LIVE: Derek Chauvin Trial Day 24

twitter.com/i/broadcasts/1…
Court has begun but the jury isn't in yet - Cahill is discussing "the admissibility of body worn camera" (BWC) video.

The state objects to showing the jury part of the video, says it shows an officer running George Floyd's info in the squad car and the BWC video captured it
The video also contains a bunch of hearsay statements without capturing the main incident in question, MN Asst AG Frank tells the court. Asks for this info to be redacted and for "hearsay" portions to be excluded.
Judge Cahill asks how this would be any different from bystander video that includes hearsay - Frank says those bystanders were "part of the incident itself...they cannot really be separated from the issues involved in the restraint and the reasonableness of it..."
Nelson says he wants to break Officer Chang's body camera into three sections
Nelson says the second part of the body camera video is relevant because it shows "the reactions of other officers" and the "crowd growing more and more vociferous as time progresses"
Nelson says the video shows the crowd interacting with the police and proves that the crowd could be a "distraction" and "perceived as a risk or a threat" by officers. Calls the video "highly relevant" and "not hearsay"
Judge Cahill: "I viewed the entire thumb drive that contains the exhibit... I would note that the body cam includes from a distance what is going on in front of Cup Foods, as well as the timing of...the EMS response...when the firefighter showed up..this puts that in a timeframe"
Judge Cahill orders that the portion of the video shows that info that comes up when the officer goes in the car and runs Floyd's name has to be redacted when evidence goes back with the jury but for now it can just be fast forwarded through
Nelson says he'll just cut that portion out, asks for ten minutes to do the redactions. Cahill says sure and calls for a break until 9:30 when the jury should be back in court for the day
Court is back - state has no more witnesses, the prosecution just rested its case.

Nelson calling the first defense witness now
Judge Cahill complains about having computer problems
First defense witness is Scott Creighton - a retired Minneapolis cop

Judge Cahill tells the jury about "evidence being showed for limited purpose to show the effect ingestion of opiates may or may not have had on Mr. Floyd...this is not to be uses as evidence of character..."
Creighton started with MPD in 1993 as a 911 responder, did that for 6 years and transferred to public housing for 9 months, then went to the 4th precinct and became a community response team member working narcotics, did that for 22 years. Was on duty on May 6, 2019
On May 6, 2019, Creighton was involved in a traffic stop that involved George Floyd in the passenger seat of a vehicle. Describes the interaction as giving commands and "the passenger was unresponsive and noncompliant, i had to physically reach in...bc i couldn't see his hands.."
Creighton says "in my mind his behavior was very nervous, anxious...he turned away from me towards the driver's side..."
Nelson asks Creighton about his body worn camera from that day and moves to publish it
The video shows Creighton yelling at the passenger side - "keep your hands where i can fuckin see em" - the passenger, presumably George Floyd, says he's afraid of being shot
Another officer threatens to tazer George Floyd while Creighton forcefully pulls Floyd out of the vehicle while Floyd says he is sorry. Creighton seems to threaten Floyd in the video saying "you're not gonna get beat up or nothing if you do what we say"...
Floyd seemed to be panicking in this moment similarly to how he did on May 25. One officer was yelling at him to "spit out what you got" while Floyd says "I'm sorry" and another officer yells loudly at him to "RELAX"
After having Creighton confirm the passenger was George Floyd, Nelson says he has no further Qs for Creighton.

State doing cross exam now - Erin Eldridge asking Qs. Asking Creighton about how he approached w gun drawn and Floyd said "don't shoot me man...I don't wanna get shot"
Eldridge asking Creighton about how Floyd followed commands to undo his seat belt, put his hands up, on the dash, on his head. One officer threatened to tazer Floyd as he appeared to be following commands
Creighton says "he was incoherent in my mind a lot of the time" but agrees with Eldridge that Floyd got out of the car when he told him to, was able to walk and talk.
Eldridge asks Creighton about handcuffing Floyd outside the car and how he didn't fall down. Eldridge is done with cross, Nelson on re-direct asks about other officers giving commands to the driver while Creighton was talking to Floyd.
Nelson implies that the "spit it out" comment by the other officer was directed at the vehicle's driver. Nelson done w re-direct after that.
Retired MPD officer Creighton's testimony has concluded
Next defense witness is on the stand getting sworn in - Michelle Moseng, a retired Hennepin County EMS paramedic of 34 years.
Nelson asks Moseng about May 6, 2019 - Moseng was summonsed to MPD Precinct 4 to "care for" George Floyd after his arrest that day. Says she learned about his consumption of opiates that day. "it was quite hard to assess him, he was upset and confused".
Objection from the state, Judge Cahill strikes that answer
Moseng says she doesn't remember exactly what Floyd said he was taken "but it wasn't really consistent with his behavior which was elevated and agitated"

state objects, Judge Cahill strikes the "agitated" comment
Moseng took Floyd's vitals, Nelson asks about his blood pressure. Nelson shows her the "run sheet" showing the medical data noted from her check up on Floyd on May 6, 2019.
Moseng says she recommended George Floyd get brought to the hospital, which he "eventually" was. Nelson done on direct now, he is going through witnesses fast so far today.

