We're down to the last few days of #EastmanTrial -- a few hours at 2pm EDT, then 10/30 for sure. Possibly 11/2 and/or 11/3, but the judge said 11/3 is it. Miller still not done with Eastman's direct, and CA Bar has a lot more to ask now. I'm still with @tomryanlaw on this:

Meanwhile, #HouseGOP: “It’s a dumpster fire, frankly,” Rep. Bill Huizenga (R-Mich.) told reporters as he left the room. Speaker designate Rep. Tom Emmer (R-Minn.) will talk to the roughly 2 dozen holdouts. All reconvene at 4pm EDT. MAGA's biggest star, Catturd, is seething.

2:10pm EDT: And here we go! Duncan Carling was on camera, they're on Zoom again today. I'm going to miss Judge Yvette Roland, she's been terrific. Everybody's checking in and then off to the races.

The parties think they've reached a stipulation re a tranche of pre Jan 2021 exhibits collected in Eastman's file. That will reduce Miller's need for time with Eastman. There's a second tranche, of post Jan 2021 documents, & they are trying to work that out. #EastmanTrial

Judge Roland notes that many of those document were ruled inadmissible. She says don't spend a lot of time on that. The court won't be inclined to receive those documents in any form. Miller said he'd like to make a proffer "for the record".

Miller said he only has a few more areas & ready to start with Eastman. Carling signed a stipulation this morning on the pre 2021 documents, they haven't discussed the 2nd tranche. These are documents that Eastman reviewed (we heard a lot of them previously). 140+ exhibits.

"Aspirationally" Miller would like to be finished with John Eastman's direct exam today. Judge notes 3 days next week (guess that's confirmed now). Looks like remote on the 30th. Live for closing arguments Fri 11/3. Court needs remote on 11/2.

Eastman is trying to dispute the CA Bar's NDC. Eastman objects to "no reliable evidence". He mentions an audit in Ware County GA & Mesa County CO "forensic audit" by Jeffrey O'Donnell. (Tina Peters criminal election case.) Carling moves to strike audit results, hearsay. Sustained.

Eastman is talking about Garland Favorito's VoterGA press release. Eastman is trying to dispute NDC about statistical analysis. Eastman says some craziness about a "5% differential" in votes on Dominion machines. 🙄 He can't remember the study. #EastmanTrial

Now they talk about Prof. Haldeman, their holy grail on election machine issues. Election deniers leave out that Haldeman said he’s seen "no evidence the vulnerabilities were exploited to change the outcome of the 2020 election". Eastman keeps up about Antrim County

Now to paragraph 24 of the NDC (Notice of Disciplinary Charges) by CA Bar. Eastman says letter doesn't refer to him in Pences' Dear Colleague letter & request he made to Pence was to delay, not to just not count. He says an inaccurate attempt to link it to him.

Eastman said it was "legislatures" not "legislators" and for Pence to send the results back on a delay.

They turn to a letter from the PA Senate 1/4/21.

JE: PA Senate letter to Congressional leaders saying a majority of Senators (Republicans) thought the election shouldn't have been certified.

JE: No because not in session, signed by Republicans

PA Senate letter that Eastman found very important, they said the results shouldn't have been certified. (This was where Trump was exerting pressure on PA legislators.)

John Eastman felt this was the "penultimate paragraph" in the PA letter. Judge confirms it was NOT an official state document, it was written by Republicans in the PA Senate led by Jake Corman.

John Eastman thought this was also an important letter -- it was from 100 state legislators asking Pence for a 10 day delay to determine if the election should have been certified. JE: "This was consistent with the request I had made with whether there was illegality."

Judge: The letter doesn't request an audit or recount.
JE: No, delay. Election challenge still pending in GA, the US Supreme Court, Wisconsin...
Judge: Any recounts?
JE: Georgia. Recount doesn't get to the question of illegality, need an audit and that wasn't conducted.

Eastman is disputing the NDC ethics charges. He's trying to show that others were asking for what he was. Of course, these were all Republicans, and they weren't official state documents, these were Trump supporters. Another letter, to Scott Perry.

Letter: JE: Lead was PA Rep. Frank Ryan identifying issues for delay
JE: Like significantly larger number of ballots vs. voters (or voted before sent out)
Judge notes this letter doesn't discuss non-legislative officers taking actions that impacted the election.

This letter contained actions which "undermined" the PA election. It detailed issues "violations of state law".

Eastman is talking about what was happening at the time. Subsequently, the charges were adjudicated and many/most claims were proven bogus.

Eastman: Ballots were returned before the mail date. To this day I find it "deeply troubling" that ballots were returned before the mail in day, 110K ballots on a state where margin was 80K.

PA "concerns" before the election about voting changes. (Republicans passed Act 77. Changes were made because of COVID. Expert on this is @R5Philly, check his X feed for lots of great info.)

Judge: Not approved as official document?
JE: Official act by legislators in the state
Judge: Not official as state action if not adopted or approved by body right?
JE: Introduced, not taken up by the state house. Legislative session ended that day, that's why it wasn't taken up

Judge: Not official, it's just some legislators vs. the Pennsylvania Legislature.
JE: "When elected officials are saying the same things that I'm saying it's highly relevant... It's about the charges against me.
(Just become partisans wrote things doesn't mean they're true.)

