Ukrainian govt doing a masterful job here.

1) They've released names of individuals in Russian brigade that committed atrocities in #Bucha

2) They report the brigade is redeploying toward Kharkiv

First, let's hope US/NATO intel is used to capture these suspected war criminals ImageImageImage
Second, take note especially of the Russian military officers on the list. They could be held criminally liable under the doctrine of "command responsibility."

By way of example, Article 28 of the #InternationalCriminalCourt statute.👇

Third, the fast redeployment of brigade = evidence of criminal liability for Putin and top Russian officials for the atrocities in Bucha.

The redeployment is a clear failure to take "necessary and reasonable measures" to repress the atrocities (so is their attempted coverup).

Important opportunity here for Congress to fix (long-overdue) #WarCrimes Act so DOJ can go after #Russian war crimes in #Ukraine.

Also important for DOJ to use existing authority to investigate killings of American journalists.

2. As Chen, who served in Dept of Justice 2006-2016 including special unit handling war crimes, writes:

a. Under War Crimes Act, 18 USC § 2441, DOJ can prosecute killing of American civilians.

b. Russian forces have killed American journalists in Ukraine.

3. Chen also proposes fixing War Crimes Act so that it's not limited to US perpetrators and US national victims of war crimes.

Indeed, long, long, long overdue.