Eldridge crossing Moseng for the state now, asks about blood pressure.
Eldridge asks if Floyd told Moseng he had a history of high blood pressure, Moseng says yes. Floyd also told her that he had swallowed some pills, Moseng's run-sheet shows that she noted he said he took 7-9 Percocets throughout that day. "I asked him why, he said he was addicted"
Eldridge: "he didn't want to go the hospital right...it took some time to convince him"

Moseng: yes

Eldridge: he didnt feel he wanted to go the hospital?

Moseng: he didn't want to go with us
Eldridge: you documented that he was alert and obeyed commands?

Moseng: eventually

Eldridge: that's what's in your report correct? He had a healthy response to stimulation?
Eldridge going over Moseng's EMS "run sheet" showing that she recorded Floyd as having normal, stable vitals on May 6, 2019.
Nelson declines to redirect - retired Hennepin County EMS paramedic Michelle Moseng is now done testifying.
Judge Cahill tells jurors "we're gonna take a lawyerly five minute break which means it will probably be ten"
Court is back but the jury isn't present - seems like a motions issue or something with evidence gonna be discussed
A potential witness, a Black woman who we don't think has been named in court today yet, being asked by Judge Cahill about her willingness to testify about what she witnessed in and around Cup Foods on the day George Floyd was killed. She says she is willing to testify
Judge Cahill brings the jury back in
jury is back in, the witness is being sworn in now. Her name is Showanda Renee Hill
Nelson asks Hill about May 25, 2020, when she was at Cup Foods and ran into George Floyd who she knew. Nelson asks her about Floyd's "behavior, demeanor, things of that nature... while inside Cup Foods"

Hill: "happy, normal, talking, alert."
Hill says Floyd offered to give him a ride home and they got in the car but then she got a phone call from her daughter and he fell asleep in the car sometime during the call.
Hill says George Floyd was still asleep when the Cup Foods employees came up to the car and the employees, Hill and another friend tried to wake Floyd - says he would wake up and then go back to sleep.

Nelson has Hill say that Floyd's state seemed to have changed over time
Nelson's direct examination is done, Asst MN AG Frank asking some questions on cross now. Asks Hill about Floyd seeming "alert, friendly, talkative" in the store. Hill audibly tears up as she describes Floyd as seeming "happy...loving" when she saw him in Cup Foods
Frank asks Hill if she was eventually able to wake Floyd and she says yes.
Floyd nodded in and out but Hill says she woke up him again when the officers approached the car
Hill describes seeing an officer tap on the window with a flashlight, "when he seen the man, the man had the gun when he looked at him, so he instantly grabbed the wheel and was like, please don't kill me, please don't shoot me..."
Hill says she was in the back right passenger seat of Floyd's vehicle. Officers approached the vehicle on both sides. Hill describes being in the middle stretching to shake Floyd awake as officers walked towards them
Asked if Floyd complained about shortness of breath or chest pains or seemed off at all other than being sleepy, Hill says no. Asked if Floyd was startled when the officer pulled the gun, Hill says "very." Frank is done w cross now.
Nelson on re-direct quickly asks Hill if she had to make multiple efforts to wake Floyd up, she says yes. That's it for Ms. Hill's testimony. She appeared quite sad when reliving Floyd's last moments with her and softly said "thank you" when Judge Cahill excused her.
Nelson calls the next defense witness - Minneapolis Park Police officer Peter Chang

Officer Chang responded to the scene at Cup Foods on May 25, 2020
Asked how he "became a part of this incident" Officer Chang says he was stationed at a park nearby and "heard dispatch asking for assistance...i was one of the closer squads so I self-assigned to that.."

Its common for park police to assist w calls around the city, he says
Minneapolis Police and Minneapolis Park Police have the same training academy and field training system
Officer Chang describes arriving at the scene at Cup Foods, seeing officers there, being told it was a "Code 4" and seeing George Floyd in handcuffs sitting on the ground
Asked if he knew officers Kueng or Lane prior to this incident, Officer Chang says no. Chang says he was asked "to identify Floyd in out system so i went back to my car" to run his record. Says from in his car, he then noticed officers interacting w Floyd.
Chang says once he identified Floyd, "i observed officers... assisting Mr Floyd to their squad car" and then he moved his car "nose to nose" with the MPD cruiser.
Then he "observed officers Kueng and Lane pinning Floyd against the squad car so i wanted to go assist...when he got closer Lane told him "go watch the car"... "So i did that"
Officer Chang was monitoring the passengers from Floyd's vehicle who were standing near the car still - he says he saw them reach inside the car & told them to stop.
Chang saw another squad car arrive & park and says he directed them towards the squad car in front of Cup Foods. Derek Chauvin was in this car.
Chang describes the onlooking crowd as officers manhandled Floyd "becoming more loud and aggressive" , says he "became concerned for officer safety"
Nelson is warming up towards introducing Park Police officer Chang's body worn camera from May 25, 2020 - this was the evidence at issue first thing this morning.