Arizona letter to Pence about "Reclamation of Electoral College Electors from Arizona". Now we know the Trump-nominated Republican Electors were illegally sending bogus votes to the government & that people like Speaker Bowers were totally against these election subversion attempts. #EastmanTrial

Judge to Miller: Eastman gave over 100 pages of response to the NDC charges. Since he's responded, we're not going line by line on the 34 pages of the ethics charges. RM then does just that & reads all the highlighted of paragraph into the record. Judge doesn't want it again.

Eastman disagrees: It's not "grossly negligent" because he doesn't think 12A precluded giving it back to the states. Also thinks it's inaccurate under Article II. Eastman gets testy about this. RM then goes completely in another direction asking what he did after he spoke 1/6.

RM: When were you aware of violence 1/6?
JE: We were watching the joint session on TV so at the time.
RM: Following Trump tweets from 1/1-1/6?
JE: Don't think so but don't recall, saw Trump's tweets about VP later.

They are discussing Dr. Seligman's report & testimony. Eastman is peeved about it.
JE: Didn't provide info on federal convention, "gross oversight", Extremely important about the role of Congress... they excluded Congress. If they hadn't would be a parliamentary system.

Eastman is getting his anger out about Sidney Powell, Ken Chesebro, Jenna Ellis, his role in all this and the likely result. He attacks Dr. Seligman, saying he didn't examine things Eastman wanted & thinks are important. He goes back to a 1789 Senate Journal.

Eastman makes a big deal out of how it's a "formal thing" and "not reporter's notes" but the official record of the Senate. He's agitated & confusing himself. It's interesting that he's so into OFFICIAL but a few minutes ago, the PA note by some legislators was sacrosanct. Bro.

John Eastman is hopped up discussing this Senate action in 1797. He's continuing to define his position that these actions gave credibility to his actions regarding the 2020 election. #EastmanTrial

John Eastman is continuing to discuss a Congressional debate. Randall Miller wants to know how Eastman sees that related to the VP's abilities.
JE: They debated for several days & historical precedent is that the dispute mechanism is resolved by the VP. House & Senate were just there to be present.

Here we go again back into the mud. Eastman thinks report by Jeffrey O'Donnell was a "sustained forensic analysis". He says the only forensic audit was in Antrim County (maybe Ware in GA).
(O'Donnell has a big role in the Mesa County Colorado illegal activity with Tina Peters.)

John Eastman says Jeffrey O'Donnell is credible & report is significant.

Judge Roland asks the difference between significant and RELIABLE evidence. 🔥

Court is not admitting this. Miller says relevant to paragraph 24. Decision stands. Miller tries to argue.. Let's move on.

Randall Miller now talks with John Eastman about Prof. Grimmer. JE: He was critical of Cicchetti & Gilles work related to the signature verification disqualification rate related to the settlement agreement in Georgia. JE: I think there's a lot of looseness in definitions.

Three criticisms of Grimmer:
1) False about ballots received late
2) Issues with consistency
3) Grimmer acknowledged the rate declined from .38% 2016 to .15% in 2020. He wrote that off as small but its a 46% difference, which 6500 if applied to all is more than 1/2 total margin.

Eastman is strident, talking fast, being hostile and angry. He thinks the "illegal consent decree" that GA officials signed was the cause of the problem. That's not the position of the state of Georgia.

Dr. Grimmer criticized Gilles work. Eastman points out late rejections are not on this chart. He thinks there's a lack of consistency between counties. He reiterates it was a 46% decline in the rejection rate. "If signatures don't match, it's not the voter."

Weakening of the signature verification process "allowing illegal votes" because of the "illegal consent decree" (meaning that it wasn't approved by the Legislature, that's his whole position) was significant. It would have been 30-40K votes, far beyond the margin in GA.

Eastman is being testy with Judge Roland, it's all feeling rushed. (Opinion: Not the best way to deal with the trier of fact.) Now back to underage voters, and Gilles' report with all wrong numbers while Eastman relied on. Shows Raffensperger's report disputing election claims.

Secretary Raffensperger (another Republican) slammed Gilles (and Eastman's) data about Georgia considered the wrong number for "underage teenagers". Miller is rushing to the next exhibit. Last 25 minutes for today.

Duncan Carling is letting it go, but we've seen this before & heard this testimony. Eastman is slamming Raffensperger, he said it "debunks a claim that isn't there". 🚀 Whoa, on to State Farm Arena tape (this is the Ruby Freeman nightmare).

John Eastman is repeating disputed, debunked talking points about "counting" at State Farm Arena without observers were counted illegally. Eastman should talk to Rudy Giuliani who is being made to pay huge money for this intimidation and lost his bar license too. Coming soon.

Just what I expected...
Judge: Basis of your understanding of what you've described?
Eastman: Sworn affidavits...
Judge: Sounds like hearsay to me.
Miller: Let's move on.

John Eastman is showing why his mentor called him a "political animal". He's trying to steamroll bogus info fast.

That ended abruptly. I don't think the judge was happy with the pace, Miller's behavior (once again she had to raise her voice about LEADING) & the rush of material.

That was wild! #EastmanTrial went off the rails with Randy Miller's rushed questioning & Eastman's nasty tone talking about debunked points folks are going to jail over.

Sill no smoking gun testimony. except here. As Tom Ryan said, still not one thing to exonerate Eastman.
