HC says it cant declare emergency as it is in executive domain, court is already monitoring situation, steps are being taken by State etc.
While disposing of the PILs, Court adds: Without formally declaring an emergency on medical grounds, whether or not that is constitutionally permissible, there exists an emergency like the situation with all concerned now here to fight the pandemic.
Advocate General R Shanmugasundaram makes submissions in suo motu case, informs court that an additional affidavit has been filed.
Court: You had earlier indicated that number of beds would be increased?

CJ refers to media reports that TN is among States that would be floating tenders for vaccines.

CJ: But state can't do anything about PMCARES funds
CJ suggests to State: Mr Adv ... immediately write to PMCARES for release of funds for DRDO to set up the PSA plants.. at least four or five places if you can do that, it would be much better.
Court: Anyone else? Otherwise, we will go through these reports of the States and Centre and take it up tomorrow.

CJ: What is the use of adding oxygen and vaccine on the list when we don't have supply?
CJ: These are measures for the executive to decide. The disaster management by itself gives all authority in one kind of cover... if there are other suggestions?

CJ tells Mala: We see a gap in Puducherry.. all the time you are harping that you have more than enough, but that does not seem the be the reality...

CJ: But your incremental cases exceeded 2000 yesterday!

CJ: So if incremental is 2000, what will you do with 4000 beds?

Mention made with respect to facilities for vaccination of persons with disabilities. Court says it will also be heard tomorrow.
Court tells AG: Persons with disabilities, some special care must be taken..
CJ: ... you know what happens is, it may be better to remove vaccination centres from hospitals because hospitals are infected places. People don't want to come there. It is an airborne virus. From a layman's point of view, people feel apprehensive...
CJ: ... if vaccination can be other than where hospitals are.. crowding can be reduced ... Please make special facilities for persons with disabilities including to facilitate their coming to get vaccinated
Submissions made with respect to integrated vaccine centre at Chengalpettu. The court notes that Centre has reportedly tried to float tenders but no vaccine manufacturer has come up to begin vaccine production.
CJ: Reports have come out today, that they have attempted it ...
CJ: ... we read media reports, we follow.. really, it should be done by experts and not central govt itself.. there have been certain efforts, but unfortunately... if you are aware of anyone, connect them to ASG
Adv C Kanagraj says that he will connect eligible companies.
Adv Kanagraj raises concern that there are no checkpoints in airports.
That is a matter for Centre to decide, Court says.
Another concern raised by Adv Kanagraj is with respect to doctors working without rest
CJ: ... right now the system is surviving because of the sacrifice of doctors.. some of them are not even going home to not infect their families.. some of them are working in 18 hr shifts.. we are thankful for nurses who do not sit for more than 5 minutes...
CJ: ... system is bursting at the seams ... system cannot tackle so many people.. we are seeing some tapering of.. if it tapers off, I am sure they (medical staff) will be given leave... but right now we are fighting a war, at the peak
Adv Kanagraj adds that even today he saw a line of ambulances. Refers to the need for panic control teams
CJ: There is a lot of apprehension among the people. A lot of people do not need immediate hospitalization. Yet at the first sign of COVID, they go to hospitals...
CJ: ... not everyondee needs admission, even if you do need admission, not everyone needs oxygen and ventilators...how do you control panic? You can't control panic at the gate ... you cant have someone at the gate saying number 2 go out, number 1 stay in ...
