): is it possible to get a
mental health bus ? Seems best to reach out to them. Sanitation like port a potties and dumpsters need to be available as well as heating/cooling centers. People need to be out seeing what is going on in field. Tiny Homes has worked in other towns. Who monitors the field workers
who ask personal questions and then don't follow up. Next: I get $1200 a month and it isn't enough. Hacienda occupants just drink and let their dogs run wild. I can't sleep there like that. These four need to be investigated? ( I am unsure if she is referring to the county staff
who presented today?) Next:@LovesMercy Brandi: concerned as number of beds as they quickly fill when made available. those on freeways are demonized, those not counted who live in their cars;Number of rooms are two person designed but only one occupant. Many are pushed around by
Homeless Taskforce. Thank you for old Smugglers Inn being close to services. Be sure to invest around that neighborhood to keep everyone happy.
5.Appeal Planning Commission denial of Variance Application No. 4059,
(Applicant: Laurencio Villa; Appellant for Applicant: Dirk Poeschel Land
Development Services, Inc.)
Consider appeal of the Planning Commission’s denial of Variance Application No. 4059 proposing to
allow the
allow the creation of three substandard-sized parcels with reduced lot width, lot depth and
setbacks in the AL-20 (Limited Agricultural, 20-acre minimum parcel size) Zone District.
The project site is located on the north side of E. Belmont Avenue, on the northeast corner of its
intersection with N. Fine Avenue, approximately 690 feet east of the nearest city limits of the City of
Fresno. Three Supervisors mention their discussion with Dirk Poeschel. Bulk of Planning Commissioners were not present when this was presented. Letters in support and two
letters against (Animal smell). Magsig:AL-20 seems out of place with single family homes around it. Staff: AL-20 made it easier to annex. Still not annexed though.Smaller parcels are harder to annex due to "voting cap" . Magsig:General Plan Amendment may be cleaner option then?
Staff: two step process and cost aspects may make it harder. Dirk Poeschel represents developer: City General Plan indicates it should be like this developer proposes but City is not interested in annexation. 25 lots of AL-20 which is holding that leads to urban. This is
consistent with surrounding area. Spoke to Councilmember @D7Esparza who was supportive. He doesn't want the parcel to be commercial though. Poeschel agrees with that.Magsig: You believe Findings 1 and 4 can be made?Poeschel: Exceptional circumstances as there are two parcels
even smaller. Finding 4 is similar to City of Fresno's General Plan. Counsel Cedarborg: we can't use City's General Plan even though it is in City's Sphere of Influence. Poeschel" it is in policy that is possible. " Staff: some level of flexibility. Mendes:Planning Commission met
partially in person and some remotely. I think that is possible problem.Poeschel: one commissioner there in person said all 10 letters were from one person which misled those Commissioners remotely participating. Pacheco: fIf our General Plan was updated this would have been more
simple. Approve Appeal 5-0 6.*Amendment to Text Application No. 379 Urban Fence Standards
On August 4, 2020, the Board of Supervisors considered an item brought forward by County Staff
to address fence violations in the urban residential zone districts; and subsequently adopted
a
minute order directing County Staff to initiate an amendment to the Fresno County Zoning
Ordinance relating to urban residential fence standards. Draft language, based on language in
the “R-R” Zone District standards, was provided in advance for comment to all cities within the
County, relevant County Staff, as well as the Fig Garden Homeowners Association and Property Owners Association. The resulting text is shown in Exhibit 1.
ANALYSIS/DISCUSSION:
The scope of the proposed amendment is limited to Urban Residential Fence Standards. The
intent is try
and provide a means whereby fences in urban zone districts that normally limit the
height of a fence to three(3) feet can be up to seven feet in height if designed and constructed
to still provide light, ventilation and views and not create an aesthetic or safety concern. It
t also
allows side and rear yard fences to be constructed up to seven feet in height with no special
provisions.
There are a number of ways fences may be designed to provide light, ventilation, and views.
The proposed provisions seek to avoid complex or subjective standards.

(Vacation Application No. V17-07) (Applicant - Susan and Richard Hemb) Conduct public hearing and adopt Resolution making required findings necessary to approve the
he
vacation of certain road right-of-way of East Belmont Avenue, that portion of East Belmont Avenue
public road right-of-way (ROW) lying between Lots 14 and 17 of the Map of Kings River Thermal Approved with No discussion.
