@cambell_karen@kyoag The precedent was set during a time of low standards of healthcare and for a highly fatal virus (Mortality rate was 30%). The case (which was from 1902 btw) had stipulations however and was not a whole sale green light to impose vaccination on a whim.
@cambell_karen@kyoag They made it clear in the ruling that mandates can in fact be arbitrary and oppressive if they extend beyond what was reasonably required for the safety of the public which in today’s day and age feasibly could be presented to override the precedent set.
@cambell_karen@kyoag Not only that but the Massachusetts law was not a blanket legislation. The legislation specifically assigned the power to use this power at the city and town level limiting scope. This was not imposed on a state level and forced outside the areas of impact.

@cambell_karen@kyoag Compelled and fined. Also this law specifically limited those who it applied to limiting it to adults 21 and older. There’s numerous arguments in 2021 that could be made which would change this precedent and the manner itself is highly questionable constitutionally
@cambell_karen@kyoag Fact is I’d say the attorney general, has every reason to deem this unconstitutional and is like right. A century old case is not unquestionable and the case itself makes clear these powers can be abused but deems the general concept constitutional conditionally
