THREAD: 1. Govt wants to amend Registration of Births and Deaths Act, 1969. The amendment will allow Central govt to create a unified database of all registered births & deaths. Currently, this is carried out by states. But now Union will be allowed to collect data
2. The unified database will be used for NPR-NRC, electoral rolls, passports, etc. Currently, these are all separate processes. For example, electoral roll enrolment is done by an INDEPENDENT body, ECI. Now Union govt can allow birth/death register to be used for enrolment
This violates Article 324 of the Constitution that gives independence to ECI. It also violates the Constitution as the NPR rules are themselves unconstitutional and data should not be collected under it.
3. Furthermore, Puttaswamy judgement had struck down attempts to link Aadhaar with telecom and banking services. Here it is being used to expand the use of birth/death registration to Aadhaar, voter enrolment, NPR, etc.
The right to privacy includes the right to be protected from such acts where data is collected for one purpose (in this case, birth registration) and to use it for other purposes not expressly authorised by the person giving their data (NPR, voter enrolment, etc).
4. Registration of births and deaths falls in the concurrent list. Currently states have the power to collect this data, why is this power being taken away? Why are states not opposing it?
5. ~38% of kids under age of 5 don’t have birth certificates. Even among those who had their births registered, some still don’t have certificates. People who were born earlier, have even less chance of having registered births or certificates since they weren’t born in hospitals
If this is used for proving citizenship or enrolment in electoral rolls, how many will get excluded? Remember, proof of citizenship requires you to not only prove that YOU were born in India but also that your parents are Indian. How will you do it when no doc is proof enough?
6. 82.3% of children under the age of five in the richest wealth group had their births registered and possessed a birth certificate, only 40.7% in the poorest wealth group did. The poor (majority of whom are Muslims, STs, SCs and OBCs) will suffer the most because of this.

Modi’s speech on human rights at #NHRC today exposed his problematic & incorrect understanding of human rights. Most unfortunate part was that there was only one passing mention of the constitution, but references to ‘tradition’, ‘culture’ & religion could be found throughout.
1. A constant Hindutva talking point was repeated by Modi; that human rights & duties are dependent on each other. No. Rights against state always trump duties. Duties are not enforceable, rights are.
People in power failed to discharge their duties. This resulted in a deadly second wave where people died without vaccines, oxygen & hospital beds
The statements after the latest round of talks with #China clearly show that they’ll continue to remain on Indian territory & @PMOIndia can do nothing. Sad that a new status quo has been created on LAC. This denies our forces access to the areas they traditionally patrolled. 1/
This loss of control over our territory to China has been on for 20 months, but Parliament has not been briefed in detail nor have questions been taken in an open press conference. Why is Modi silent? Or does he still say that no one has encroached our territory? 2/
