Headlines ⁦@thetimes⁩ this morning ⁦@michaelgove@luhc confirms ⁦@GOVUK⁩ to blame for #Grenfell but holds developers over a barrel for remediation costs shortfalls

Michael Gove: We are to blame on Grenfell | News | The Sunday Times thetimes.co.uk/article/michae…
@michaelgove makes a remarkable admission in today’s @thetimes

“faulty and ambiguous”

government guidance allowed the scandal to happen.

As I’ve said all along @GOVUK legislation & guidance was the root cause & large part of the compounding failures leading to #Grenfell Image
@thetime citing remediation fund of £9.1bil

Fact check please: recall @GOVUK has agreed to £5.1bil building safety fund

Do we assume balance of £4bil is coming from developers pledge or should we say developers attempt to cap (unlimited) liabilities in deals behind closed doors Image
@michaelgove is either a genius or opened up an unholy can of worms.

Pic 1 Placing the root cause failures with @GOVUK

Pic 2 But then expecting developers to pick-up the tab on the remediation cost shortfalls ImageImage
No where do we see minister going after:

Designers
specifiers
fire engineers
manufactures
constructors
specialist contractors
approved inspectors or building control
management cos
warranty providers or PII insurers

Hence developers have deep war chests to push back or sue! Image
@michaelgove hints that @grenfellinquiry will “allocate responsibility appropriately”

There is already legal precedent following the judges ruling on the #LacrosseFire in Australia

Where the judge assigned significant costs against the contractor & other project principals ImageImageImageImage
Just as the #lacrossefire + #Neo2000 cases lurched into lengthy legal claims & generating millions in legal fees.

Anticipate we will see decades of post #grenfell + near 10,000 impacted blocks heading into decades of legal claims and counter claims.

blogs.law.ox.ac.uk/housing-after-… Image
5 1/2yrs on can we get a simple - straight answer to the following

1 how many impacted blocks

2 how much is the estimated cost to fix

3 how much is in the @GOVUK building safety fund

4 how much will developers levy or new pot contribute

5 what is the short fall ImageImageImageImage
Previously stated that post #grenfell remediation costs could range between £50-100bil

Again the estimates from the #lacrossefire (claim A$ 12.6mil) across 1,000 other impacted blocks could amount to A$1 billion legal costs alone.

Now scale-up to est 10,000 impacted UK blocks! Image
@michaelgove appears to have stacked-up press interviews & making a number of revaluations on #grenfell failures

Is this preemptive for the @grenfellinquiry phase 2 report or a minister genuinely apologising.
I’m not the only sector commentator to question today’s statements by sec of state.
Also adding respected sector leader @formerCEOciob

Agree cut the money off, come down hard with unlimited fines + custodial sentences & we’ll see the necessary changes to improve the safety culture from CEO to all levels in the sector.
When they first read the @thetimes article by @Lees_Martina and @HarryYorke1 you think scoop.

When you see the sec of state on other news outlets, it’s starting to look like a carefully crafted crisis response &/or leverage against developers.

Let see how this plays out! ImageImage
Call me skeptical but isn’t sec of state not testing another crown pleaser on leasehold reform

Whilst admitting @GOVUK was at fault but quickly moving to developers must pay.

Let’s see how this stands when the anticipated legal challenges or pushback are inbound.
Here’s the front page @thetimes everyone’s talking about

Truly hope this the turning point for everyone impacted by #grenfell - truly hope that this won’t end in disappointment for so very many trying to hand onto their homes. Image
Good to see more press coverage on @luhc sec of state statement on oot cause & compounding failures leading to #grenfell

We have to remember it’s not just residential high-rise impacted but across the built environment

Instead of tinkering with approved documents - overhaul!
Trade press catching-up on @michaelgove @luhc statements over government guidance ambiguity + giving developers 6wks to sign-on to new terms.

Sector whispers - all good & well ministers positions but we work in the real world & better deals to be made!

constructionnews.co.uk/health-and-saf…
Also adding product test houses, product certified & 3rd party accreditation schemes!
@insidehousing posting a number of features today following sec of states announcement
Residents perspective & will sec of states positions statements be any constellation?

#BuildingSafetyCrisis

theguardian.com/society/2023/j…
Developers given opportunity to comment on the contracts?