Supervisor Discussion: @LincolnSeward Rodeo wants to have a safe version end of April. Clovis Mayor and some councilmembers are in agreement if it can be done safely. pacheco and Mendes agree too. Mendes says smaller rodeos look to Clovis for direction. Brandau: People are wel-
come to not attend. Quintero: I agree provided the animals don't have to wear mask too. Magsig: New library in clovis proceeding. We also need to have a strategy to get mobile clinics out to rural areas in order to vaccinate. Pacheco: ACLU contacted him regarding mobile home park
rents as the landowner has the occupants once they plot their home down as it is isn't easy to move if rent rises. Much to Pacheco's surprise cities of Fresno and Clovis have a rent control on these types. So now we need to do the same in rural areas. Pacheco typically doesn't
like rent control but needs it in this case. Pacheco: wants Supervisors consent to bring this forward at a later date. Some discussion as to whether needs Supervisors consent as not to waste Cedarborg's time.
Pacheco: this private property looks like a third world country. This is not county road but was vacated back to private owner with stipulation that he keeps it up. As photos taken a truck showed up to dump more and quickly drove off saying he was lost. We need to force owner to
Clean it up this property near Easton. Also: Fresno and Clovis have yearly Operation Cleanup. We need to do same for rural residents where one day a year they can bring anything to American Landfill. Also Pacheco: we need to direct Public Health to open up our schools.Also he
says if Super Bowl can have spectators so can Rodeo. (Smattering of applause). He also thinks mass vaccination rumored to be in Save Mart Center which is great for Fresno but need to be in Dunlap area and Westside of Fresno County too @BuddySupervisor Vaccination effort is a
Circus. We have pleaded for more vaccinations but only have 1/4 that we need. State suffers from “terminal rectal cranial inversion” Brandeau: you can add city of Fresno to that too. Mendes: Problem with vaccines is supply and not logistical. Brandau: I will go to rodeo no matter
what. If it doesn’t happen I will be there with rest of Clovis. I will also push for Fresno County to open up for businesses and schools. (Supervisors) Need to take over county schools again. I am for Save Mart Distribution if that means more vaccines. If not Governor “can go
pound sand. I have no confident with Sacramento on vaccines.” Also Brandau says County’s Jordan Scott last day today. He is the Public Information Officer. (Very nice person. I enjoyed talking to him over the years). @BuddySupervisor he often asks people “what is one thing State
of California does right?” No one can tell me. Next unscheduled public comment: Ralph says Mark Johnson should be named new Registrar of Voters with Brandi Orth resignation. Strong distrust of voting in this nation. Johnson’s legal background would help with lawsuit against
County. An audit of voter tolls needed. Cindy Brooks: as a poll watcher the past 8 years but as this election I was told by Orth to be in backroom where we couldn’t see. We are told we have 3 seconds for signature verification but it was faster. Supervisors should not take Orth’s
recommendation to replace her. Johnson is a better choice.Maricopa County is doing an audit of their voter rolls. Need to look at poor Dominion voting machines too. She is also a restaurant owner. Fresno County needs to open up again much like Clovis voted 5-1 to open. Next Eric
Rollins: Free and Fair elections is the cornerstone. We need to clean our voter rolls as dead people still receive ballots. Need strong signature verification. Need to review county employees too ( I assume in registrars office?)Mark Johnson for registrars. Mark Alredge: Need to
voter standards higher than before.Next: Rodenberry says Spotted Owl killed off all but two mountain timber mills. This led to overgrown forests and more fires. Some work done but too little too late. Next: I am from Mexico. I can't believe USA requires someone to pay
taxes even after you die and no Voter ID required. Next:Sherry Rich: Need audit of voter rolls. Brandau:Stalin said "it is not who votes but who counts the votes" @BuddySupervisor That was Trotsky who said that. Brandau:I don't think Fresno County's voting system is bad but there
are things we can clean up. Nationwide however we are screwed.

Supervisors are moving to 10 AM start time rather than the previous 9 AM. Pre-Covid the parking was tough to find even at 9 AM . I imagine 10 AM will be even harder for the public to engage (if) and when we can meet in person again.
