[BREAKING] NEET-MDS Counselling will be held within 4 weeks: Central govt tells Supreme Court
Sr Adv Vikas Singh: Tamil Nadu judgment of 2020, Tamil Nadu govt challenged ti saying it should be applicable for this year. no one challenged that judgment and has become final. The application by centre is pending in SC and they should have challenged
Sr Adv Singh: a committee was formed and it stated reservations can be there in all India quota seats but state wise. But now centre faces contempt in madras hc. you can't stall the admission process for this year
Sr Adv Singh: committee said deliberations have to be state wise and it cannot be done this year and seats cannot go empty because of this. Centre says reservation issue is pending here in Saloni jumar but SC has not stayed the madras HC judgment.
Justice Chandrachud: Yes Mr Natraj
ASG KM Natraj: yes we did not challenge the Madras HC judgment. we are not against reservation too. a committee is constituted and now it has to be seen to what extend can reservation be granted.
ASG reads the Madras HC judgment.
Justice Chandrachud: issue was of OBC reservation in All India Quota seats of UG, PG courses?
Justice Chandrachud: the judgment of three judge bench states committee will complete exercise so that process can be started for 2021-22. we cannot pass an order that carry on admission without the direction being adhered to.
SC: Have you moved the IA before the 3 judge bench?
ASG: It's being moved
Justice Chandrachud: look how callous it is. These doctors appeared for exams and qualified and there is no light at the end of the tunnel.
Justice Chandrachud: please prepare and move the IA. Please don't invite adverse remarks from this court
Sr Adv Vikas Singh: this is unfair to OBC candidates
Justice Chandrachud: yes it is unfair to obc candidates also
Justice Chandrachud: In 2020 Madras HC issues directions in a plea involving case of OBC reservation against OBC quota seats for UG PG Courses in dental faculties. HC directed the constitution of a committee by the Centre through the DGHS and to finalise its recommendation
Justice Chandrachud:.... in consultation with states and Tamil nadu. This judgment was challenged on the ground that there is no legal or constitutional impediment to implement obc reservations for the academic year of 2020-21.
Justice Chandrachud: the committee after holding discussions framed rules that can be implemented. Interim order dated Oct, 2020 contains the following directions.
Justice Chandrachud: Mr Vikas Singh submits that pursuant to orders of this court, the process was required to be completed and directions of HC to be implemented. the appellants have already appeared for NEET entrance.
Justice Chandrachud: It is necessary that counselling be conducted so that students can start their courses. ASG Natraj submits that an IA will be moved in the pending case seeking extension of time for the commission to conclude its work/ let the ia be filed within a week