Expectation those who have must sign up in six weeks or find a new line of business.

@michaelgove @luhc doubles down but also cites ambiguous guidance contributed to #grenfell - will developers use this as defence?

As ex London vice chair to the #EmergencyPlanningSociety - #disastermanagers will be implementing civil contingency responses to the #Firefighterstrikes

Homeowners & business operators should also implement fire risk reduction measures where possible

Press DMs open for comment
Remember that the fire-service respond to a range of incidents beyond fire-fighting from road traffic accidents to flooding, search and rescue operations.

However business might consider letting staff work from home on strike days & offering fire safety advice.
Businesses should test fire alarm & run drills on fire alarm response, first aid fire-fighting, assisted evacuation for disabled occupants & suspending hot-works etc.

At home test your fire alarm & ensure everyone know an what to do in event of a fire.

One of my favourite projects was - resolving a long standing fire safety issue on one of the first UK #protonbeams.

What’s the point of all this knowladge if we can’t do some good in the world!

Breast cancer patients take part in proton beam trial bbc.co.uk/news/health-64…
Here’s how I achieved in 30mins that which a global design team struggled with for months if not years

So we have new technology = proton-beam

The problem was a high RPM spinning shaft, going through a fire compartment wall & how do you make the fire seal.
Traditional fire stopping wouldn’t work eg

Intumescent seals would heat activate with the shafts RPM friction

Proprietary fire stopping systems or collars would have the same issue

We had to separate the patient treatment from the plant areas

This was urgently needed tech

lots of position statements on modern methods of construction #MMC as @NFCC_Chair highlights the dangers (thread)

@stuartgreenUoR
Excellent points from @emmadentcoad on modern methods of construction #MMC

Wed do well to listen to the Ex MP who championed post #grenfell response & legislative overhauls.

@andrewjteacher @GeorgeNHammond @ftweekend @GrenfellUnited @officialJ4G Also worth reading a the earlier #Australian #LacrosseFire ruling which may present a cost recovery option for the contractor under vicarious liability against project principals

Three appealed but judge also found against them.

architectureau.com/articles/lacro…
@andrewjteacher @GeorgeNHammond @ftweekend @GrenfellUnited @officialJ4G Then there’s this gem of a case & ruling also upheld on appeal

Sahib Foods Ltd v Paskin Kyriakides Sands (a firm) [2003] EWCA Civ 1832

Hence predict stormy waters ahead for developers, contractors, architects, specifies, consultant (fire) engineers etc

cms-lawnow.com/ealerts/2004/0…
@andrewjteacher @GeorgeNHammond @ftweekend @GrenfellUnited @officialJ4G Finally there’s the post #grenfell remediation cases where the mistakes of the past & present are being quietly swept under the carpet

Remember this one as clear as day - 23 June 2017 week after #grenfell

Was waiting on the bus home - absolutely shattered (thread)

Grenfell fire: Theresa May attacked by fire safety expert for not treating disaster as national emergency independent.co.uk/news/uk/home-n…
Call came in from @gtubbsky @skynews back of 8pm 23 June 2017

Gerard: Steve we have another one

Me: another #Grenfell

Gerard: no! five tower blocks in Camden are being evacuated

Me: let me check the jumbo tv (in Woolwich Sq normally showing @BBCNews)
Me Put me on now

Gerard - going live 3, 2, 1

I recall saying:

where the hell is Teresa May,

why hasn’t Parliment been recalled,

why hasn’t COBRA been convened,

where is the Home Office & MHCLG fire experts

this is turning into a PR disaster for Local Authorities

Everyone should brace for a lot more of this whether a leaseholder, shared owner or social housing tenant

Many building owners & operators have been in a holding pattern until #FireSafetyAct + #BuildingSafetyAct became law

Some will await secondary legislation & guidance 1/
Some will postpone until the 11th hour - however demand is outstripping supply of labour, goods & services

As a result of #brexit + #covid labour & material costs are more expensive now than 5yrs previous when #Grenfell exposed a #buildingsafetycrisis /2
Additional stressors disrupting global markets increases costs from #suezcanalcrisis to #UkraineRussianWar have sent fuel & material costs sky rocketing, all with oncost, profit & vat at every level.

Literally the shop has sailed & any remediation will cost infinitely more /3
