A note sent from the jury to Judge Moon in the ‘Sines v. Kessler’ case just now - the jury asks “under punitive damages…can we separate out the amount that is awarded to individual plaintiffs?”
Moon proposes telling the jury no, “but only plaintiffs awarded compensatory damages will share in the punitive damages awarded”
Judge Moon says he received a letter from Chris Cantwell asking to be brought to the court whenever the jury asks any more questions… Moon says that the defense side can just have one person present while jury notes are being read.
Another note for Judge Moon has arrived from the jury, should be read in court shortly.

Possible verdict incoming - court marshals are inviting sketch artist and an extra pool reporter into the courtroom

We're waiting for the video feed in the courthouse media room to show Judge Moon & attorneys in the 'Sines v. Kessler'#UniteTheRight Charlottesville lawsuit - if this is in fact verdict time, the jury will read off their findings as to each defendant & plaintiff, damages etc.
The courtroom media feed video monitor has zoomed out to show attorneys on both sides - Judge Moon is currently not at the bench.
Judge Moon is taking the bench now...
Judge Moon says he got a note from the jury saying they have achieved a verdict:
"We have unanimously decided on claims 3,4,5 and 6 after reviewing the final jury instructions and discussing claims 1 and 2 at length, we are deadlocked, we do not believe this will change"
Judge Moon says he intends to call the jury, receive their decision, send the jury back to the jury room, and then hear arguments
Plaintiffs request that the jury receive an Allen Charge on counts 1-2.
Judge Moon: they indicated they could not receive a unanimous verdict on 1-3, I told them to reach a unanimous verdict on all counts... if after further deliberations they still feel they cannot reach a verdict... I will not make them stay
Dunn (plaintiffs): I don't know if the jury has received the Allen Charge...
Judge Moon: I don't know if the 4th Circuit is on board with the Allen Charge
Dunn: we'd ask the jury be asked to decide counts 1-2 defendant by defendant
Judge Moon calls the jury back in
Dunn: we have a proposed charge... we ask that it be included to... encourage the jury to consider defendant by defendant...
The jury is coming in now
The jury foreperson just handed the verdict form to the marshal
Judge Moon is opening the verdict form
Judge Moon is about to read the jury's verdict form (he was not clear as to the plaintiffs' request to have defendants charged one at a time on the first 2 counts)
Judge Moon asks the clerk to publish the verdict

Judge Moon asks if any jurors believe the jury could possibly still reach a verdict on counts 1 and 2, even if it was one defendant at a time. No one raised their hand so Judge Moon says he "will respect the verdict of the jury."
The jury is sent back to the jury room. Judge Moon seems to have declined to sent the jury an Allen Charge based on the first two claims as the plaintiffs had requested.
Roberta Kaplan to Judge Moon: there have been entries of default entered for the following defendants; Andrew Anglin, Moonbase Holdings LLC, East Coast Knights of the KKK, Fraternal Order of the Alt-Knights, August us Sol Invictus, Nationalist Front
Kaplan says default motions will be filed.
James Fields' lawyer David Campbell says he will be making a motion to Judge Moon to reduce damages. Judge Moon says he will give all counsel a copy of the verdict form. Josh Smith (TWP lawyer) says he will also make a motion to reduce damages.
Judge Moon tells the jury he is pleased with "civil" behavior by parties in this case, says they have been "a credit to the legal profession."
Moon says "those who represented themselves acquitted themselves well... no one could have asked for a trial to go better"
Correction: punitive damages against individuals here were $200k not $500k each as we initially tweeted in a hurry
Total of compensatory and punitive damages in this case is around/over $25 million
The jury found 'Unite The Right' defendants violated Virginia state civil rights laws against hate crimes but failed to agree on a verdict about violations of the federal Ku Klux Klan act. ~$25 million in total damages. Individual neo-nazi leaders all owe $200K, all orgs owe $1M.
*$500k, not $200k

Court is starting for the 21st say in the civil trial of the ‘Sines v. Kessler’ lawsuit filed against organizers of the Charlottesville neo-nazi rally. Judge Moon says the jury arrived at 8:30 AM and already began deliberating
Apparently on Friday jurors asked for a transcript of defendant Matt Parrott (co-leader of the neo-nazi Traditionalist Worker Party) - Moon says he will allow the jury to request particular portions of the transcript.
Court has adjourned until the hear from the jury - either with a note/question or if they’ve reached a verdict.

Judge Moon is excusing a juror whose two children were possibly exposed to COVID-19 at their school. The juror is unvaccinated.
Judge Moon calls the jury in, before he begins reading them their final jury instructions he tells them about excusing juror 210 due to the COVID issue.
Judge Moon reminds jurors that they have to consider all witnesses’ testimony regardless of who called them. Reminds them that opening and closing arguments are not evidence.
