On Monday, the #calcuttahighcourt directed the state government to deploy adequate police force in the affected areas where incidents of violence took place during the #RamNavami procession so that peace and tranquillity prevail.
ACJ: We have read in the news how it all started, it is there everywhere on social media. We want the Advocate General to tell us what is State's plan to tackle the situation.
ACJ: State can take the help of some other forces like Paramilitary etc if there is an inadequate police force within the state. After all, we need to ensure the safety of citizens.
ACJ: We received a letter written by a sessions judge to the Registrar of the HC informing that violence started near his residence and he sought help from the police, however, no help was offered to him.
ACJ: The Sessions Judge said that he lives near a Lord Hanuman Temple and the anti-social elements are trying to target the said temple. He said he is not getting any help from the local administration.
ACJ: He sought HC's help for police protection. Now what happens is all these judges reside in these districts, and they have to go to work. You said you have arrested some people, then they will have to be brought before the judges for remand.
ACJ: Then what will happen is that the surcharged atmosphere will also get into the court complex as well. Something needs to be done about this. You can barricade these routes. Police can take out peace marches to assure the citizens that they are safe.
ACJ: You can designate short routes so that religious sentiments are not hurt. If you have shortage of police force, you can take the assistance of central forces.
ACJ: You should not take this as adversarial litigation, dont give this a political color. We can always discharge the petitioner (@SuvenduWB) and appoint an Amicus in this matter and proceed ahead.
AG: The state has imposed 27 conditions on those seeking to carry out processions. The state will allow a tableau for the Hanuman Jayanthi procession. The person/organization applying for permission is to be held responsible for the breach of conditions.
AG: Since over 2000 application seeking permission has been received by the state for tomorrow's Hanuman Jayanthi processions, the state can not barricade all the routes in such a short time but we will barricade sensitive areas.
AG: I want to say something. #RamNavami and #hanumanjayanti processions were not very common thing for Kolkata and for West Bengal. But, in the last 5 years, these have started. Unknown applications have also started applying for taking out the procession.
ACJ: Looking at the magnitude of the crowd that will assemble, I don't think state police will be adequate. The state can seek assistance from Paramilitary forces. It is to assist the state machinery.
ACJ: A lot of these have started coming up recently like in 5 years. Western influence etc. But once it has come to the state, it has come to the state.
BJP leader and Lawyer Priyanka Tibrewal (@impriyankabjp) submits: The Chief Minister of the state has made utterances against one community. Can a CM make biased statements?
Adv Tibrewal (@impriyankabjp): She (CM) is saying it is the month of Moharram, and Muslims cannot do anything bad. It is upon you Hindus to ensure that they stay safe. Hindus should protect them. #calcuttahighcourt#RamNavamiViolence
Adv Tibrewal (@impriyankabjp): What does this mean? that you have divided the State between Hindus & Muslims? Such biased statements coming from the CM. This resulted in further violence.
Adv Tibrewal: Despite Court's orders, there was violence. I was part of a rally where the violence took place. I was brutally attacked on my eyes, and I had to get operated on. Police stood there as a mute spectator just next to me.
Adv Tibrewal: AG says that #RamNavami and #hanumanjayanti are recent fashion, can we say so regarding one community, can we question their belief?
If it is a fashion and people are on the streets can we stop them?
Adv Tibrewal: Can we do the same for some other community. If such rules are made today, can AG say that such rules will apply to processions of Muharram or Eid?
ACJ: Obviously. Nobody has got a right. You are entitled to free movement and if that is going to be hampered, then the definitely State can put restrictions. The rules will apply to all rallies and processions.
#SupremeCourt hears petition challenging Section 64 of the CrPC the ground that the said section discriminates against women by treating female members of a family incapable of accepting summons on behalf of the person summoned.
Section 64 of CrPC relates to service of summons when a person summoned cannot be found. The section states that summons can be served with an "adult male member" of the family of the person summoned.
AG: Consultation has taken place. In fact, I've personally asked the government to take an active role in this. Some of this has to do with sedition laws.

#SupremeCourt to hear shortly the petition filed BJP UP Spokesperson Prashant Umrao challenging the Madras HC's pre-arrest bail condition that he should appear before police for 15 days in the criminal case for allegedly spreading fake news about attacks against Bihari migrants
A bench comprising Justices BR Gavai and Pankaj Mithal will also hear another petition filed by Prashant Umrao seeking clubbing of multiple FIRs registered by Tamil Nadu police over his tweets.
Senior Adv Siddharth Luthra for petitioner : State has multiple FIRs. I have got protection in one FIR. If I appear before police as per bail condition, I will be arrested in other FIRs.
The ordinance fixes max age of 50 years for appointment as Tribunal Members.
Sr Adv Rohatgi: These are four officers. Two of them were district Judges who left their posts and joined there, one was AOR here who left here and joined there.
Rohatgi: It is very clear that we will retire according to rules then prevailing when we applied in 2016. When they were appointed in 2018, they slipped in the line that the tenure will be 5 years or 62 whichever is earlier- this is completely wrong.
Petitioner: After the last order, there was a meeting by SC Committee on Road Safety with 15 states. Each state indicated to the committee what steps were taken. It was decided that a standardization was required - which electronic monitoring to be used, budget was also discussed
Petitioner: The committee met the Home Secretary because implementation needs to be there.
CJI DY Chandrachud: MP HC cancelled the bail. HC observed that bail was granted by Trial Court without taking into account an earlier order of HC and hence the mere fact that the chargesheet that was filed could not be considered as change in circumstances.