Chang again describes the crowd as "very aggressive towards the officers" when prompted by Nelson
Selections from Chang's body cam being shown now
Chang estimates he was assigned to the scene around. 8PM. The time stamp on his body camera is off by a significant amount.
This BWC clip is around 3 mins, Nelson said. So far it just shows kinda Chang's POV driving through Minneapolis
In the body cam video Chang pulls his vehicle up to Cup Foods, gets out, and walks towards where Floyd is sitting down on the sidewalk handcuffed and being detained. Floyd is visibly and audibly upset but is coherently spelling his name for the detaining officer.
The video shows Floyd giving his birthday and other information as he seems to be trying not to cry out of fear. Then Chang goes back into his squad car to pull Floyd's data from police systems.
The video is paused for the portion the court agreed not to show publicly. Nelson asks Chang to narrate, Chang says he saw the officers move Floyd to their squad car, then he got out of the car and "observed officers Kueng and Lane pinning Floyd against their squad car"
Nelson going back to the body camera footage from May 25, 2020, now its from after when he ran Floyd's info in his car computer.
This is about to be an over 20 minute selection of Chang's BWC footage if we heard right.
Video shows Chang putting his gloves on as he goes to Floyd's vehicle and tells the two passengers to "leave the car alone right now"
Chang asks the passengers what they took out of the car. They say they took a phone and cigarettes. Asks them who the car belongs to, he is told it belongs to a friend of "his", presumably meaning Floyd. Chang appears slightly hostile in demeanor to the passengers.
The body camera shows another MPD cruiser show up, presumably the one with the defendant Derek Chauvin in it.
To the extent this video recreates the same traumatizing scene we are all familiar with, we will spare the detailed narration. We will try to note any new information shown in this longer body camera clip.
Chang repeatedly asks the passengers for their IDs after they already told him they showed their IDs and gave their names to other officers on the scene. He doesn't exactly come across as respectful but doesn't sound extremely aggressive either.
Chang repeatedly asked the two passengers being detained outside the vehicle - Maurice Hall and Shawanda Hill - if they're "together"
Nelson pauses the video as someone passes by the video. of the body camera -likely one of of the witnesses who filmed Floyd's killing. Then resumes playing the footage
Officer Chang repeatedly refers to the MPD officers currently killing Floyd across the street as "my partners" when speaking to Hall and Hill.
Chang tells Hall and Hill "right now we're getting an ambulance for your buddy.. he might have hurt himself". Hill cries out "they hurt him???" and Chang again victim-blames Floyd - "he might have hurt himself"
The body camera video then shows the ambulance leaving, presumably with George Floyd's dead body inside. Shawanda Hill says she wants to get him his phone, Officer Chang tells her "he's gone" and can't have his phone. Hill becomes upset - "they fucked him up!!"
Chang then tells Hill and Hall "you guys are good" meaning they are free to go
A fire engine then arrives at Cup Foods after the ambulance has already left.
Despite Officer Chang's earlier testimony calling the crowd of onlookers watching Floyd die "aggressive", these onlookers didn't really appear on his body camera video at any time. It's hardly clear how he could have had eyes on bystanders for any meaningful period of time.
Nelson stopped playing the video and now asking Chang about seeing officer stationed around the area as well as various onlookers being present beyond the onlooking crowd right at the imemdiate scene. Nelson asks about cars and traffic passing through the intersection
Nelson asks if Chang's involvement ended around this time, he says yes. Nelson is done w direct questioning of this witness.
MN Asst AG Frank asking Qs on cross examination now. Asks about his convo w Officer Tou Thao and says "still red?", Frank asks what that means. Chang clarifies he was asking if the other officer's body cam was still turned on.
Frank asks Chang about how in his Park Police training he would have trained alongside cadets who went on to become Minneapolis Police officers.
Asked how often he assists with city calls outside of strictly the park system, Chang says "not often" but sometimes and he doesn't get in trouble for self-assigning to a city call, its part of his responsibilities. He also hears the same radio traffic as MPD officers.
Frank asked about Chang's decision to "use lights and sirens" because he "heard some noise in the background" but then turned lights/sirens off on the ride over to Cup Foods.
asked what "Code 4" means, Chang says "scene safe" - aka its under control
Asked if Floyd was peaceful when he was sitting on the sidewalk when he arrived, Chang says "yes".

Asked if he heard officers call a "code 3", Chang says no. Later, a Code 3 was called on the ambulance but "never for the responding officers"
Asked about saying "the crowd was getting louder and more aggressive", Frank asks Chang about assuming the officers were okay bc there was 4 of them and they never radio'd for help. Chang agrees. Frank is done with cross now. Park Police Officer Peter Chang done testifying now.
Court is back from a break - MPD Officer Nicole Mackenzie, who testified before, is now testifying again called by the defense. Nelson asking about training materials regarding the controversial theory called "excited delirium"
After going over some basics of the training around so-called excited delirium, Nelson is done w direct questioning of Officer Mackenzie.
Asst MN AG Frank is asking Qs on cross now. Asking about the side recovery process to assist breathing. bc excited delirium "could compromise proper breathing"
Mackenzie is done testifying. Judge Cahill declares a lunch break with court back at 1:15 PM central USA time.
